Decree No. 2014-1682 of 30 December 2014 approving the statutes of the community of universities and institutions "Languagedoc-Roussillon Universities"

Publics concerned: users and staff of higher education and research institutions of the community of universities and institutions (COMUE) "Languagedoc-Roussillon Universities".
Subject: approval of the statutes of the scientific, cultural and professional public institution "Languagedoc-Roussillon Universities".
Entry into force: the text comes into force on the day after its publication.
Notice: this decree approves the COMUE statutes, in accordance with theArticle L. 718-8 of the Education Code. The establishment is composed of the following members:
- under higher education institutions: the Ecole Nationale Supérieure de Chemistry de Montpellier, the University of Montpellier-I, the University of Montpellier-II, the University of Montpellier-III, the University of Nîmes and the University of Perpignan;
- for research organizations: the National Centre for Scientific Research and the Research Institute for Development.

    Preamble


    Vu la Act No. 2013-660 of 22 July 2013, including article 117universities and research organizations present in the territory of the Languedoc-Roussillon, heirs of a long tradition of collaborative work, in a changing regional, national and international context, decide to contribute collectively, as members, associates or partners to the creation of the community of universities and institutions (COMUE) Languedoc-Roussillon Universities, public institution commonly carrying the policy of the site Languedoc-Roussillon
    The community of universities and institutions "Langudoc-Roussillon Universities" brings together in an original model, a set of autonomous institutions of higher education and research and research organizations, which while retaining their legal personality, agree to coordinate their actions and to pool certain means within the framework of a shared project defined and implemented jointly.


    Statutes of the public institution with a cultural and professional scientific character « Languedoc-Roussillon Universities »

    • Part I: GENERAL PROVISIONS Article 1


      It is established a community of universities and institutions established in the legal form of a public institution of a scientific, cultural and professional nature under the jurisdiction of theparagraph 4 of Article L. 711-2 of the Education Code, whose name is "Langudoc-Roussillon Universities".


      Article 2
      Composition and principles of membership and withdrawal
      Article 2.1
      Composition of the COMUE


      At its inception, the COMUE brings together the following members:
      1° Université Montpellier-I ;
      2° Université Montpellier-II Sciences et techniques ;
      3° Paul-Valéry University Montpellier-III;
      4° University of Perpignan Via-Domitia;
      5° University of Nîmes;
      6° Ecole nationale supérieure de chemistry de Montpellier;
      7° Research Institute for Development (IRD);
      8° National Centre for Scientific Research (CNRS).
      The rules of procedure will specify, for each research and institution of higher education and member research, the entities under which it is a member of the COMUE.


      Article 2.2
      Membership principles: members, partners or partners


      Other higher education and research institutions, other research institutions and other institutions can join the COMUE grouping:
      1° be as "members" provided that their application is approved by the Board of Directors under the conditions set out below;
      2° Either as a "associated" by decree following the signing of an association agreement with the COMUE, in accordance with the third paragraph of Article L. 718-16 of education code. At the creation, the "associated" are: the Ecole des Mines d'Alès, Montpellier SupAgro and the Ecole nationale supérieure d'architecture de Montpellier;
      3° Be as "partners" by signing a partnership agreement with the COMEU under the conditions set out below, as well as in accordance with first paragraph of Article L. 718-16 of the Education Code.


      Article 2.3
      Group withdrawal principles: members, partners or partners


      The application for withdrawal of a member or the denunciation of a partnership or association agreement shall be communicated to the President of the COMEU no later than six months before the date of withdrawal envisaged.
      Any establishment with membership status and no longer wishing to be a member may apply to be a partner or partner of the COMUE and/or join another group.


      Article 3
      Headquarters


      The COMUE headquarters is located in Montpellier, 163 Auguste-Broussonet Street. He may be transferred to another place, on the proposal of his president, after deliberation of the board of directors.

    • Part II: MISSIONS, COMPÉTENCES AND MEANS


      Article 4
      Missions


      COMUE carries the shared project provided for in the articles L. 718-2, L. 718-5 and L. 718-16 the code of education in research, training, valorization and, in particular, the transfer of technologies, the professional integration of users, international action, communication, the diffusion of scientific, technical and industrial culture and campus life.


      Article 5
      Jurisdiction


      On the basis of the shared project, for the realization of its missions, and in accordance with the principle of subsidiarity, the COMEU exercises the following skills:


      Article 5.1
      Clean skills


      In agreement with members and on the basis of the shared project, the COMUE ensures:
      1° Development and implementation of the common component of the multi-year site contract;
      2° The launch of new research programs or projects within the framework of the shared strategy;
      3° The definition and management of the common doctoral policy of the site and its coordination by the doctoral college that can go, with the agreement of the boards of the institutions concerned, until the grant of the doctorate in the thematic fields being part of the IDEX;
      4° The definition of a common policy for the signing of scientific publications, while ensuring that each member and partner has the visibility of his contributions;
      5° Communication on the COMEU within the scope of the shared project;
      6° The piloting and monitoring of the real estate program of the campus operation and upon express request of one of its members, the piloting and conducting of real estate and/or development operations and the conduct of studies in these same areas;
      7° Piloting the structuring of different scientific communities, through cross-cutting axes responding to societal challenges and thematic clusters such as the Balard Chemistry Pole and the Rabelais Biology-Health Pole existing during the creation of the COMUE;
      8° The porting of the student hub for innovation, transfer and entrepreneurship (PEPITE-LR);
      9° The portage of the Maison des sciences de l'homme de Montpellier;
      10° The porting of academic foundations, including the Balard foundation;
      11° The development, porting and management of national or international federative projects at the site level such as the IDEX project;
      12° Development of services for foreign students and foreign personalities.
      In agreement with members, on the basis of the shared project, and as soon as the legislative or regulatory provisions permit, the COMEU will manage:
      1° The Higher School of Faculty and Education (ESPE), part of the COMUE, and accreditation of its degrees,
      2° The interuniversity library of Montpellier and the cooperation between all libraries of the site.
      The delivery of the Learning Training Centre and the management of the website's presentation portal will also be transferred to the COMUE.


      Article 5.2
      Coordination skills


      In agreement with members and on the basis of the shared project, the COMUE ensures:
      1° The joint presentation of the member training offer;
      2° The mention of the COMUE label on doctoral degrees issued by members;
      3° The development of services offered to students through a reconciliation or mutualization of existing structures;
      4° The establishment of joint training actions for staff in institutions;
      5° The development of a common policy for persons with disabilities;
      6° Coordination of the valorization of historical academic heritage.
      The COMUE will be able to welcome structures for dialogue, exchange and cooperation among its members. These structures may be created on the initiative of the said components, after validation by the Board of Directors of the COMUE and the boards of directors of each of the institutions concerned.


      Article 6
      Means of actions


      For the purpose of exercising its competence, the COMEU can carry out the following actions:
      1° Establish and manage the public establishment, allocate funding to services or equipment that may or may not be common to members, such as technology platforms, hospitality and accommodation, support services and logistical facilities;
      2° Negotiate, conclude and manage any legal act with public or private, French or foreign partners;
      3° Acquire, assign, manage buildings;
      4° Finance or contribute to the financing of research programmes or projects carried out by members;
      5° Recruit and manage personnel within the framework defined by the board of directors in terms defined in the rules of procedure;
      6° Granting financial assistance to students;
      7° Creating and exploiting data banks;
      8° Take participations or create subsidiaries entering its business area;
      9° As part of the Campus operation, subscribing loan contracts;
      10° Implement any other operation that contributes to the exercise of its missions.

    • Part III: INSTANCES OF COMUAL GOVERNANCE


      The COMUE is administered by a board of directors. The board of directors is assisted by a board of members and an academic council. It is headed by a president, assisted by vice-presidents.


      Article 7
      General conditions of election organization


      Members of the board of directors and academic council, apart from the president and external and qualified personalities, shall be elected in accordance with the provisions of the articles L. 719-1 and L. 719-2 the education code, subject to the specific provisions of these statutes.
      The members of the board of directors referred to in 4°, 5° and 6° of Article 8-1 below shall be elected by direct suffrage by secret ballot by separate colleges.
      The election is made by the list vote in a tower with proportional representation to the strongest remains, possibility of incomplete lists and without dressing. The seats are allocated to the proportion to the strongest remains.
      For members mentioned to 4° to 6° of Article L. 718-11 of the Education Code, each list of candidates ensures the representation of at least seventy-five percent of the community's member institutions.
      The members of the academic council designated in Article 10-1 below shall be elected by indirect suffrage by the ballot of a list in a ballot with proportional representation to the strongest remaining, possibility of incomplete lists and without dressing. The composition of the colleges of major electors is specified in Article 10-1 of these statutes.
      A nomination is mandatory for each list of candidates. The seats are allocated to the proportion to the strongest remains. The lists that did not obtain a number of votes at least ten percent of the votes cast are not allowed to the distribution of seats.
      The election takes place either by filing a paper ballot in a ballot box or by secure electronic means. Electors prevented from voting personally are allowed to vote by proxy. The rules of procedure specify the conditions for the organization of the elections.
      The president of the COMUE is responsible for organizing the elections. He is assisted by an electoral commission. Any judicial appeal against the elections must be preceded by an appeal filed with the President within five days of posting the results. The President shall rule on this appeal within eight days of its filing. If not, the appeal is deemed to be rejected.
      Each member institution transmits to the President of the COMUE the list of electors for each college.


      Article 8
      Board of Directors
      Article 8.1
      Composition


      The Board of Directors includes fifty-four members, including:
      1° The eight president(s) or director(s) representing the higher education institutions and member research organizations, or their designated representatives, for the duration of their term as the respective president(s) or director(s);
      2° Fourteen qualified personalities agreed by the members mentioned at 1°, including a representative of the CROUS, at least three personalities selected from the staff of Montpellier Sup Agro, the Ecole des Mines d'Alès and the Ecole nationale supérieure d'architecture de Montpellier, and at least three personalities from the staff of the INRA, CIRAD and INERM;
      3° Four external representatives for each category 3° of Article L. 718-11 of the Education Code, including a representative of an intercommunity and a representative of the Languedoc-Roussillon region, and two representatives of the socio-economic world and associations designated by the representatives of the establishments designated at 1°;
      4° Sixteen professor-researchers, teachers and researchers mentioned in the 4° of Article L. 718-11 of the Education Code (eight from College A and eight from College B), directly elected under the terms set out in Article 7 above;
      5° Six representatives of other staff, referred to in 5° of Article L. 718-11 of the Education Code, elected by direct suffrage in accordance with the terms set out in Article 7 above;
      6° Six user representatives mentioned to the 6° of Article L. 718-11 of the Education Code, directly elected under the terms set out in Article 7 above.
      For each representative of categories 4° to 6°, an alternate of the same sex shall be designated under the same conditions as the holders.


      Article 8.2
      Mandate


      The term of office of directors of the board of directors of categories 2° to 5° is fixed to four years renewable once, that of the representatives of the users is fixed to two years, renewable once.
      The terms of reference of the members of the board of directors are short from the first meeting convened for the election of the President of the COMEU. This meeting is chaired by the senior elected to the Board of Directors.
      When a director loses the quality for which he or she has been designated or when his or her seat becomes vacant for any cause, a new director shall be designated for the remainder of the term, subject to the conditions set out in the rules of procedure.


      Article 8.3
      Attributions


      The Board of Directors defines the COMUE policy.
      After any notice of the Council of Members, in accordance with Article 9-3, and of the Academic Council, in accordance with Article 10, the Council shall:
      1° Vote the general guidelines and strategic plan for COMUE actions, means and structures;
      2° Approves the common part of the multi-year settlement contract with the State;
      3° Approves the coordinated territorial strategy of the training offer;
      4° Approves the general organization and operation of the COMEU;
      5° Decides on the membership of a new member, its principle and its terms;
      6° Decides on the exclusion of a member, its principle and its terms;
      7° Decides on the terms and conditions of withdrawal of a member;
      8° Decides on any request for partnership or association, its principle and its terms;
      9° Denounces a partnership or association agreement, its principle and its terms;
      10° Deliberates on the consequences of changing the legal status of a member, partner or partner, or its scientific scope on the community of universities and institutions;
      11° Approves the budget and its amendments, the financial account and the allocation of results;
      12° Voting the rules of procedure and its amendments;
      13° Vote the rules for training accredited by the COMEU;
      14° Establishes general terms and conditions of recruitment and employment of the COMEU staff, including contractual agents;
      15° Déliberère sur les questions et ressources numériques de la COMUE ;
      16° Approves acquisitions, alienations and exchanges of buildings;
      17° Approves leases and leases of buildings;
      18° Accepts the alienation of household goods;
      19° Accept gifts and bequests;
      20° Approves contracts, and conventions;
      21° Authorizes legal actions, both in demand and in defence, transactions and recourse to arbitration in cases of disputes arising from the execution of contracts with foreign agencies;
      22° Authorizes participation in legal entities, including by taking part and creating subsidiaries;
      23° Approves the annual activity report, the social balance sheet and the disability master plan;
      24° Eliminate the President of the COMEU by a majority single-member vote of two rounds;
      25° Eliminates the Vice-President of the Board of Directors by a two-round majority single vote;
      26° Eliminates the Vice-President responsible for digital resources on the proposal of the President by a two-round majority single vote;
      27° Gives an opinion on the proposals for the appointment of the other Vice-Presidents of the COMEU;
      28° Creates any commission or committee that it considers useful or proposed to it by the Chair, as these committees or committees are placed directly under its authority in accordance with the terms and conditions set out in the rules of procedure;
      29° Takes note of the recommendations of the academic council and deliberates on the follow-up to be given;
      30° Approves the amendments to these statutes;
      31° Vote the creation of the COMUE technical committee in accordance with theArticle L. 951-1-1 of the Education Code ;
      32° Describes the public institution of higher education member whose disciplinary section is competent to examine the facts of prosecution, committed by teachers-searchers, teachers or users, in the premises and premises of the COMUE.
      Within the limits it determines, the Board of Directors may delegate to the President all or part of its powers, in the matters referred to in paragraphs 16 to 21. The Chairperson shall report, at the next sitting, on the decisions he made under that delegation.
      By exception to the above, the Board of Directors:
      1° Approves decisions on the IDEX project on mandatory advice from the IDEX Strategic Council;
      2° Approves on mandatory advice from the strategic council of the campus operation decisions relating to the project of the campus operation.


      Article 8.4
      Meetings - Decision-making - Attributions


      The Board of Directors shall meet at least once a quarter by convocation of the President of the COMEU, or at the request of at least half of the directors, under the conditions provided for in the rules of procedure.
      The procedure for convening and holding meetings of the board of directors is detailed in the rules of procedure.
      The academy rector, chancellor of universities, attends law or is represented at the board of directors.
      The regional research and technology delegate from the Languedoc-Roussillon region, or his representative, is invited to the meetings of the board of directors.
      The Director General of Services, the Accountant Officer, the members of the Executive Committee, the Vice-Presidents of the Board of Directors and the Academic Council, and in general, any person, including the Chairman of the COMUE, wishes to obtain the opinion, may attend the meetings of the Board of Directors with an advisory voice.
      The President of the COMUE may invite a representative of a partner or partner when the partner is particularly concerned by an item on the Board's agenda.
      When the President of the COMUE cannot preside over a session of the Board of Directors, his duties shall be performed by the Vice-President of the Board of Directors according to the conditions defined by the rules of procedure.
      A director may give power to another administrator, from the same category. No one can carry more than one proxy.
      The procedure for convening and holding meetings of the board of directors is detailed in the rules of procedure.
      The board of directors shall meet validly if the majority of the directors in office is present or represented or participate in the session by means of videoconference or electronic communication under detailed conditions in the rules of procedure allowing the identification of these directors and guaranteeing the collegial character of the deliberation. If the quorum is not reached, the board of directors is again convened on the same agenda within eight days. It then meets validly, regardless of the number of directors present or represented.
      Each administrator has one voice. The deliberations are taken by a simple majority of members present or represented. In the event of a vote-sharing, the president's vote is preponderant.
      The amendment of these statutes, including the accession of new higher education institutions or a research organization or the exclusion of a member, is presented to the Board of Directors of the COMEU following a notice of the boards of directors of the member institutions.
      The Board of Directors of the COMUE shall decide by an absolute majority of the directors in office on:
      1° The adoption and amendment of the COMUE rules of procedure;
      2° Adoption or denunciation of an association or partnership agreement with higher education institutions or research organizations.


      Article 9
      Council of members
      Article 9.1
      Composition


      The Council of Members shall convene a representative of each of the members of the COMEU, designated in accordance with the rules in force within each member. Each representative of a member has a deliberate voice.
      It is presided over by the President of the COMUE, who has no deliberative voice. Institutions that have entered into a partnership or association agreement with the COMUE can be invited to the Council of Members without a deliberative vote.


      Article 9.2
      Attributions


      The Council of Members is associated with the preparation of the work and the implementation of the decisions of the Board of Directors and the Academic Council. The Council of Members shall have a principal advisory role. It is consulted in particular on the following topics:
      1° The definition of shared project;
      2° the signing of the multi-year settlement contract;
      3° The general guidelines and strategic plan for COMUE actions, means and structures;
      4° The adoption or modification of the budget;
      5° Any request for partnership or association. In the case of higher education institutions located in the territory and under the sole minister responsible for higher education, deliberation concerns the content of the convention, in accordance with theArticle L. 718- 16 of the Education Code ;
      6° The denunciation of any partnership or association agreement, its principle and its terms;
      7° The consequences of the change affecting the scientific perimeter of a member, associate or partner in his or her involvement in the COMUE;
      8° The adoption and amendment of the COMUE rules of procedure;
      9° The common part of the multi-year contract;
      10° Any changes to these statutes including the accession of new higher education institutions or research organization, the withdrawal or exclusion of a member and their consequences. It may also be consulted in the manner defined in the rules of procedure by the board of directors, as well as by the academic council, on any matter that falls within their competence.


      Article 9.3
      Meetings - Opinions and voting


      The Council of Members shall meet at least once a quarter by convocation of the President of the COMEU who sets the agenda. It may also, in accordance with the terms and conditions specified in the rules of procedure, be convened at the request of at least one third of its members on a specific agenda.
      The Accountant Officer, the members of the COMUE Steering Committee and the Vice-Presidents of the Academic Council and the Board of Directors may attend the meetings of the Council of Members without a deliberate vote.
      When the President of the COMEU cannot preside over a session of the Council of Members, his duties shall be performed by one of the members of the Council according to the conditions defined by the rules of procedure.
      Members of the Council may give power to another member of the Council of Members. No one can carry more than one proxy.
      For decisions requiring a vote, the Council of Members shall meet validly if the majority of members are present or represented or participate in the session by means of videoconference or electronic communication under conditions allowing the identification of such representatives. If the quorum is not reached at the opening of the session, the Council of Members shall again be convened on the same agenda within eight days. It then meets validly, regardless of the number of members present or represented.
      Each member serving on the Council of Members has one vote. Members' advice is obtained by a simple majority of members present or represented.
      With the exception of the above, a favourable notice taken by a two-thirds majority of the members present or represented is required with respect to:
      1° The joint component of the COMUE multi-year contract;
      2° Any request for association or partnership within the meaning of Article L. 718-16 of the Education Code;
      3° The consequences of denunciation of any partnership or association agreement;
      4° The modification affecting the scientific perimeter of a member, partner or partner in his or her involvement in the COMUE;
      5° The modification of these statutes, including, inter alia, membership, withdrawal or exclusion of a member;
      6° The adoption and amendment of the COMEU rules of procedure. For these exceptional cases, the documents on which the Council of Members is requested to make its decision should be sent to the members no later than six weeks before the Council of Members is to be decided.


      Article 10
      Academic Council
      Article 10.1
      Composition


      The academic council consists of thirty-four members distributed as follows:
      1° Eight representatives of each of the members of the COMEU designated according to their own rules;
      2° Two personalities outside the meaning ofArticle L. 719-3 of the Education Code Designated jointly by members of the academic council at the first meeting of all other members of the academic council;
      3° Sixteen Research Teachers, Teachers and Researchers 4° of Article L. 718-11 of the Education Code (eight for College A and eight for College B), appointed by the elected "teacher-researchers, teachers and researchers" to the boards of the higher education institutions members;
      4° Four other personnel mentioned 5° of Article L. 718-11 of the Education Codeappointed by the elected "other staff" to the boards of the higher education institutions members;
      5° Four users mentioned 6° of Article L. 718-11 of the Education Codeappointed by the elected "users" to the boards of the higher education institutions members.
      In order to carry out its tasks relating to research, innovation, training and the life of the campus, the academic council shall be organized into committees responsible for preparing its opinions in accordance with the terms specified in the rules of procedure.
      Representatives of associated institutions, partners and components may attend the plenary sessions of the Academic Council on the basis of the issues on the agenda, at the invitation of the Chair.


      Article 10.2
      Mandate of members


      The term of office of the members of the academic council is four years, renewable once, with the exception of the elect of the users whose term is two years renewable once.
      The academic council elects among its members and for four years, renewable once its vice-president during a single majority vote of two towers.


      Article 10.3
      Attributes and opinions


      In accordance withArticle L. 718-12 of the Education Code, the academic council exercises, for the skills transferred to the COMEU, the advisory role envisaged in theArticle L. 712-6-1 of the Education Code. It provides its opinion on the proposed shared project and the multi-year contract, respectively, under articles L. 718-2 and L. 718-3.


      Article 10.4
      Meetings


      The academic council meets at least twice a year on the convocation of the President of the COMUE who sets out its agenda. It may also, in accordance with the terms and conditions specified in the rules of procedure, be convened at the request of at least one third of its members on a specific agenda. It may also be consulted by the board of directors or the board of members.
      When the President of the COMUE cannot preside over a session of the Academic Council, his functions are performed by the Vice-President of the Academic Council according to the conditions defined by the rules of procedure.
      Members of the academic council may give power to another member of the academic council. No one can carry more than one proxy.


      Article 11
      Other councils or committees


      The board of directors, upon its constitution, shall establish in a manner that it has defined by deliberation:
      1° ESP advice;
      2° MSH advice;
      3° A doctoral college council;
      4° A strategic board of IDEX, obligatoryly composed of at least one representative of each institution and organization that is part of IDEX;
      5° A strategic council of the campus operation, obligatoryly composed of at least one representative of all institutions receiving the campus operation.
      The Board of Directors may establish any other board or committee that it considers appropriate.

    • Part IV: THE PRESIDENCE OF THE COMMITTEE


      Article 12
      Election and powers of the President of the COMUE


      The President of the COMUE is elected from among the members of the Board of Directors by the directors present or represented in a single-member majority vote of two rounds.
      Its mandate is four years, renewable once. When the President reaches the age limit of sixty-eight years, he or she may serve until 31 August after the date on which he or she reaches that age.
      The President is responsible for the management of the COMUE within the framework of the guidelines defined by the Board of Directors. As such:
      1° He chairs the board of directors, the board of members and the academic council. It sets out the agenda of meetings, prepares its deliberations and ensures its implementation;
      2° It represents the COMEU in justice and in all acts of civil life;
      3° It prepares the budget and ensures its execution under the conditions provided for in the rules of procedure and in the respect of the budgetary balance;
      4° He is the order of expenditure and revenue;
      5° It reports annually to the Board of Directors for the execution of the shares and its management;
      6° It submits the rules of procedure to the approval of the Board of Directors after prior notice of the Council of Members and the Academic Council and ensures its implementation;
      7° It has hierarchical authority over COMUE personnel and functional authority over officers designated by members who perform all or part of their functions;
      8° He is responsible for the proper functioning, respect for the order and security of the COMEU;
      9° It may propose to the board of directors the establishment of any commission or committee that it considers useful in accordance with the terms and conditions set out in the rules of procedure;
      10° He may exercise any mission delegated to him by deliberation of the board of directors;
      11° He proposed to the Board of Directors the appointment of a Vice-President responsible for digital resources;
      12° In addition to the Vice-Presidents of the Board of Directors and the Academic Council, he proposes one or more Vice-Presidents as well as directors for prior advice from the Board of Directors and then appoints them;
      13° He may delegate part of his or her powers to the Vice-President(s), within the limits and conditions determined by the rules of procedure;
      14° It signs contracts, contracts and agreements approved by the Board of Directors.
      For the purpose of a service organization, it may delegate its signature to the staff on duty in the establishment within the limits and conditions defined by the board of directors.

    • Title V: OPERATIONAL PILOTAGE INSTANCES


      Article 13
      The Executive Committee


      The COMUE includes operational steering bodies whose organization and operation are provided for by the rules of procedure. These include the steering committee, components, directorates and administrative services.
      Presented under the authority of the President of the COMUE, the Steering Committee is responsible for attending the Chair for the purposes of:
      1° To conduct all preparatory work for the definition and implementation of the objectives, the general strategy, and the strategic plan of actions, means and structures that decline the shared project;
      2° Implement all deliberations of the Board of Directors;
      3° To prepare the sessions of the board of directors and those of the board of members. The composition of the steering committee is specified in the rules of procedure.


      Article 14
      Components, directions and services


      In order to carry out its mission, the COMUE organizes its own means in the components, directions and services defined in the rules of procedure. Within this framework, the COMUE has staff available, seconded or under contract, placed under the hierarchical or functional authority of the President of the COMUE within the framework of their functions. Staff made available by an institution or agency retain their original status.

    • Part VI: FINANCIAL RESOURCES - ADMINISTRATIVE AND COMPTABLE FINANCIAL MANAGEMENT


      Article 15
      Provisions applicable


      The COMEU is subject to the provisions of the articles L. 719-4, L. 719-5 and R. 719-51 the Code of Education, as well as the provisions of Article L. 719-9 of the same Code relating to a posteriori financial control.


      Article 16
      Income


      The COMUE revenue includes:
      1° Contributions of any kind made by members, partners and partners;
      2° State subsidies;
      3° Subsidies of local authorities;
      4° Resources obtained from funding agencies for COMUE participation in national or international programmes;
      5° Resources paid by the National Agency for Research as part of the Campus operation;
      6° The product of participation in the COMUE-specific continuing vocational training;
      7° The product of the research or enhancement contracts of the COMUE research, including the products of the operation of patents and licences under conditions defined in the rules of procedure;
      8° The proceeds of services of any kind;
      9° The product of alienations;
      10° The product of participations;
      11° Donations and bequests;
      12° Any other resources authorized by the laws and regulations in force.


      Article 17
      Expenditure


      The expenses of the COMUE include the personnel costs of its own, the equipment and operating expenses and, in general, all the expenses necessary for its activities. The annual initial budget and revisions over the course of the year, subject to the Board of Directors' deliberation, must be balanced in revenues and expenditures.


      Article 18
      Accountant


      On the proposal of the President of the COMEU, the accounting officer shall be appointed by joint order of the Minister in charge of higher education and the Minister in charge of the budget.

    • Part VII: REVISION OF STATUS AND INLAND REGULATIONS


      Article 19
      Revision of statutes


      The amendment of these statutes shall be submitted to the Board of Directors of the COMEU after notice of the member institutions. In application of theArticle L. 718-8 of the Education Code, the statutes are amended by deliberation of the Board of Directors of the COMEU after approval of the Board of Members rendered in accordance with the above provisions. These revisions are approved by decree. Any jurisdiction transferred requires the agreement of the board of directors of the members.


      Rule 20
      Rules of procedure


      The rules of procedure are adopted within six months of the designation of the first president of the COMEU. It can only be modified by deliberation of the board of directors, made after notice of the boards of directors of the member institutions, favourable advice of the board of members and consultation with the academic council.

    • Part VIII: SUBSTANCE OF STATUTS


      Article 21
      Transitional and final measures


      The statutes apply from their publication in the Official Journal of the French Republic.
      The final bodies of the COMUE will be established within six months of this publication in the Official Gazette and will succeed in the proceedings in force on that date.
      The terms of reference of the members of the board of directors are short from the first meeting convened for the election of the President of the COMEU.
