Having regard to Decree No. 53-192, 14 March 1953 as amended relating to the ratification and the publication of the international commitments entered into by France;
Mindful of Decree No. 99 - 605 of 7 July 1999 on the publication of the agreement between the Government of the French Republic and the Government of the People's Republic of China on cooperation in the field of public service, signed in Beijing on 18 January 1999, enacts as follows: Article 1 the agreement between the Government of the French Republic and the Government of the People's Republic of China on cooperation in the field of administration and service public, signed in Beijing on January 9, 2014, will be published in the Official Journal of the French Republic.
Article 2 the Prime Minister and the Minister of Foreign Affairs and international development are responsible, each in relation to the implementation of this Decree, which shall be published in the Official Journal of the French Republic.
AGREEMENT between the Government of the French Republic and the Government of the people's Republic of China on COOPERATION in the field of ADMINISTRATION and public service the Government of the French Republic and the Government of the People's Republic of China (hereinafter referred to as the Parties), considering that the cooperation in the field of administration and public service between the administrations of the two countries has proved successful in implementation of the agreement between the Government of the French Republic and the Government of the People's Republic of China on cooperation in the field of the public service of January 18, 1999;
Convinced to give a new impetus to cooperation between the two countries widened to the modernisation of the administration;
Eager to promote and develop exchanges and cooperation in the field of the administration and the public service on the basis of equality and reciprocity and the mutual interests of both parties;
Eager to reaffirm at the ministerial level the bonds of friendships and administrative cooperation between the France and China, have agreed to the following: Article 1 this agreement establishes the framework for cooperation and exchanges between the Parties, in the field of administration and public service.
Article 2. Parties shall ensure the development of cooperation and bilateral exchanges in the field of administration and public service, under the laws and regulations in force in each of the States.
Article 3 the objective of this agreement is to establish a framework for bilateral cooperation focused on programs of common interest and declined every year cooperation action plan.
Article 4 the Parties develop joint actions of exchanges of good practices and expertise in the following areas: 1. the professionalization of the management of human resources within public administrations;
2. strengthening governance of the public service;
3. the territorial administration and local authorities;
4. the simplification of administrative procedures;
5. the modernisation of the administration and development of the electronic administration;
6. the training of trainers;
7. other themes which the Parties may agree.
Article 5 actions of cooperation arising out of this agreement may take the form of: 1. Ministerial visits;
2. expert missions;
3 study trips;
4. Organization of seminars;
5. Exchange of documentation and publications;
6. other forms of cooperation agreed between the two parties.
Subject to funding available from the Embassy of France in People's Republic of China or other french and Chinese partners of cooperation arising out of this agreement may also take the form of studies or internship scholarships.
Article 6 for the purposes of this agreement, the Parties establish a Steering Committee composed equally of french and Chinese representatives. These representatives are from the Ministry of the State reform, decentralisation and public service of the French Republic, of the Ministry of human resources and social security of the People's Republic of China and the diplomatic missions of the two Parties. List of the members of their delegation to the Steering Committee and changes, the Parties shall notify each other by note verbale.
The Steering Committee meets in principle once a year. Its meetings are held in France or China. Otherwise, his work is done remotely, electronically or by any other appropriate means.
Article 7 the Steering Committee is in charge: 1. define the activities to be undertaken in respect of an annual plan of action for cooperation;
2. to identify and encourage the participation of other partners in cooperation activities, in particular: National School of administration, Central School of Chinese Communist Party Academy of Chinese governance, Training Centre of the senior officials of the Ministry of human resources and social security.
3. to conduct a qualitative assessment of the achievements carried out in respect of the previous year.
Cooperation action plan defines, for each year, the activities to be implemented in respect of this agreement. They are the object of concerted action between the two Parties. Each Party designates and shall notify the other party authorities for implementation.
Article 8 the cost of mission of the members of the Steering Committee are supported by their respective countries. The host country facilitates the smooth running of the stay of the delegation of the sending country and bears the costs of material organization of meetings according to a principle of reciprocity.
Cooperation actions selected clans the framework for the implementation of this agreement are carried out within the limits of the appropriations available each year by each administration for its current operation.
The Parties may, if they deem it necessary, agree on other modalities of financial support for the cooperation activities under this agreement. They shall endeavour in particular to mobilize, where possible, the resources of multilateral cooperation programs.
Article 9 this agreement repeals and replaces, from its entry into force, the agreement between the Government of the French Republic and the Government of the People's Republic of China on cooperation in the field of public service signed on January 18, 1999.
Each Party shall notify the other party the accomplishment of the internal procedures required for the entry into force of the present agreement, which takes effect on the day of receipt of the last notification.
It is concluded for a period of three years and may be extended every three years by the exchange of letters between the Parties. If one of the Parties intends to terminate this agreement, it shall notify the other party through diplomatic channels and six months in advance. Unless the Parties otherwise agree, the termination of this Agreement shall not affect the implementation of the already agreed cooperation activities between the Parties.
Any dispute related to the interpretation or application of this agreement is settled by amicable negotiation between the Parties.
In witness whereof, the representatives of the Parties, duly authorized thereto, have signed this agreement.
Done in Beijing on January 9, 2014, in two originals, each in the French language and in the language Chinese, both versions being equally authentic.
