Judgment of July 29, 2013 concerning the apprenticeship booklet of category B of the driver's licence

Subject: determination:
- the content of the pedagogical part of the learning booklet;
– the content of the administrative part of the learning booklet.
Entry into force: the Order comes into force as of July 1, 2014, when the December 22, 2009 Learning Book Order will be repealed.
Notice: This Order does not impose the obligation of a model type of booklet.
In order to ensure consistency in the training of the driver, the use of the booklet as a pedagogical support and an exchange tool between the driver's teacher and the driver's student remains a priority, but its realization and design are free provided that the general framework of the training set out in annex III is respected. The contents of the booklets shall comply with the following requirements:
a pedagogical part presenting the general framework of the training program established by the State;
- an administrative part allowing the follow-up of training in early learning and supervised driving.

Any person who learns to drive a motor vehicle, in order to obtain the category B driver's licence referred to in theR. 221-4 road code, must be holder of the application form for a driver's licence validated by the prefect of the department in which the application was filed and a learning booklet. During practical driving learning, these two documents must be present in the vehicle. Only the form of the application for a driver's licence, or its photocopy, is used to justify its driver's student status in the event of control by the officers and agents authorized to perform road controls.

However, pending the prefect's validation of a Class B application of the driver's licence, a receipt of the application issued by the prefect allows the student to begin his or her practical training for a period not exceeding two months.
The receiver allows to justify the driver's student condition in the event of control by the officers and agents authorized to perform road controls.
This receipt, in accordance with the attached model in Appendix I, loses any validity as long as one of the conditions specified by the order of April 20, 2012 referred to above is not met. The prefect informs the student that he is no longer allowed to continue his training. He also informs, if any, the educational institution in which the student is enrolled.

The learning booklet specifies all the skills to be acquired during the course of the training.
Any Category B vehicle instruction booklet shall be in accordance with the contents of Annexes II, III and IV to this Order and shall enable the completion of a balance sheet of the level of acquisition of competencies described in Appendix III.

In the event of loss or theft of the learning booklet, a new copy is established by the student conductor, with the help of the teacher or companion.

The provisions of this Order come into force as of July 1, 2014, when the December 22, 2009 Learning Book Order is repealed.

The prefect, delegate for road safety and traffic, is responsible for the execution of this decree, which will be published in the Official Journal of the French Republic.

    This receipt is valid for a maximum of two months from the date shown below. It loses any validity as long as one of the conditions set out in the amended decision of 20 April 2012 setting the conditions for the establishment, issuance and validity of the driver's licence is not met.

    WARNING: The booklet will be used for your training regardless of the chosen sector. It will need to understand the necessary regulatory certifications.
    The preamble addresses the following five points:
    Why better learn to drive?
    What is the usefulness of your learning booklet?
    – what training program?
    – how are your progress assessed?
    - How is the exam going?
    1. Why better learn to drive?
    The automobile has become an indispensable social tool for a very large part of the youth of our society.
    Beyond the pleasure of driving, the use of a car is often essential for studies, work or leisure. Rolling safely is therefore a necessity for all.
    Beginner drivers represent too much of the killed and injured on the road.
    The effort must be pursued, including by strengthening education and training.
    Road accidents are not related to fatality and to help new drivers to move with a low risk of losing life or degrading it, a new training program is put in place.
    The general objective is to bring any motorist beginning to the mastery of skills in terms of know-how, know-how, and know-how.
    Learning to drive is a demanding educational approach and this booklet will guide you in your progress with the help of your trainer, a graduate of road safety or your coach.
    2. What is the usefulness of your learning booklet?
    It is, with your application for a driver's license (CERFA 02), the indispensable and mandatory document during your courses, both theoretical and practical.
    In this booklet you will find:
    mandatory documents for the following courses: traditional training, early learning of conduct or supervised driving;
    – the thirty goals to work and validate through differentiated approaches.
    This booklet will guide you in your learning path. It allows you to know "where you are" but also and especially "where you go".
    You will gradually become autonomous and competent.
    3. What training program?
    This program is intended to be an overview, as exhaustive as possible, of the skills that a responsible driver must acquire in order not to put his safety and that of others at risk.
    You will need to be aware that what is learned in training must progress and evolve, after obtaining the driver's license, taking into account the same security objectives as when learning.
    You will learn how to manipulate a car and to circulate in different configurations, to know its risks and limitations.
    You go through this program understand the rules of road code and the influence of physical, psychological and physiological laws.
    You will also have to place yourself as a citizen in your choice of conduct.
    Theory and practical courses, collective or individual, will help you achieve the defined goals and customize your progress. Your trainer will be with you to guide and advise you.
    Knowledge and capacity tests can be put in place as well.
    4. How are your progress assessed?
    To provide benchmarks, four progress grids accompany the student in the acquisition of skills (Appendix III). They detail the behavioural, technical and environmental knowledge to be available to the student as they evolve.
    For each of the objectives of your program, evaluations implemented by your trainer, which will specify the criteria and conditions of success, are planned. It will be possible for you to measure your success or to appreciate the elements to progress.
    Likewise, for each of the objectives, which involve the awareness that you will have of your abilities, motivations and limitations, self-assessments are available on each of the four grids.
    When all required skills are validated, your trainer will be able to present you to the driver's license tests.
    5. How is the exam going?
    The practical test for the examination of the driver's licence is evaluated by an expert: the driver's licence inspector and road safety.
    On the day of the exam, the test is presented to you individually by the expert, who specifies what you will have to do:
    ― to carry out a journey through urban, road and/or highway routes;
    · follow a route or go to a previously established destination, guided independently, for a total duration of about five minutes;
    – to carry out two different manoeuvres, including at least one in the rear and one at its initiative;
    - perform the verification of a technical element inside and outside the vehicle and answer a question related to road safety;
    ∙ apply the rules road code, in particular, speed limits applicable to conductor students;
    ― adapting your driving in an effort to save fuel and reduce greenhouse gas emissions;
    - to be courteous to other users, especially the most vulnerable.
    The expert's assessment is based on specific regulations and instructions that set out the terms and conditions.
    This evaluation consists of an assessment of the necessary and fundamental skills to be gained for safe driving, as driving is a difficult act that entails a strong responsibility.
    The expert strives to value your behavioral gains rather than your weaknesses. It thus produces an inventory of the positive and negative points returned to a given jurisdiction. An exchange between the expert and you can start during the trial.
    At the end of the test, the expert formally transcribes this balance of competence in an evaluation grid.
