Vu la Organic Law No. 2001-692 of 1 August 2001 relating to financial laws, including Article 51;
Vu la Act No. 2005-5 of 5 January 2005 relating to the situation of the masters of private educational institutions under contract, including Article 3;
Vu le Decree No. 2005-1233 of 30 September 2005 relating to the additional pension plan for teachers and documentation referred to in sections L. 914-1 of the Education Code and L. 813-8 of the Rural Code, including section 19, as amended by Decree No. 2013-145 of 18 February 2013 ;
Considering the 28 July 2006 decision taken for the application of Decree No. 2005-1233 of 30 September 2005 relating to the additional pension plan for teachers and documentation referred to in sections L. 914-1 of the Education Code and L. 813-8 of the Rural Code, including sections 6 and 7,
Stop:
Section 1 of the above-mentioned 28 July 2006 Order is amended to read:
1° In the first paragraph, the words "from 1 September 2005 to 0.75%" are replaced by the words "to 1%";
2° In the second paragraph, the words "from that date to 0.75%" are replaced by the words "to 1%";
3° This article is supplemented by the following paragraphs:
"By derogation from the preceding paragraphs, the rate of employer contribution and the rate of pay contribution are set as follows:
« 1° Until December 31, 2013, at 0.80%;
« 2° For the year 2014, at 0.85 %;
« 3° For 2015, at 0.90%;
« 4° For 2016, at 0.95%. »
Section 6 of the above-mentioned Order of July 28, 2006 is amended as follows:
1° In the second paragraph, the words "in article 2 of the same decree" are replaced by the words "in article R. 914-97 of the Code of Education";
2° In the third and fifth paragraphs, the words "in Article 5 of the same decree" are replaced by the words "in Article R. 914-138 of the Code of Education";
3° In the fourth paragraph, the words "in Article 9 of the same Decree" are replaced by the words "in Article R. 914-142 of the Code of Education".
Section 7 of the 28 July 2006 Order is supplemented by a paragraph written as follows:
"For the establishment of the balance-of-charge ratio referred to in 3rd of the III of Article 19 of the amended September 30, 2005 Order referred to above, the actuary shall conduct its calculations on the basis of a renewal of the known contributory strength at the date of valuation of the plan's commitments, as follows:
« 1° For the year following the closure of the exercise under review, the number of contributors known at the date of assessment of the plan's commitments is adjusted by the measures of the schedules of the budget 139 "Private education of the first and the second degree" and 143 "Agricultural technical education" of the interdepartmental mission School education for staff in sections L. 914-1 of the Education Code and L. 813-8 of the Rural Code, as set out in the Schedule to the Financial Law of the year under review 5° of Article 51 of the Organic Law of August 1, 2001 referred to above.
« 2° For the following year, the number of contributors obtained at 1° is adjusted to take into account the extension in full year of the measures of the employment schemes selected at 1°;
« 3° For the following years, the number of contributors obtained at 2° is maintained. »
The provisions of Article 1 of the Decree of 28 July 2006 as amended by this Order come into force on the first day of the month following its publication.
The Minister of National Education, the Minister of Social Affairs and Health, the Minister of Agriculture, Agri-Food and Forestry, and the Minister Delegate to the Minister of Economy and Finance, in charge of the budget, are responsible, each with regard to the performance of this Order, to be published in the Official Journal of the French Republic.
