Decree No. 2014-1054 of 16 September 2014 derogating from minimum working and rest guarantees applicable to certain officials of the Ministry of Foreign Affairs and International Development in service to the central government

Public officials: agents of the Ministry of Foreign Affairs and International Development assigned to the crisis centre.
Subject: derogation from the minimum working and rest guarantees for officers in the crisis centre.
Entry into force: the text comes into force on the day after publication.
Notice: to take into account the specific constraints of the crisis centre of the Ministry of Foreign Affairs, this decree sets out a specific time-frame based on the following:
- daily working hours maximum 14 hours;
- maximum amplitude of the working day fixed at 3 p.m.;
- maximum effective weekly working time set at 65 hours during the same week, with an average duration of 48 hours over any period of six consecutive months;
- provision of compensatory rest and financial compensation under the compensation plan and in the form of allowances for trespass and intervention.

On the report of the Minister for Foreign Affairs and International Development,
Having regard to Directive 2003/88/EC of the European Parliament and the Council of 4 November 2003 on certain aspects of working time development;
Vu le Decree No. 2000-815 of 25 August 2000 amended on the development and reduction of working time in the public service of the State and in the judiciary, including its article 3;
Considering the advice of the Departmental Technical Committee of the Ministry of Foreign Affairs of 31 May 2012;
Considering the opinion of the Supreme Council of the State Civil Service of 4 March 2014;
The State Council (Section of Administration) heard,

It may be derogated, for agents of the crisis centre of the Ministry of Foreign Affairs responsible for the day before, anticipation, alerting and management of crises taking place abroad, to the minimum guarantees of work duration and rest fixed at the time of work I of Article 3 of the decree of 25 August 2000 referred to above under the conditions mentioned in articles 2 to 4 of this decree.

I. - The actual working hours can be up to 14 hours, the maximum amplitude of the working day can be up to 15 hours, the continuous daily rest can be reduced to nine hours.
The actual working time may not exceed twelve hours thirty, however, when it includes the period between 22 hours and 7 hours.
II. - The effective weekly working time can be up to sixty-five hours during the same week, with a minimum weekly rest period of thirty-five hours.
However, the average working hours may not exceed 48 hours for any period of six consecutive months.

The officers referred to in section 1 shall be paid financial compensation and additional rest days, subject to the conditions specified by an order of the Minister for Foreign Affairs.

The administration shall annually inform the committee of hygiene, security and working conditions of the implementation of the provisions of this decree.

The Minister for Foreign Affairs and International Development, the Minister of Finance and Public Accounts, the Minister of Decentralization and the Public Service and the Secretary of State responsible for the budget are responsible, each with regard to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.
