Decree No. 2014-1164 of 9 October 2014 amending Decree No. 68-270 of 19 March 1968 on the special status of technical officials of the Mint and Medals

Audiences concerned: technical officials of the public establishment La Monnaie de Paris: technical assistants mechanics, workshop leaders, mechanics chiefs, principal workshop leaders, assistant manufacturing chiefs and engravers.
Subject: modification of the specific status applicable to the technical officials of La Monnaie de Paris.
Entry into force: the text comes into force on November 1, 2014.
Notice: the Decree No. 68-270 of 19 March 1968 relating to the special status of technical officials of the Mints and Medals is amended to ensure that officers of the grades are equal to those of the bodies classified in category B of a career similar to that established by the Decree No. 2009-1388 of 11 November 2009 bringing statutory provisions common to various bodies of civil servants in category B of the public service of the State. The body of the technical officials of the Mints and Medals is also placed on the way to extinction.

Vu la Act No. 83-634 of 13 July 1983 amendments to the rights and obligations of civil servants, together with Act No. 84-16 of 11 January 1984 amended with statutory provisions relating to the public service of the State;
Vu le Decree No. 68-270 of 19 March 1968 amended on the specific status of technical officials of the Mint and Medals;
Vu le Decree No. 2005-1090 of 1 September 2005 relative to the advancement of rank in the bodies of state administrations;
Vu le Decree No. 2009-1388 of 11 November 2009 amended bringing statutory provisions common to various bodies of officials of category B of the public service of the State;
Considering the advice of the single ministerial technical committee of the Ministry of Finance and Public Accounts and the Ministry of Economy, Production Recovery and Digital Affairs of 30 April 2014;

    Article 5 of the aforementioned Decree of 19 March 1968 is amended as follows:


    1° In the third preambular paragraph, the words: "one of which acts as a test director" are deleted;
    2° The fourth and sixth preambular paragraphs are deleted.

    After Article 5 of the same decree, an article 5-1 is inserted as follows:


    "Art. 5-1. - From the coming into force of Decree No. 2014-1164 of 9 October 2014 amending Decree No. 68-270 of 19 March 1968 relating to the special status of technical officials of the Mints and Medals, new recruitments are no longer carried out in the grades referred to in Article 5, except for those carried out under Article 21-1. »

    Article 6 of the same decree is replaced by the following provisions:


    "Art. 6.-The rank of Chief Engineer, Chief Operating Officer, includes four steps.
    "The rank of chief engineer includes four steps.
    "The engineering grade consists of eight steps.
    "The grade of general currency engraver includes three steps.
    "The grade of manufacturing chief includes three steps.
    "The grade of assistant manufacturing chief includes eleven steps.
    "The rank of chief engineer includes thirteen steps.
    "The rank of principal workshop leader is 13 steps.
    "The grade of workshop leader includes thirteen steps.
    "The rank of master engraver consists of six steps.
    "The grade of engraver includes eleven steps.
    "The rank of technical assistant engineer includes thirteen steps. »

    The third, fourth and sixth paragraphs of Article 7 of the same decree are deleted.

    Article 8 of the same decree is replaced by the following provisions:


    "Art. 8.-The officials governed by this decree are appointed and managed by the President and CEO of the institution " La Monnaie de Paris ”, subject to the provisions provided for in the second and third paragraphs of Article R. 121-14 of the Monetary and Financial Code. »

    In Article 19 of the same decree, the words: "By derogation from the provisions of Article 9" and the words: "with the exception of the one referred to in the last paragraph of that Article" are deleted.

    After Article 21 of the same decree, an article 21-1 is inserted as follows:


    "Art. 21-1.-May be promoted to the choice, by way of enrollment to an annual progress table taken after notice of the competent administrative commission, at the grade of:
    « 1° Chief Engineer: Mechanic Technical Assistants justifying at least one year in the 6th grade and at least five years of actual service in their grade;
    « 2° Senior Workshop Leader: Workshop Leaders justifying at least one year in the 6th grade and at least five years of actual service in their grade;
    « 3° Assistant Manufacturing Officer: Chief Engineers and Chief Workshop Officers justifying, as of December 31 of the year of their appointment, at least one year in the 6th grade and at least five years of actual service in these grades;
    « 4° Head of Manufacturing: Assistant Manufacturing Heads with at least five years of seniority in their grade;
    « 5° Master engraver: engravers with at least one year of service in the sixth grade.
    "The agents promoted under this section shall be classified at the level of their new grade with an equal index or, if not, immediately higher than that of which they were in their former grade. They shall, within the limits of the service time required for access to the upper level, retain the seniority they had acquired if the salary increase removed from their promotion is less than that which would have resulted from a level advancement in their former grade.
    "The agents promoted when they had reached the highest class or level of their previous grade retain their seniority, under the same conditions and within the same limits, when the increase in treatment following their promotion is less than the increase that would have been given to them by their appointment to the class or level."

    I. - Progress tables to grades referred to in Article 11, b of Articles 12 and 12 bis and toarticle 21 of the decree of 19 March 1968 referred to above, in its writing prior to the coming into force of this decree, established under the year 2014, remain valid until December 31 of that same year.
    II. - Agents promulgated pursuant to the preceding paragraph after the date of entry into force of this Order shall be classified in their new rank, taking into account the situation that would have been theirs if they had not ceased to be governed, until the date of their promotion, by the provisions of the Decree of 19 March 1968, in its writing before this decree, then promulgated in their new rank under the same provisions, and finally reclassified to that same date in accordance with the provisions of Article 10.

    This Order comes into force on the first day of the month following its publication in the Official Journal of the French Republic.

    The Minister of Finance and Public Accounts, the Minister of Economy, Industry and Digital Affairs, the Minister of Decentralization and Public Service and the Secretary of State responsible for the budget are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
