Vu la Act No. 78-17 of 6 January 1978 modified in relation to computing, files and freedoms, including articles 27-II (4°) and 27-III;
Vu le Decree No. 2010-112 of 2 February 2010 taken for application of articles 9,10 and 12 of Order No. 2005-1516 of 8 December 2005 on electronic exchanges between users and administrative authorities and between administrative authorities;
Vu the opinion of the National Commission on Informatics and Freedoms of 31 May 2012,

It is created at the Ministry of National Education an automated processing of personal data called OCEAN with the purpose of the operations specific to the organization of school exams and contests and comprising two teleservices, Inscrinet and Publinet.
The Inscrinet teleservice allows remote enrolment in school exams and contests.
The Publinet teleservice allows, on the one hand, the publication of the names of the candidates admitted and, on the other hand, the access, for each candidate, to the details of his results, via an identifier and a password.

The personal data categories recorded are:
Applicant data:
identity: civility, birth name, common name, first name;
- date and place of birth;
nationality (for statistical development);
INE-BEA;
― registration number;
― socio-professional category (for statistical development);
contact information (posting address, e-mail address, telephone);
- category of candidate (school, individual, distance education);
- establishment of origin;
- class division;
- past review;
― selected options;
– disability (yes-no), for the needs of possible test facilities;
― notes obtained;
― result (admissed first group, if applicable, mention, eligible second group, adjourned first group, admitted second group, adjourned second group) ;
― skills of the common core of competence, for the only candidates for the national patent degree.
Data relating to legal officials of candidates:
― socio-professional category (for statistical development – optional collection).

The recipients or categories of recipients, internal to the Ministries of National Education, Higher Education and Research, authorized to carry out their respective missions to receive such data are:
– the authorized officers of the academic services, for the only candidates of the academy;
― the principal of the candidate's original school, for the only data relating to the students of his school;
- members of the jury;
– the authorized officers of the test centres, for the only candidates assigned to their test centre;
- the authorized officers of higher education institutions, for the purposes of the registration of eligible candidates;
- the authorized officials of the Departmental Statistical Service and academic statistical services;
– the authorized officers of the Qualification Research and Study Centre.
The recipients or categories of external recipients to the Ministries of National Education, Higher Education and Research, empowered to carry out their respective missions to receive such data are:
- as part of the language certification examination, the authorized staff of the certifying bodies for the calculation of the results and the issuance of the diplomas or certificates (name of birth, common name, date of birth and place of birth, address, sex, school code, notes to the tests, decision)
- the authorized agents of the Ministry of Agriculture for the only data relating to candidates of agricultural establishments who have passed their examination (name of birth, common name, first names, date of birth, INE-BEA, decision, establishment code);
― the press and private organizations having signed a licence to reuse the information in the lists of examination results, for the publication of the results of the candidates, subject to their prior agreement (name, first name, sex, date of birth, common in which, if applicable, the schooling is continued, entitled of the diploma, decision group [for the general bachelor's degree and the technological bachelor's degree], series or specialty, result [admis first class, if applicable
― the authorized officials of the local authorities participating in the public education service who apply for it, for the award of rewards to the winners of the various examinations, subject to the collection of the express and prior agreement of the candidate, or its legal officials, for the minor candidates (for the only candidates domiciled in the territory of the requesting territorial authority: identity, address, mention, if any, name and location of the establishment of origin). The data transmitted to the local authorities are deleted after the award is given to the winners of the various reviews.

The right of access and rectification provided by Articles 39 et seq. of the Act of 6 January 1978 referred to above conducts with the examination services and competitions of the rectorates or branches of the departmental services of national education.

Pursuant to the third paragraph of section 38 of the amended Act of 6 January 1978, the right of opposition does not apply to this treatment.
However, candidates have the right to object, on legitimate grounds, to the publication of the data concerning them via the Publinet service, in accordance with the first paragraph of Article 38.

The data set out in section 2 shall be retained for the duration of the review session, until the results of the next session are announced.

Any automated processing operation created by this Order shall be registered including the identification of the user, the date and time of the intervention in the said automated processing. This information is retained for a period of three months.

The implementation of the treatment referred to in Article 1 by the rectorates is subject to the pre-shipment of the National Commission on Informatics and Freedoms, pursuant to Article 27 of the Law of 6 January 1978, of a commitment to compliance with this Order which will include an annex specifying the academic measures taken to ensure the safety of the material and the confidentiality of the information.

The Order of 12 July 1995 establishing an automated processing of nominal information relating to the management of school examinations and examinations is repealed.

The Director General of School Education is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
