In view of the March 30, 2006 decision establishing an automated processing of individual information from administrative files relating to non-salariees;
Considering the referral of the National Commission on Informatics and Freedoms dated 14 March 2014,
Stop:
It is created at the National Institute of Statistics and Economic Studies (INSEE) an automated processing of personal data relating to the management of a permanent demographic sample that has the sole purpose of developing demographic and social statistics.
The recorded information concerns persons born from 2 to 5 January, from 1 to 4 April, from 1 to 4 July and from 1 to 4 October of each year.
This information is derived from the national index of identification of physical persons, censuses of the successive population, statistical bulletins of the civil status, the electoral file, annual social data declarations and statistical exploitation for the study of the employment and income of activity of non-salaries.
The different categories of information treated are:
- identification and civil status data;
- personal and professional life data;
- economic and financial data;
- NIR.
The Archives de France are recipients of the individual information collected identifying the persons, in accordance with provisions of Article L. 212-4 of the Heritage Code.
Individual information derived from the treatment provided for in Article 1 for the identification of persons may be disclosed under the conditions provided for inArticle 17 of Decree No. 2009-318 of 20 March 2009 referred to abovefor purposes of public statistics or scientific or historical research, by decision of the administration of the archives taken after advice of the Committee of Statistical Secret and agreement of the National Institute of Statistics and Economic Studies.
The rights of access and rectification provided by the articles 39 and 40 Act No. 78-17 of 6 January 1978, as amended, applies to the regional branches of the National Institute of Statistics and Economic Studies.
The right of opposition provided forArticle 38 of Act No. 78-17 of 6 January 1978 Amended does not apply to this treatment.
The decision of May 23, 1984 on the definition of the permanent demographic sample of INSEE and the measures taken to ensure the safety of treatment is repealed.
The Director General of the National Institute of Statistics and Economic Studies is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
