Decree No. 2014-959 of 22 August 2014 on the allowance of persons assigned to certain staff of the National Institute for Geographical and Forest Information

Publics concerned: Officers of the National Institute of Geographical and Forest Information (IGN).
Subject: Creation of an allowance for the agents of the IGN performing periods of confinement.
Entry into force: the text comes into force on the day after publication.
Notice: the specific tasks of the IGN need to establish, in certain special situations, appropriate working organizations that translate in particular into the need for some agents to perform intertwining. Derogations from the minimum working and rest guarantees are thus provided for these officers.
This Order sets out the terms and conditions for payment of compensation to agents of the IGN who perform contempt. The list of activities of the IGN that may give rise to the establishment of intertwine is specified by order.

Vu la Act No. 83-634 of 13 July 1983 amendments to the rights and obligations of civil servants, together with Act No. 84-16 of 11 January 1984 amended with statutory provisions relating to the public service of the State;
Vu le Decree No. 48-949 of 4 June 1948 amended to regulate public administration on the situation of qualified temporary workers of the National Geographical Institute;
Vu le Decree No. 67-91 of 20 January 1967 amended on the specific status of the geometers of the National Institute of Geographical and Forest Information;
Vu le Decree No. 73-264 of 6 March 1973 modified in relation to the specific status of engineers of the geographical and cartographic works of the State;
Vu le Decree No. 86-83 of 17 January 1986 amended to apply the general provisions applicable to non-State agents for the application of theArticle 7 of Act No. 84-16 of 11 January 1984 amended with statutory provisions relating to the public service of the State;
Vu le Decree No. 94-874 of 7 October 1994 Amending the common provisions applicable to trainees of the State and its public institutions;
Vu le Decree No. 2000-815 of 25 August 2000 amended on the development and reduction of working time in the public service of the State, including Article 5;
Vu le Decree No. 2006-1760 of 23 December 2006 amended on the common provisions applicable to the administrative units of the state administrations;
Vu le Decree No. 2006-1761 of 23 December 2006 amended with respect to the common statutory provisions applicable to the bodies of technical assistants of State administrations,

The National Institute of Geographical and Forest Information Officers shall be provided with a service allowance when integrated into one of the organizations established pursuant to the decree of 25 August 2000 referred to aboveunder the following conditions:
I. - Holders or trainees of engineers of the geographic and cartographic works of the State and geometers of the National Institute of Geographical and Forest Information may receive an operating allowance when, for the needs of the service, they are required to remain at home or in the vicinity in order to be able to intervene.
Aeronautical personnel in the air operations department, state workers and non-public law officers performing equivalent functions may be entitled to an operating allowance under the same conditions.
II. - Public servants, non-responsive agents and state workers subject to contempt may receive maintenance allowance.

The allowance of a victim cannot be attributed to agents who benefit from an absolute necessity of accommodation of service or a new indiciary bonus under higher responsibility functions.

The amount of the allowance provided for in Article 1 shall be determined by a joint order of Ministers for Sustainable Development, Budget and Public Service. It is increased by 50% when the officer is notified of his detention for a period of less than fifteen frank days before the beginning of that period.

The Minister of Ecology, Sustainable Development and Energy, the Minister of Finance and Public Accounts, the Minister of Decentralization and the Public Service, the Minister of Agriculture, Agri-Food and Forestry, spokesperson for the Government, and the Secretary of State responsible for the budget are responsible, each with regard to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
