Order of May 2, 2013 on the terms and conditions of organization of the public statistics label committee

Vu la Act No. 51-711 of 7 June 1951 amended on the obligation, coordination and secrecy of statistics;
Vu le Decree No. 2009-318 of 20 March 2009 relating to the National Council of Statistical Information, the Committee on Statistical Secret and the Committee on the Public Statistics Label, including Chapter IV;
Considering the opinion of the Public Statistics Authority of 26 March 2013;
Considering the opinion of the National Statistical Information Council of 23 April 2013,

I. ― The chair of the Public Statistics Label Committee is appointed for a period of three years. Its mandate is renewable once.
A rapporteur from the Public Statistics Label Committee, appointed by the Director General of the National Institute of Statistics and Economic Studies, prepares the documentation submitted to the committee.
II. - The Public Statistics Label Committee comprises three competent commissions to review projects involving the collection of information through statistical surveys, respectively:
1° Companies, national public bodies and their institutions, liberal professions, territorial authorities or local public institutions;
2° Households or natural persons;
3° Farms or their farmers.
The Chair may decide to entrust the review of a file simultaneously to several competent commissions.
In the case of a favourable evaluation of the project, the notice of compliance given to the investigation by the Public Statistics Label Committee and the notice of its mandatory nature are forwarded to the President of the National Statistical Information Council. It can issue a label of general interest and statistical quality. It transmits these notices to the Ministers concerned, who may issue the visa to theArticle 2 of the Act of 7 June 1951 referred to above and decide on the mandatory nature of the investigation.
III. - It includes a competent commission to give the notices resulting from the examination:
- either, on behalf of the National Statistical Information Council and at the request of the National Statistical Information Council, statistics produced by private law bodies; in this case, these opinions are forwarded to the President of the National Statistical Information Council, who considers their contribution to the general interest;
- either, on behalf of the Public Statistics Authority and at the request of the Public Statistics Authority, processes for the exploitation and dissemination of data collected by government departments, public bodies and private bodies responsible for a public service mission for general information. In the latter case, these notices are transmitted to the president of the Public Statistics Authority, who can issue to the processes examined a label of general interest and statistical quality, in reference to the principles of the code of good practices of European statistics.

The competent commission for projects relating to companies, national public bodies and their institutions, liberal professions, territorial authorities or local public institutions, including the collection of information through surveys, includes, in addition to the chair of the Public Statistics Label Committee:
1° A representative of the Mouvement des entreprises de France;
2° A representative of the General Confederation of Small and Medium Enterprises and Real Patronage;
3° A representative of the Assembly of French Chambers of Commerce and Industry;
4° A representative of the Permanent Assembly of Chambers of Crafts and Crafts;
5° A representative of the artisanal professional union;
6° A representative of trade union organizations referred to in 3° of Article 5 of the decree of 20 March 2009 referred to above chosen by these;
7° The Director of Business Statistics at the National Institute of Statistics and Economic Studies;
8° The head of an investigator service designated by the chair of the public statistics label committee, implementing statistical surveys under this commission;
9° In the case of a regional or local initiative survey, the Regional Action Director at the National Institute of Statistics and Economic Studies.
In the case of a project relating to local authorities or local public institutions, persons designated at 1°, 2°, 4°, 5°, 7° and 9° are replaced by persons designated at 10°, 11°, 12° and 13°:
10° The Director General of Local Government;
11° The interdepartmental delegate to land development and regional attractiveness;
12° A secretary general for regional affairs appointed by the chair of the public statistics label committee;
13° The Director of Regional Action at the National Institute of Statistics and Economic Studies.

In addition to the chair of the public statistics label committee, the competent committee for household or natural persons projects, including the collection of information through surveys, includes:
1° Two persons designated by the President of the National Commission on Informatics and Freedoms;
2° A representative of trade union organizations referred to in 3° of Article 5 of the decree of 20 March 2009 referred to above chosen by these;
3° A representative of the National Union of Family Associations;
4° A representative of the Scientific Council of the Human and Social Sciences Data Consultation Committee;
5° The Director of Population and Social Statistics at the National Institute of Statistics and Economic Studies;
6° The head of an investigator service designated by the chair of the public statistics label committee, implementing statistical surveys under this commission; and
7° In the case of a regional or local initiative survey, the Regional Action Director at the National Institute of Statistics and Economic Studies.

In addition to the chair of the Public Statistics Label Committee, the competent commission for agricultural farm projects or their operators, including the collection of information through surveys, includes:
1° A representative of the Permanent Assembly of the Chambers of Agriculture;
2° A representative of the National Federation of Agricultural Operator Unions;
3° A representative of the National Institute of Agricultural Research;
4° A representative of the Central Board of Directors of Agricultural Social Mutuality;
5° A regional or departmental director in charge of agriculture;
6° The Chief of the Statistical Service of the Ministry of Agriculture;
7° The Director of Business Statistics at the National Institute of Statistics and Economic Studies; and
8° In the case of a regional or local initiative survey, the Regional Action Director at the National Institute of Statistics and Economic Studies.

The commission referred to in Article 1 III includes, in addition to the chair of the Public Statistics Label Committee:
1° In cases where the request arises from the National Council of Statistical Information (CNIS), a personality appointed by the President of CNIS or, in cases where the application emanates from the Public Statistics Authority (PSA), a personality appointed by the President of the PSA;
2° The Director of Statistical Coordination at the National Institute of Statistics and Economic Studies;
3° A representative of the Minister in charge of the area concerned or the administration collecting the data;
4° A personality appointed by the chair of the public statistics label committee, designated during each examination;
5° An expert recognized for his competence in the area concerned, appointed by the chair of the public statistics label committee and with an advisory voice, designated during each review.

With the exception of persons designated at 1°, 4° and 5° of Article 5, the members of the commissions mentioned in sections 2 to 5 may be represented by a person other than one of those already designated as a member of the same commission. They may also, if they are unable to attend a meeting of a commission of which they are members, give their power to a member present.

The competent committees of the committee shall meet on the convocation of the chair to review the files presented to it. They may only deliberate in a valid manner if at least half of the members are present or represented or have expressly given power.
In each of these committees, experts participate in committee meetings with an advisory voice. These experts are appointed by the chair of the committee on the proposal of the rapporteur.
In the case provided for in Article 1 II, the deliberation concerns the proposal for the award of a general interest and statistical quality mark and, in the case the investigator has requested, a notice on the mandatory nature of the investigation.
The members of the commissions designated at the 7th and 8th of Article 2, at the 5th and 6th of Article 3 and at the 6th and 7th of Article 4 shall abstain in a deliberation concerning a file or project in which they participated.
In the event of an emergency, the President may, with the consent of the members of the Commission or the committees concerned, establish a written or electronic deliberation.
