President of the Republic,
On the report of the Prime Minister and the Minister for Foreign Affairs,
Considering the Constitution, in particular articles 52 to 55;
Vu le Decree No. 53-192 of 14 March 1953 amended on the ratification and publication of international commitments undertaken by France,
Decrete:

Article 1


The agreement between the Government of the French Republic and the Government of the Republic of Mauritius on cooperation on sustainable development and energy control (two annexes), signed at Saint-Denis de La Réunion on 24 January 2011, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign Affairs are responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.

    A C C O R D


    BETWEEN THE GOVERNMENT OF THE FRENCH REPUBLIC AND THE GOVERNMENT OF THE MAURICE REPUBLIC RELATING TO A COOPERATION ON SUSTAINABLE DEVELOPMENT AND ENERGY MAEDIUM (SECOND APPENDIX)
    The Government of the French Republic
    and
    The Government of the Republic of Mauritius,
    The parties,
    RECALLING the need to promote sustainable development, in line with the vision of the Government of the Republic of Mauritius within the framework of the Mauritius Ile Durable (MID) programme, and in order to ensure, among other things, the provision of energy through a more efficient use of the latter through the increased use of renewable energy,
    REQUESTS to promote cooperation that will ensure the transfer of technology and know-how to Mauritian institutions in the field of energy efficiency, renewable energies, and sustainable constructions in connection with sustainable urban planning,
    AND REQUESTS IN ACCOUNT the initiatives and resources of the French Environment Fund (FFEM) up to 1 M EURO, available according to the agreement signed on 2 September 2009 between the Ministry of Energy and Public Utilities of the Republic of Mauritius (MEPU) and the French Development Agency (AFD) amended by having signed on 28 October 2010 between the Ministry of Finance and Economic Development of the Republic of Mauritius (MOF)
    Considering that the Ministry of Energy and Public Uses (MEPU) of the Republic of Mauritius is in charge of policies concerning the management of all energy, water and wastewater; that the main activity of the Ministry is, inter alia, to ensure the smooth running of policies related to the energy sector and to ensure the establishment of a legal structure conducive to the development of this sector; that the Central Electricity Board (CEB)
    Considering that the Agence de l'environnement et de la maîtrise de l'énergie (ADEME) de France is a commercial and industrial structure of a public nature, placed under the primary guardianship of the Ministry of Ecology, Sustainable Development, Transport and Housing; that the ADEME has a well-structured multidisciplinary technical team and quality expertise in the sustainable development sector; That the local experts of the ADEME MEETING work closely with all public and private actors in its fields of competence; that its mission is to encourage, supervise, coordinate, facilitate and undertake operations in order to protect the environment and to manage energy at best.
    Convince of the following:


    Article 1


    The parties agree, within the framework of their national legislation and in accordance with the implementation of a strategy for sustainable development in Mauritius, to promote and develop the cooperation and technical assistance that will materialize by a collaboration between ADEME (REUNION) and the Ministry of Energy and the public utility of the Government of the Republic of Mauritius in the areas of reducing energy consumption, sustainable energy efficiency


    Article 2


    In order to accelerate the implementation of the MID programme in Mauritius, the parties encourage cooperation between appropriate agencies and other entities, including non-limitative activities, on the following projects in accordance with specific agreements:
    (a) Establishment of an energy efficiency promotion unit (EEMO):
    ADEME and its experts located on the island of La Réunion and throughout France will help the MEPU to install and operationalize the unit for the promotion of energy efficiency or EEMO, in terms of technical capacity, assistance to the establishment of the communication unit (which will aim to raise awareness among the general public and professionals) and the execution of energy studies and the promotion of energy efficiency in the tertiary sectors
    (b) Conduct of energy audits in the public sector:
    ADEME and its experts, located on the island of La Réunion and throughout France, will assist experts from the MEPU and the Ministry of Public Infrastructure, the Department for National Development, Land Transport and Marine (MPI) by creating training programmes in the tertiary building sector (offices) to implement the energy efficiency plan and the construction of sustainable buildings in the public sector. A follow-up to actions already undertaken will be proposed.
    (c) Promotion of solar hot water in the housing thanks to individual or collective solar water heaters:
    ADEME, in close connection with the CSTB (Centre scientifique et technique du bâtiment) and the Chamber of Crafts and Crafts, will share the experiences gained in the island of La Réunion, in order to propose a framework for the quality of both solar water heaters and their installation according to the provisions established by the Government of the Republic of Mauritius and in order to also raise public awareness of the use of these products. ADEME and the partners identified above will provide technical assistance to the Mauritius Standards Bureau (MSB) for the adoption and application of standards based on those in Europe (EN) to promote standards for individual solar water heaters. In addition, ADEME and the CSTB will provide advice on the actions to be developed to put in place test facilities on solar water heaters and training sessions for installers.
    (d) Promotion of renewable energy in the electricity sector:
    ADEME, in a coordinated action with ARMINES Sophia Antipolis and EDF REUNION (if necessary), will help the MEPU to analyse the technical constraints regarding the connection to the network of renewable energy facilities (wind, photovoltaic in particular) and, if necessary, to take the measures to strengthen the electricity grid in order to accept a higher rate of intermittent energy sources in the country's electricity mix.
    (e) Training in sustainable construction and energy efficiency:
    ADEME and its partners such as the ADI (Association de développement de l'industrie à La Réunion), the CAUE (Conseil architecture, urbanisme et environnement) and Envirobât REUNION will organize the useful trainings to Mauritian professionals with technical visits to the island of La Réunion and by addressing topics such as: energy efficiency in the industry, the promotion of renewable energies in the field of construction, the
    (f) Support for the construction of exemplary green buildings:
    ADEME and its partners will provide support for the design and construction of two public buildings
    (g) Establishment of an Energy Observatory:
    ADEME and its partners such as PARER will support the establishment of an Energy Observatory in Mauritius.
    (h) Other activities:
    Activities on sustainable development other than those mentioned in this agreement may be subject to the mutual agreement of both parties. ADEME and its partners will be able to contribute to the organization of a seminar on exchanges between Mauritian actors and meeting on the various topics of energy control.


    Article 3


    In accordance with Article 2, technical assistance will be organized and implemented in accordance with the action plan and the forecast schedule set out in Annex B. The action plan may be reviewed by the parties every six months to include all new mutually agreed topics of cooperation.


    Article 4


    In order to ensure the proper implementation of the agreement, ADEME may designate other organizations or entities with recognized expertise in the sustainable development sector. These organizations will include those listed in Appendix A.


    Article 5


    Parties will meet regularly to assess the implementation of the agreement.


    Article 6


    The agreement does not affect the rights and obligations of parties resulting from bilateral or multilateral agreements otherwise concluded.


    Article 7


    Any dispute over the interpretation of the provisions of the agreement shall be the subject of consultation between the parties.


    Article 8


    This Agreement shall enter into force on the day it is signed. It is concluded for a period of three years and may be extended by mutual agreement.
    It may be denounced by either of the parties with a three-month notice by diplomatic means. The denunciation shall not challenge the rights and obligations of the parties resulting from the implementation of this Agreement unless the parties agree otherwise.
    In faith, the representatives of the Parties, duly authorized to do so, have signed this Agreement.
