Judgment of 27 January 2014 concerning the requirements for transfer and debit transactions defined in Article L. 712-8 of the monetary and financial code

For the realization of the transfer and debit operations in euros referred to in Article L. 712-8, the following means:
1° "Payment Scheme" a unique set of rules or guidelines, agreed between payment service providers, for the execution of payment transactions;
2° "RIB" a payment account number that identifies an individual payment account opened to a payment service provider and that can only be used for local payment transactions, the same payment account being identified by an IBAN number for other payment transactions;
3° "International Bank and Account Number (IBAN)", a payment account number identifying an individual payment account, the elements of which are specified by the International Organization for Standardization (ISO);
4° "BIC" a company identification code to identify a payment service provider and whose elements are specified by ISO;
5° "ISO Standard 20022 XML" the syntax of the standard defined by the International Organization for Standardization (ISO) used for the development of electronic financial messages, including the physical representation of payment transactions using an XML syntax, in accordance with the rules applicable to payment transactions;
6° "System Payment System" a payment system whose main purpose is to process, compensate or settle single payment transactions that are very priority and urgent, and mainly high;
7° "Enceasing" the portion of a sampling transaction that begins when it is initiated by the recipient and ends with the payor's payment account flow;
8° "Termination" means the expression of the consent and authorization given by the payer to the beneficiary and, directly or indirectly through the recipient, to the payer's payment service provider to allow the recipient to submit a transaction to the encumberment to debit the specified payment account of the payer and to allow the payer's payment service provider to comply with these instructions;
9° "Detail Payment System" means a payment system whose main purpose is to treat, compensate and pay transfers or levies, mainly of a low and low amount, which are generally grouped for transmission;
10° "Consumer" a natural person who acts for a purpose other than his commercial or professional activity in the field of payment services contracts;
11° "Transaction R" means a transaction in the event of a payment transaction that cannot be performed correctly by a payment service provider or is subject to exceptional processing, in particular due to a lack of provision, a revocation, an erroneous amount, an erroneous date or an erroneous or fenced account;
12° "Reference Thirds" a natural or legal person on whose behalf a payer makes a payment or on whose behalf a beneficiary receives a payment.

Payment service providers who carry out payment transactions in euros defined in Article L. 712-8 shall use:
1° The ISO20022 XML syntax, for the development of electronic financial messages in the transmission of payment transactions to another payment service provider or via a retail payment system;
2° IBAN identifier of the recipient's payment account and the payer's account.

Payment service providers carry out the Euro Transfer transactions referred to in Article D. 712-20, in accordance with the following requirements:
1° The payer's payment service provider must ensure that the payer provides the following:
(a) The name of the payer;
(b) IBAN number of the payor's payment account;
(c) The amount of the transfer in euros;
(d) IBAN number of the recipient's payment account;
(e) The name of the beneficiary;
(f) Any wording of the operation;
2° The payer's payment service provider must provide or make available to the recipient's payment service provider the following:
(a) The name of the payer;
(b) IBAN number of the payor's payment account;
(c) BIC of the payor's payment service provider;
(d) The amount of the transfer in euros;
(e) IBAN number of the recipient's payment account;
(f) BIC of the recipient's payment service provider;
(g) The payment scheme identification code;
(h) The date of payment of the transfer;
(i) The reference number of the transfer message given by the payor's payment service provider.
The payer's payment service provider may also provide or make available to the recipient's payment service provider the following:
(a) Any wording of the operation;
(b) Any recipient identification code;
(c) The name of any third-party reference;
(d) Identification of the nature of the transfer;
3° The recipient's payment service provider must provide the recipient with the following:
(a) The name of the payer;
(b) The amount of the transfer;
(c) Any wording of the operation.

Payment service providers shall carry out the Euro collection operations referred to in Article D. 712-20 in accordance with the following requirements:
1° The recipient's payment service provider must ensure that the payer consents to both the recipient and the payer's payment provider, directly or indirectly through the recipient, by means of a warrant, held by the recipient or by a third party, on behalf of the recipient;
2° The recipient's payment service provider must ensure that the recipient provides, in each sampling operation, the following data:
(a) The type of sampling (single, first, recurring or last);
(b) The name of the beneficiary;
(c) IBAN number of the recipient's payment account;
(d) The name of the payer;
(e) IBAN number of the payor's payment account;
(f) The unique reference of the mandate;
(g) The date of signature of the mandate;
(h) The amount of cashing;
(i) Recipient identifier (SEPA creditor identifier [ICS]);
(j) During the first transaction following the resumption of the mandate by another beneficiary other than the one who issued it, the recipient's identifier who initially issued the mandate, and the sole reference of the mandate given by the recipient;
(k) Any wording of the transaction provided by the recipient to the payer;
(l) Any kind of encumberment and category relating to such encumberment;
3° The recipient's payment service provider shall provide or make available to the payer's payment provider, in addition to the items mentioned in 2° of this section, the following:
(a) BIC of the recipient's payment service provider;
(b) BIC of the payor's payment service provider;
(c) The name of any third-party payor reference and its identification code, if this information appears on the dematerialized mandate;
(d) The name of any third-party beneficiary reference and its identification code, if this information is on the dematerialized mandate;
(e) The payment scheme identification code;
(f) The date of settlement of the deposit;
(g) The reference of the recipient's payment service provider;
(h) The type of mandate;
4° The payer's payment service provider must provide the payer with the following:
(a) The unique reference of the mandate;
(b) The name of the beneficiary;
(c) Recipient ID;
(d) The amount of cashing;
(e) Any wording of the operation;
(f) The payment scheme identification code;
5° If the payer is a consumer, he must have the right to inform his payment service provider of:
(a) Limit the cashing to a certain amount or to a certain periodicity;
(b) Block any levy initiated by one or more specified beneficiaries or authorize only the levies initiated by one or more specified beneficiaries;
6° During the first sampling operation and in each subsequent sampling operation, the recipient sends the mandate information to the payment service provider, who transmits this information to the payor's service provider during each sampling operation.

Payment service providers located throughout the territory of the French Republic are able to receive transfers and debits in the format defined by Articles 1 to 4 of this Order.

Payment service providers are authorized to offer services to derogate from the provisions of 1° of Article 3 and 2° of Article 4.

The provisions of this Order come into force on 1 February 2014.
