Subject: reform of the composition and the functioning of the National Commission on decentralised cooperation.
Entry into force: the text comes into force the day following its publication.
Notice: the reform of the decree governing the CNCD takes into account the recommendations of the Laignel report on external action of local authorities. The main axes of this reform are:-the expansion of the jurisdiction of the CNCD to all external action of local and regional authorities and their groupings;
-the development of its economic competence through the creation of a Committee specially dedicated which may include representatives of businesses, consular Chambers, professional and trade union organizations and experts;
-the implementation in accordance with the composition of the commission with the development of government structures.
On the occasion of this reform will be operated several schemes to make its operation more efficient: the office is replaced by a Standing Committee, a Vice-Chairman chosen among representative national associations of local and regional authorities and a general rapporteur is responsible for coordinating the activity of the working groups.

The Prime Minister, on the report of the Minister of Foreign Affairs and international development and the Minister of the Interior, having regard to the general code of territorial communities, particular articles l. 1115-6, 1115-7, r. 1115-8, r. 1115-9, R. 1115-11, R. 1115-13 and R. 1115-15;
Having regard to Decree No 2006-672 of 8 June 2006 amended relating to the creation, composition and operation of administrative advisory commissions;

Article r. 1115-8 of the general code of territorial communities is amended as follows: 1 ° to the first paragraph, the words: 'the Minister responsible for cooperation' shall be replaced by the words: "the Minister of Foreign Affairs";
2 ° the second subparagraph is replaced by the following: "It shall meet at least twice a year.";
3 ° the third paragraph is replaced by the following provisions: "it includes, in addition to its Chairman, thirty-three members, including:" 1 ° 14 representatives of local authorities and associations specialising in decentralised cooperation and fourteen representatives of the State, which have voting rights;
«2 ° four personalities in the field of local development and international cooperation and a representative of the Agence française de développement, which have consultative voice. ";
4 ° a paragraph as follows is added: "a vice-president is appointed by Prime Minister among the representatives of local authorities referred to in a to f of I of article r. 1115-9, on the proposal of these."

Article r. 1115-9 of the code is amended as follows: 1 ° the first two paragraphs are replaced by the following: "i. - representatives of local and regional authorities are appointed for a renewable term of three years by order of the Prime Minister. They cannot sit beyond their elected term of Office. "They include:";

«f) a representative of the Minister responsible for education;
"(g) a representative of the Minister of international trade;
'h) a representative of the Minister responsible for culture;
' i) a representative of the Minister in charge of the overseas;
'j) a representative of the Minister responsible for research;
'k) a representative of the Minister of agriculture;
"l) a representative of the Minister of ecology;
«m) a representative of the Minister responsible for equality of the territories.»

Article R. 1115-11 of the code shall be replaced by the following: «art.» R. 1115-11.-qualified persons referred to in article r. 1115-8 are appointed for a renewable term of three years by order of the Prime Minister, of which two on a proposal from Foreign Minister on the proposal of the Minister of the Interior and on the proposal of the Minister responsible for decentralization.
'The French Development Agency is represented by its Managing Director or representative of it.'

Article R. 1115-13 of the code shall be replaced by the following: «art.» R. 1115-13.-the commission collection, with local authorities and their groupings, and updates information on actions that fall within the scope of the decentralized cooperation defined in articles l. 1115-1 to l. 1115-4-1. Article R. 1115-14 of the code shall be replaced by the following: «art.» R. 1115-14.-the secretariat of the National Commission of decentralized cooperation and its Standing Committee is provided by a Secretary general appointed by Decree of the Prime Minister. A general rapporteur, appointed under the same conditions, is to assist these two instances in their work. Article R. 1115-15 of the code shall be replaced by the following: «art.» R. 1115-15.-the national decentralized cooperation Commission is in its midst a permanent commission composed of the Vice-Chairman of one of the representatives of the regions and the territorial collectivity of Corsica, one of the representatives of the departments, one of the representatives of the municipalities, by the representative of United Cities France, representative of the Association Française de conseil des communes et Régions d'Europe and to one of the representatives of the Minister for Foreign Affairs, the representative of the Minister of the Interior, of the representative of the Minister in charge of decentralization, by the representative of the Minister responsible of the development and the representative of the Agence française de développement.

Is inserted after article R. 1115-15 article R. 1115 - worded 16: «art.» R. 1115-16.-the National Commission to decentralised cooperation shall adopt its rules of procedure on a proposal from its Standing Committee. It may establish working groups under the conditions laid down in its rules of procedure.
"An Economic Committee is created to the National Commission of decentralised cooperation. It includes representatives of economic activities. Its composition and its rules of operation are determined by the rules of procedure. ' Article 8 more on this article...

Representatives of local authorities and qualified persons appointed prior to the entry into force of this Decree shall complete their term on the National Commission of cooperation decentralised in accordance with the rules applicable before the entry into force.

The Minister of Foreign Affairs and international development, the Minister of the Interior, the Minister of decentralization and public service, the Minister of overseas, Secretary of State responsible for the development and the francophonie and the Secretary of State in charge of territorial reform are responsible, each in relation to the implementation of this Decree, which shall be published in the Official Journal of the French Republic.
