Notice: the reform of the decree governing CNCD takes into account the recommendations of the Laignel report on the external action of the local authorities. The main areas of this reform are:
- the expansion of CNCD's jurisdiction to the entire external action of the local authorities and their groupings;
- the development of its economic competence through the creation of a specially dedicated committee that may include representatives of companies, consular chambers, professional and trade union organizations and experts;
- the conformity of the composition of the commission with the evolution of government structures.
On the occasion of this reform will be carried out several adjustments to make its operation more effective: the office is replaced by a permanent commission, a vice-president selected from the national associations representative of the local authorities and a general rapporteur is responsible for coordinating the activity of the working groups.

The Prime Minister,
On the report of the Minister of Foreign Affairs and International Development and the Minister of the Interior,
Vu le general code of territorial authoritiesincluding articles L. 1115-6, L. 1115-7, R. 1115-8, R. 1115-9, R. 1115-11, R. 1115-13 and R. 1115-15;
Vu le Decree No. 2006-672 of 8 June 2006 modified on the establishment, composition and functioning of administrative advisory commissions;
The State Council (Finance Section) heard,
Decrete:
Section R. 1115-8 of the General Code of Territorial Communities is amended as follows:
1° In the first paragraph, the words "the Minister for Cooperation" are replaced by the words "the Minister for Foreign Affairs";
2° The second paragraph is replaced by the following:
"It meets at least twice a year. » ;
3° The third paragraph is replaced by the following:
"In addition to its president, it includes thirty-three members, including:
« 1° Fourteen representatives of territorial authorities and associations specialized in decentralized cooperation and fourteen representatives of the State, who have a deliberate vote;
« 2° Four qualified personalities in the field of local development and international cooperation and a representative of the French Development Agency, who have an advisory voice. » ;
4° It is added a paragraph to read:
"A Vice-President shall be appointed by the Prime Minister among the representatives of the territorial authorities referred to in paragraph 1 (f) of section R. 1115-9, on the proposal of them. »
Article R. 1115-9 of the same code is amended as follows:
1° The first two paragraphs are replaced by the following:
"I.-Representatives of local authorities are appointed for a period of three years renewable by order of the Prime Minister. They cannot sit beyond the duration of their elective mandate. They understand:
2° The 1st is amended to read:
(a) In a, the words: "regional councils" are replaced by the word: "areas" and the words: "Assembly of Corsica" are replaced by the words: "Territorial Community of Corsica";
(b) In b, the words "general councils" are replaced by the word "departments";
3° The second becomes the second;
4° The 3° is replaced by the following:
"III.-Government representatives include:
“(a) Two representatives of the Minister for Foreign Affairs;
“(b) A representative of the Minister of Interior;
"(c) A representative of the minister responsible for decentralization;
"(d) A representative of the Minister for Development;
“e) A representative of the Minister responsible for the economy;
“(f) A representative of the Minister for Education;
“(g) A representative of the Minister for Foreign Trade;
“(h) A representative of the Minister for Culture;
“(i) A representative of the overseas minister;
“j) A representative of the Minister for Research;
“(k) A representative of the minister responsible for agriculture;
"(l) A representative of the minister responsible for ecology;
“m) A representative of the Minister for the Equality of the Territories. »
Section R. 1115-11 of the same code is replaced by the following provisions:
"Art. R. 1115-11.-The qualified personalities referred to in section R. 1115-8 shall be appointed for a period of three years renewable by order of the Prime Minister, including two on the proposal of the Minister of Foreign Affairs, one on the proposal of the Minister of Interior and one on the proposal of the Minister responsible for decentralization.
"The French Development Agency is represented by its Director General or its representative. »
Section R. 1115-13 of the same code is replaced by the following provisions:
"Art. R. 1115-13.-The commission collects, from the territorial authorities and their groupings, and updates information on actions that fall within the scope of decentralized cooperation defined in articles L. 1115-1 to L. 1115-4-1. It may make any proposals in these areas. It may be consulted on any bill or decree relating to it. »
Section R. 1115-14 of the same code is replaced by the following provisions:
"Art. R. 1115-14. -The secretariat of the National Commission for Decentralised Cooperation and its Standing Committee is provided by a Secretary-General appointed by the Prime Minister ' s Order. A rapporteur general, appointed under the same conditions, is responsible for attending these two bodies in their work. Both participate in meetings of the National Commission for Decentralised Cooperation and its Standing Committee. »
Section R. 1115-15 of the same code is replaced by the following provisions:
"Art. A. 1115-15.-The National Commission for Decentralised Cooperation is a permanent commission composed of the Vice-President, one of the representatives of the regions and the territorial community of Corsica, one of the representatives of the departments, one of the representatives of the communes, the representative of the French Cities, the representative of the French Association of the Council of Commons and Regions of Europe, and one of the representatives of the Minister of Foreign Affairs
"The Standing Committee is chaired by the Minister for Foreign Affairs or his representative. It sets out the work programme of the commission. »
After the article R. 1115-15, it is inserted an article R. 1115-16andsi written:
"Art. R. 1115-16.-The National Commission for Decentralized Cooperation sets out its rules of procedure on the proposal of its Standing Committee. It may constitute working groups under the conditions provided for in its rules of procedure.
"An economic committee is established with the National Commission for Decentralised Cooperation. It includes representatives of economic activities. Its composition and operating rules are set by the rules of procedure. »
Representatives of the territorial authorities and qualified personalities appointed prior to the coming into force of this decree complete their mandate within the National Commission for Decentralised Cooperation in accordance with the rules applicable prior to this entry into force.
The Minister of Foreign Affairs and International Development, the Minister of the Interior, the Minister of Decentralization and the Public Service, the Minister of the Overseas, the Secretary of State for Development and the Francophonie and the Secretary of State for Territorial Reform are responsible, each with regard to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
