The Minister of national education, higher education and research, the Minister of finance and public accounts, the Minister of culture and communication, the Secretary of State responsible for higher education and research and the Secretary of State in charge of the budget are responsible, each which is concerned, of the execution of this Decree, which will be published in the Official Journal of the French Republic.

Annex annex preamble the Inter-Academy Norman territory, Normandy University organizes the territorial coordination of higher education institutions and research organizations in ma-guard to offer training and research strategy and such transfer as provided in article L. 718 - 2, in the form of the Norman territorial grouping comprising the members of Normandy University and associated institutions.
The community of universities and institutions Normandy University, object of the present statutes, includes higher education and research institutions linked by the common desire to offer a training and research at the highest level, to ensure the development of innovation in all its forms.
The cooperation of Norman institutions has been engaged with the University Norman, inaugurated in April 1998 in associative form, who was managing interregional projects between 3 universities (Caen, Le Havre, Rouen) and the two schools for engineers (ENSICAEN, INSA Rouen). October 14, 2011, by Decree No. 2011-1306, the Pole of research and higher education (PRES) Normandy University was created under statute of public establishment for scientific cooperation (EPCS). In accordance with article 117 of the law No. 2013-660 July 22, 2013 on higher education and research, the public establishment for scientific cooperation Normandy University became community of universities and institutions (COMUE) on the date of publication of the Act. Within a period of one year as of the same date, the new statutes of the property must be in accordance with articles L. 718 - L. 718 7 - 15 of the code of education, in their writing as a result of the law.

Grouping Normandy University brings together a set of autonomous institutions of higher education and research and research organizations that retain their identity and their ways and agree to coordinate their actions and to share some resources in the context of a shared project defined and implemented jointly. Within the framework defined by the law of July 22, 2013, other institutions or public or private bodies involved in the missions of public service of higher education or research will be able to join Normandy University.

Article 2 Composition and principles of membership and withdrawal of the grouping Normandy University under article L. 718-2 of the code of education, Normandy University organizes a coordination territorial in the form of a grouping across Normandy, consisting of the members of Normandy University, and the institutions and public or private bodies contributing to the higher education public service missions and research that have concluded with Normandy University an association in accordance with article L. 718-16 of the same Code (hereinafter the "associated with").

(3) University of Rouen;

Article 2.2 Composition of consolidation of Normandy Article 2.2.1 principles of membership in the Normandy University Council: members and associates of other academic or research institutions can join Normandy University, either as members subject their application is approved by the Board of Directors under the conditions defined in articles 8.4 and 8.5, 9.2 and 9.3, or as partners by signing with Normandy University of an association agreement under the conditions of acceptance set out in sections 8.4 and 8.5 , 9.2 and 9.3 as well as in accordance with article L. 718 - 16 of the education code.

Under the conditions defined in article L. 718 - 3 of the code of education, public institutions of higher education and research under the single Ministry in charge of higher education who demand are associated and may become members provided that their application be approved by the Board of Directors under the conditions defined in section 8.4, 9.2 and 9.3.
Article 2.2.2 principles of Normandy University withdrawal: members and associates of Normandy University no individual can leave Normandy University during a multi-year contract within the meaning of article L. 718 - 2 of the code of education. Any withdrawal request is communicated to the president or the President of Normandy University no later than two (2) years before the end of the multi-year contract.
In the specific case where an institution of higher education and research of the single Ministry responsible for higher education would more be a member, he may request to be associated with Normandy University under the conditions provided for in article L. 718 - 16 education code or join another collection.
Article 3 head office the Head Office of Normandy University shall be set by resolution of its Board of Directors.

Title II: MISSIONS, skills and means of Normandy Article 4 Missions Normandy University University carries the shared project defined by all of the members in accordance with article L. 718 - 2 of the code of education research, training and development, including technology transfer, employability of users, of international action, communication, dissemination of scientific, technical and industrial culture and campus life.
In this context, the missions of Normandy University are to drive: (1) the collective development, reviewed annually, a vision and a strategy shared as well as the variation in actions and programs in a multi-annual perspective.
(2) implementation of actions and programs that may be entrusted to one or several members engaging their means; These are called Member operators.
Article 5 skills for the realization of its tasks and in accordance with the principle of subsidiarity, Normandy University shall exercise the following powers: Article 5.1 own skills on the basis of the shared project, Normandy University takes under his responsibility the following skills: (1) the definition and the implementation of the common component of the multi-year contract;
(2) the communication on the project shared;
(3) the definition of a common digital strategy and the implementation of the shared actions foreseen by the Norman digital blueprint;
(4) the definition of a common policy on training for careers in libraries, and its implementation by the management of the regional Centre of training for careers in libraries (CRFCB);
(5) research and transfer: has) the definition of a common policy of the signature of the scientific publications showing Normandy University in first mention;
(b) the responsibility and management of the inter-regional research federations;
(c) the definition of a common research policy and a common device porting: Normandy valuation;
(d) the porting of the University Press of Normandy.
(6) training: has) accreditation of doctorate degree porting, implementation is provided by institutions of higher education members who have received a delegation of the COMUE;
(b) the management and animation of the doctoral schools;
(c) the porting of the pole students for innovation and the transfer and entrepreneurship (NUGGET) Valley of the Seine.
Article 5.2 coordination skills on the basis of the shared project, Normandy University provides: (1) the coordination of the supply of training and research strategy;
(2) the development of an educational innovation policy;
(3) the development of coordinated devices: a) of initial and continuing training, in particular distance learning and teacher and student mobility on the two regions aid, b) induction.
(4) the development of a policy to improve the quality of student life and social action, particularly in relation to the CROUS, in accordance with article L. 718 - 4 of the code of education;
(5) the coordination of a policy of dissemination of scientific and technical culture;
(6) the coordination of an international development strategy research and training (mobility aid, coordinated system of reception of students, teachers and researchers);
(7) the coordination of a policy documentary at the service of training and research, in close connection with the SDNN, in particular in the field of procurement, training and services to the user, open archives.
Normandy University offers any other action defined jointly and aiming at consolidating its strategy in its areas of action.
Implementation of the shared project and skills of Normandy University is arrested every year in a multi-annual perspective. This implementation can be secured by Normandy University, with its own means or delegated to one or more members, then appointed operators, committing their resources in coordinated actions.
Article 6 means of action of Normandy University in order to exercise its powers, Normandy University: (1) allocates funds to the services or equipment that may be or common to the members, such as technology platforms, spaces of reception and accommodation, support services and logistic facilities;
(2) negotiates, concludes, and manages all legal act with public or private, french partners or strangers;
(3) finances or contributes to the financing of programmes or research projects conducted by the members;
(4) recruits and manages personnel;
(5) grants financial aid to students and the rewards of internships;
(6) does the editing and the marketing of books and periodicals, scientific or technical;
(7) creates and operates data banks;
(8) taking stakes or create subsidiaries entering its field of activity;
(9) implements any other operation contributing to the performance of its duties.

Title III: Bodies of governance of Normandy Normandy University College is administered by a Board of Directors. It also has a members Council and an academic Council.
It is headed by the Chair, assisted (e) one or more Vice Presidents or Vice-Presidents including one, responsible (e) issues and digital resources in accordance with article L. 718 - 10 of the education code.
Article 7 common provisions to the Board of Directors and the Academic Council of Normandy University according to the provisions of articles L. 719 - 1 and L. 719 - 2 of the code of education subject to the special provisions to the present statutes, the elected members of the Board of Directors and of Normandy University Academic Council are elected by direct and secret ballot of list in a round by college with proportional representation in the strongest stay. Specific provisions for election to the Academic Council are detailed in article 10.2. Each list of candidates consists alternately one candidate of each sex.
The Chairperson of Normandy University is responsible for the Organization of elections. He is assisted in this effect of an electoral commission whose composition and powers are defined in the rules of procedure.
Boards are convened and the order of the day, accompanied by documents thereto, communicated by their Chairperson.
Article 8 Board of Directors Composition the Board of Directors 8.1 Article includes 56 directors distributed according to the following categories: (1) Six heads of institution of higher education and research defined in article 2.1. ;
(2) three qualified persons designated by a common agreement of the directors referred to in 1.
(3) eight representatives of the companies and associations whose list is fixed by statutory deliberation; four representatives from the regions of lower and upper Normandy and three representatives of public institutions of inter-communal cooperation in which members of Normandy University are located;
(4) 16 representatives elected teacher-researchers, teachers and researchers working within Normandy University or a member or both within the two, elected in two separate colleges such as defined in article D. 719 - 4 of the code of education: either has eight representatives in the title of the college and eight representatives to the title of the college B;
(5) eight elected representatives of other personnel serving in Normandy University breast or within a member or within the two;
(6) eight elected representatives of users who are trained within Normandy University or within a member or within the two.
Article 8.2 Mode of designation and election

Representatives from category 3 are designated by businesses, associations and local authorities. The list of companies and associations is set by deliberation of the Board of Directors, on proposal of the Council of members. Elections for the representatives of the 4 to 6 categories are directly elected by party list in a turn to proportional representation with seats remaining to be filled according to the rule of the strongest rest, without blending. Each list of candidates ensures the representation of at least 75% of the member institutions. Each list of candidates shall be the representative of at least three of the four major areas of training such as defined in the fourth paragraph of article L. 712 - 4 of the education code. The lists may be incomplete.
Section 8.3 mandate the mandate of the directors of the Board of Directors is fixed at four (4) years renewable, with the exception of the mandate of the representatives of users, set at two (2) years renewable.
When an administrator loses the quality for which he has been appointed, or when his seat becomes vacant for any reason whatsoever, a new administrator is designated for the duration of the term.
Section 8.4 powers the Board of Directors defines Normandy University policy. As such, it considers, after possible opinion of the Council of the Member as specified in article 9.2. and the Academic Council as indicated in article 10.4 on: (1) the General guidelines, the strategy and the definition of actions, means and structures of Normandy University to respond;
2. the common component of the multi-year contract with the State;
(3) the General Organization and the functioning of Normandy University;
(4) the provision of training and to Normandy University graduates;
(5) the membership of new higher education institutions or research institutions after approval of the Council of members;
(6) the association by convention of new higher education institutions or research organizations; in the case of the higher education institutions located in the territory and reporting to the Department of higher education and research, deliberation concerns the content of the association agreement, in accordance with article L. 718 - 16 education code;
(7) the exclusion after a favourable opinion from the Council of members or the terms of withdrawal or exclusion of a member. As an exception, an institution under the only supervision of the Ministry of higher education and research can then ask to be associated with Normandy University;
(8) the consequences of a change in the legal status of a member or its scientific scope.
(9) the budget and its amendments, the financial account and the allocation of the results;
(10) the rules of procedure and its amendments;
11 ° rules PhD and Normandy University-specific training;
(12) the politics of Normandy University human resources;
(13) the issues and digital resources;
(14) the alienation of chattels;
(15) acquisitions, disposals and exchange of buildings; leases and rentals on them;
(16) the acceptance of donations and legacies;
(17) the agreements and unilateral acts;
18 ° legal action, both in demand as for defence, the transactions and the use of arbitration in case of disputes arising in the execution of its contracts with foreign organizations;
(19) participation in legal entities, by ownership and the establishment of subsidiaries;
(20) the annual activity report, the social balance sheet and the blueprint on disability;
(21) the election of the president or the Chairman of the Board of Directors;
(22) the appointment of the Vice President or Vice President responsible (e) digital resources on the proposal of the president or the Chairman;
(23) the creation of any commission or Committee considers useful or which is proposed by the president or the Chairman, these commissions or committees being placed directly under his authority following the procedure prescribed by the rules of procedure;
(24) the Academic Council's recommendations with financial implications;
(25) the proposal to the Minister responsible for higher education and research of any changes to the present statutes;
(26) the designation of the companies and associations represented within in the title of the category (3);
(27) the designation of the University Member whose disciplinary section is competent to consider acts committed by teachers-researchers, teachers or users, in the premises and own speakers of the COMUE that could give rise to lawsuits.
The Board of Directors may delegate to the Chair or the Chair all or part of its powers, in subjects under 14 to 19 points. The Chair shall report, at the next meeting, decisions that he or she has taken under this delegation.
Article 8.5 meetings - decisions the Board of Directors meets at least two (2) times a year at the call of its Chairman or of its President or at the request of at least half of the directors.
The rectors of academies involved in the perimeter of Normandy University, or their designated representative, shall attend meetings of the Board of Directors. The accounting officer, the president or the Chairman of the Academic Council and, in General, anyone which the Chairperson wishes to collect the opinion can attend the sessions of the Executive Board with voice but without vote.
The representatives designated by the regional delegates to research and technology of the lower and upper Normandy regions are invited to meetings of the Board of Directors.
The Chairperson may invite a representative of a member when this one will be particularly affected by a question or a decision to be taken by the Board of Directors.
When the president or the President cannot preside over a meeting of the Board of Directors, its functions are carried out by one of the directors of the Board of Directors according to the conditions defined by the rules of procedure.
A Director may grant power of attorney to another administrator. No one may hold more power of attorney.
The methods of convening and holding of meetings of the Board of Directors are detailed in the rules of procedure.
The Board of Directors meets validly if half at least of the Directors is present or represented, or participates at the meeting by videoconference or electronic communication means under conditions allowing the identification of these directors and their effective participation in a collegial deliberation. If the quorum is not reached, the Board of Directors again convened on the same agenda within a period of eight days. He meets so validly, regardless of the number of directors present or represented.
Each Director shall have one vote. Decisions are taken by a simple majority of the directors present or represented. In case of equality of votes, the president or the Chairman has the casting vote.
However, are taken by an absolute majority of its members to exercise the following decisions:-the modification of the statutes, including the membership, withdrawal or exclusion of a member.
As an exception to the above, the majority of two-thirds (2/3) of directors present or represented is required to deliberate on: (1) the association of institutions of higher education or research organizations. In the case of the higher education institutions under the only one Ministry in charge of higher education, door deliberation on the choice between membership and association, and, if the status of associate is adopted, on the content of the agreement of association, (2) the denunciation of a convention of association and its consequences, (3) the adoption and the amendment of the rules of procedure of Normandy University.
Article 9 Article 9.1 Composition the members Council member Council brings together the heads of members of the community of universities and institutions or their representative.
It is chaired by the Chairperson of the Board of Directors, which has no voting rights.
The heads of institutions having concluded an agreement of association with Normandy University or their representative, participate in the Council of members without voting rights.
Article 9.2 powers the Council of members is associated with the preparation of the work and the implementation of the decisions of the Board of Directors.
He is primarily an advisory role. As such, according to the terms defined in the rules of procedure, it can be entered at any time by the Board of Directors on all or part of the deliberation of bills. The Council of members may also be seized by the Academic Council.
As an exception to the above, the Council members must be systematically consulted by the Board of Directors prior to a presentation for deliberation on the following topics:

(1) the definition of the project shared;
(2) the signature of the multi-year contract;
(3) the adoption or amendment of the budget after each Member on its contribution agreement;
(4) the approval of the common part of the multi-year contract ('shared project');
(5) changes to the statutes of the COMUE, including the membership, withdrawal or exclusion of a Member
(6) the proposal of the list of companies and associations in the category (3) of the Board of Directors;
(7) the admission of a new Member associate;
(8) the exclusion of an associate member.
Article 9.3 review and voting meetings the Council of members shall meet at least twice (2) per year at the call of its Chairman or President who sets the agenda. It can also, according to the terms set forth in the rules of procedure, be convened at the request of a third (1/3) at least of its members on a determined agenda.
The accounting officer, the members of the Management Committee of Normandy University as well as the President or the Chairman of the Academic Council may attend meetings of the Council of members without voting rights.
When the president or the President cannot preside over a meeting of the Council of members, its functions are carried out by one of the members of the Council of members according to the conditions defined by the rules of procedure.
Members of the Council of members may give proxy to another Member of the Council of members. No one may hold more power of attorney.
The Council of members meets validly if half of its members is present or represented, or participates at the meeting by videoconference or electronic communication means under conditions allowing the identification of these representatives and their effective participation in a collegial deliberation.
If the quorum is not reached at the opening of the meeting, the Council of members is again convened on the same agenda within a period of eight days. He meets so validly, whatever the number of members present or represented.
Each member serving on the Board of members shall have one (1) vote. Reviews of the Council of members are acquired by a simple majority of the members present or represented.
As an exception to the above: (1) a favourable opinion taken by a majority of two thirds of the members present or represented is required regarding: has) the common part of the multi-year contract of Normandy University;
(b) the amendment of the statutes, including the accession of new members, the withdrawal or the exclusion of a Member;
(2) a favourable opinion taken by a majority of 80% of the members present or represented is required regarding: has) the consequences of denunciation of any association agreement.
(b) the admission of a new Member associate;
(c) the exclusion of a member associated;
(d) the changes affecting the scientific scope of a member in his involvement in Normandy University;
(e) the proposal of the president or of the President of the Academic Council;
(f) adoption and modification of the rules of procedure of Normandy University.
Article 10 Council academic Article 10.1 Composition the Academic Council has 130 members in the following manner: (1) fifteen representatives of the institutions and components, distributed as follows: has) twelve representatives of institutional members, two per Member;
(b) two representatives of the staff of Normandy University;
(c) a representative of the college of graduate schools.
(2) twenty - two representatives of the external personalities within the meaning of article L. 719 - 3 of the code of education including five outside personalities under the 2 ° of article L. 719 - 3 designated by common agreement by the members of the Academic Council at the first meeting of all the other members of the Academic Council and seventeen foreign personalities within 1 ° of article L. 719 - 3 which list is set by statutory deliberation;
(3) fifty - six representatives of teacher-researchers, teachers and researchers engaged in Normandy University or in the members or both of the two, elected in two separate colleges such as defined in article D. 719 - 4 of the code of education, which is twenty-eight representatives to the title of the college and twenty-eight representatives to the title of the college B. They are distributed by member institution in areas of training such as defined in the fourth paragraph of article L. 712 - 4 of the education code. Article 10.2 Mode of designation and election the list of seventeen personalities outside the 2 ° is fixed by deliberation of the Board of Directors, on proposal of the Council of members.

The Academic Council shall elect its Chairman or President on terms specified in the rules of procedure.
The mandate of the president or the Chairman of the Academic Board expires at the end of the mandate of elected officials staff of the Academic Council.

When the president or the President cannot preside over a meeting of the Academic Council, its functions are carried out by a member of the Academic Council according to the conditions defined by the rules of procedure.
Members of the Academic Council may give proxy to another Member of the Academic Council. No one may hold more of one (1) proxy.
To assume its responsibilities defined in article 10.4. the Academic Council is based on the work of commissions, composed of how balanced of representatives of the Council and of the representatives of the competent bodies of the Member and Associates, according to the terms defined by the rules of procedure.

Article 11 other councils or commissions the Board of Directors may set up, according to the terms defined in the rules of procedure, any advice and/or any Committee that it considers necessary for the exercise of its tasks.

Title IV: The Presidency of Normandy University Article 12 Election and powers of the president or the Chairperson of Normandy University

The Normandy University Chair is elected among its members by the Board of directors by an absolute majority of the directors present or represented.
Its mandate is set at four (4) years renewable once.
The Chairperson provides leadership of Normandy University as part of the guidelines defined by the Board of Directors.
In this respect: (1) he or she sets the agenda of the sessions of the Governing Council, prepare the deliberations and ensure implementation.
(2) he or she sets the agenda of the sessions of the Council of members.
3 ° he or she represents Normandy University sued and in all acts of civil life;
4 ° he or she prepares the budget and ensuring the execution;
5 ° he or she is authorising expenditure and revenue;
6 ° he or she reports annually to the Board of Directors of enforcement actions and its management;
7 ° he or she submits the rules of procedure to the approval of the Board of directors after prior notice to the Council of members and ensures its implementation;
8 ° he or she has authority on Normandy University staff and functional authority over agents designated by members who are all or part of their functions;
9 ° he or she is responsible for the proper functioning, respect the order and safety of Normandy University;
10 ° he or she may propose to the Board the creation of any commission or Committee that he or she considers useful following the procedure prescribed by the rules of procedure;
(11) he or she may exercise any mission as requested by a deliberation of the Board of Directors;
(12) he or she proposes to the Board of Directors the appointment of Vice Presidents or Vice-Presidents, one or the one charge (e) of digital resources, which or which is named (e) in accordance with the provisions of article 8.4;
13 ° he or she ensures the balanced representation between women and men in the different tips, directions and Normandy University management bodies, and reports on this subject to the Board of Directors;
(14) he or she may delegate part of its powers or signature to (x) (s) vice-president or to personnel designated to exercise functions of responsibility within the COMUE, within limits and conditions determined by the rules of procedure;
15 ° he or she appoints the Normandy University Department heads.
In case of vacancy of the post or temporary incapacity of the president or the Chairman, its functions are carried out by one of the vice-presidents or one of the Vice-Presidents under conditions determined by the rules of procedure.

Title V: Proceedings of PILOTAGE operations of Normandy Normandy University includes instances of operational management whose organization and operation are presented annually to the Board of Directors. These include the partnership structures and internal directions and services.
Article 13 Structures of Normandy Article 13.1 University Structures internal Normandy University develop internal structures dedicated to the forces of the shared project lines.
At its creation, it has: (1) a college of graduate schools, structure which includes the graduate schools within the perimeter of Normandy University;
(2) research federations;
(3) training center to a career in libraries (CRFCB).
Article 13.2 Structures partnership Normandy University develop structures to implement, with partners, the forces of his shared project lines.
Article 13.2.1 Normandy valuation inception, Normandy University has a structure of partnership of the research on the scale of Normandy.
This structure implements a policy of partnership and collaboration with other actors of the valuation (poles of competitiveness, incubators, sectors, companies, institutions outside the region, JIU, RCCI, ARI, poles and companies outside the region...). It brings together the valorisation activities, transfer and incubation. She promotes the structures of regional research among economic actors and makes accessible their expertise and their results. It aims to boost the economic maturation of research projects, to create economic value in the territory, to significantly improve the efficiency of the transfer of technologies, to lead to a higher professionalization of the valuation of research and strengthen existing skills.
Article 13.2.2 other partnership structures Normandy University plans, especially with the health organizations, hospitals, Alliances, the EPIC, associated institutions, the creation of other structures partnership.

Title VI: Financial resources - management financial ADMINISTRATIVE and accounting Article 14 provisions applicable Normandy University is subject to the provisions of articles L. 719 - 4 and L. 719 - 5 and those of article R. 719 - 51 of the code of education as well as to the provisions of article L. 719 - 9 of the same code for financial control a posteriori.
Article 15 recipes recipes from Normandy University include: (1) to the contributions of any kind made by members.
(2) grants;
(3) the resources obtained from the funding agencies in respect of Normandy University participation in national or international programs;
(4) the product of participation in continuing vocational training for Normandy University;
(5) the product search or contracts of valorization of the Normandy University research, including products from the exploitation of patents and licenses according to the conditions defined in the rules of procedure;
(6) the product benefits of services of any kind;
(7) the proceeds of disposals;
(8) the product investments;
9 ° donations and bequests;
(10) any other resources authorized by the laws and regulations in force.
Article 16 Normandy University spending expenses include the costs of staff who own expenses equipment and operation and, in General, all expenditures necessary for its activities.
The annual budget and its revisions during the year, submitted to the deliberation of the Board of Directors, must be balanced in revenue and expenditure.
Article 17 accounting officer on proposal of the president or the Chairman of the Board of Directors of Normandy University, the accounting officer is appointed by joint order of the Minister in charge of higher education and research and the Minister responsible for the budget.

Title VII: Entry into force of the statutes Article 18 transitional measures the statutes come into force from the date of publication in the Official Journal of the French Republic.
Existing instances are kept in place until the election of the Board of Directors and the Academic Council within a period of one (1) year from the publication of the statutory Decree. The conditions of functioning of these bodies remain the same in this period.
Following the publication of the statutory Decree, Normandy University Office is replaced by the Council of members, as provided for in article 9 of the present statutes.
