Key Benefits:
Public officials concerned: civil servants Civil and Military Pension Code or the National Pension Fund of Local Government Officials (CNRACL) and workers under the pension scheme of workers of state industrial establishments.
Purpose: Changes in the representative rate of the employer contribution in the formula for calculating the retention rate to be applied for part-time employees and wishing to over-assemble.
Entry into force: the text comes into force on October 1, 2014.
Notice: This decree now sets out the representative rate of the employer contribution for the calculation of the retention rate to be applied to employees and workers working part-time and wishing to overtake so that their quotity of working time counts as a full time for the liquidation of pension, by reference to the rate of the contribution of employers under the CNRACL or the special pension fund of workers of the industrial establishments of the State, in order to take account of their evolutions.

Vu le Civil and Military Pension Codeincluding articles L. 11 bis and L. 61;
Vu le Decree No. 91-613 of 28 June 1991 Amending the contribution rates of various special social security schemes;
Vu le Decree No. 2003-1306 of 26 December 2003 amended on the pension plan for staff members affiliated to the National Pension Fund for Local Government Officers, including article 14;
Vu le Decree No. 2004-678 of 8 July 2004 Amending the rate of assessment provided for in Article L. 11 bis of the Civil and Military Pension Code;
Vu le Decree No. 2004-1056 of 5 October 2004 modified in relation to the pension regime of workers of industrial establishments of the State, including articles 1 and 11;
Vu le Decree No. 2007-173 of 7 February 2007 amended on the National Pension Fund for Local Government Officers;
Vu le Decree No. 2008-1328 of 15 December 2008 amended on the rate of contribution of the pension scheme of workers of industrial establishments of the State,
Decrete:
Article 1 of the above-mentioned Decree of 8 July 2004 is amended as follows:
1° The first paragraph is replaced by the following:
"For the purposes of Article L. 11 bis of the Civil and Military Pension Code, of theArticle 14 of Decree No. 2003-1306 of 26 December 2003 relating to the pension plan for officials affiliated to the National Pension Fund for Local and Local Government OfficersArticle 11 of Decree No. 2004-1056 of 5 October 2004 concerning the pension system of the workers of the industrial establishments of the State, are governed by the provisions of this decree:"
2° After the last paragraph, the following paragraph is added:
« 3° The workers mentioned to theArticle 1 of Decree No. 2004-1056 of 5 October 2004 relating to the pension scheme of workers of state industrial establishments. »
The second sentence of the second paragraph of the second paragraph of the second paragraph of the I of Article 2 of the same decree is replaced by the following sentence: "The latter rate is equal to the rate prescribed at the II of Article 5 of Decree No. 91-613 of 28 June 1991 setting the rates of contributions of various special social security plans for public servants and at the rate provided for in theArticle 1 of Decree No. 2008-1328 of 15 December 2008 the rate of contribution of the pension plan of the workers of the state industrial establishments. »
The provisions of this Order come into force on the first day of the month following its date of publication.
The Minister of Finance and Public Accounts, the Minister of Social Affairs, Health and Women's Rights, the Minister of the Interior, the Minister of Decentralization and the Public Service and the Secretary of State responsible for the budget are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
