Decree No. 2014-419 of 23 April 2014 on the increase in the family supplement referred to in articles L. 522-3 and L. 755-16-1 of the Social Security Code

The public concerned: beneficiaries of family benefits.
Subject: Increase in the amount of the family supplement as of April 1, 2014 and fixing the amount of the resource ceiling of the amount increased from the family supplement.
Entry into force: the provisions of this Decree shall apply to benefits due on or after April 1, 2014.
Notice: in accordance withArticle 73 of Act No. 2013-1203 of 23 December 2013 the purpose of this Decree is to set the rates for the calculation of the amount in force as of 1 April 2014 plus the family supplement provided for in the articles L. 522-3 and L. 755-16-1 Social Security Code. It sets the amount of the resource cap, which varies according to the number of dependent children, below which the benefit will be due and its increase when the burden of children is borne by either a couple whose each member has a professional income or by a single person.

Vu le Social Security Codeincluding articles L. 522-3 and L. 755-16-1;
Vu la Act No. 2013-1203 of 23 December 2013 the financing of social security for 2014, including its article 73;
Considering the advice of the Board of Directors of the National Family Allowance Fund dated 4 February 2014;
Considering the advice of the Central Board of Directors of the Agricultural Social Mutuality dated 6 February 2014;
Considering the referral of the Regional Council of Guadeloupe dated 27 February 2014;
Considering the referral of the general council of Guadeloupe dated 27 February 2014;
Considering the referral of the Martinique Regional Council dated 27 February 2014;
Considering the referral of the General Council of Martinique dated 27 February 2014;
Considering the referral of the Regional Council of La Réunion dated 27 February 2014;
Considering the referral of the General Council of La Réunion dated 27 February 2014;
Considering the referral of the General Council of Guyana dated 28 February 2014;
Considering the referral of the Guyana Regional Council dated 6 March 2014,

The resource ceiling and the increase planned for first and third paragraphs of Article R. 522-4 of the Social Security Code are set respectively at 10,360 € and 4,164 € for the period from 1 April 2014 to 31 December 2014.

The resource ceiling mentioned in theArticle R. 755-4 of the Social Security Code is set at 9 284 € for the period from 1 April 2014 to 31 December 2014.
It is increased for the same period by €2,785 per dependent child from the first.

I. - After article D. 522-1 of the Social Security Code, it is created an article D. 522-2 as follows:
"Art. D. 522-2. ― The rate of the extended family supplement is 45.82 per cent of the monthly basis for calculating family allowances established under section L. 551-1. »
II. - After article D. 755-6 of the Social Security Code, an article D. 755-6-1 is inserted as follows:
"Art. D. 755-6-1. ― The rate of the extended family supplement is 26.17 per cent of the monthly basis for calculating family allowances established under section L. 551-1. »

The provisions of this Decree shall apply to benefits due on or after April 1, 2014.

The Minister of Finance and Public Accounts, the Minister of Social Affairs and Health, the Minister of Agriculture, Agri-Food and Forestry, spokesperson for the Government, and the Minister of Overseas are responsible, each with regard to the implementation of this Order, to be published in the Official Journal of the French Republic.
