Order of 17 December 2012 approving the Railway Certification Agency (CERTIFER) for tanks intended for the rail transport of dangerous goods

Minister of Ecology, Sustainable Development and Energy,
In view of the agreement reached on 3 June 1999 on international rail transport, the so-called COTIF Convention, in particular its Appendix C on the Regulations concerning the International Carriage of Dangerous Goods by Rail, says "RID";
Considering the transport code, including its article L. 1252-1;
Having regard to the amended decision of 29 May 2009 on the transport of dangerous goods by land, said "TDG Order", in particular Articles 15 and 20;
Considering the application by the Railway Certification Agency (CERTIFER), housed 1, place de Boussu, BP 70141, 59416 Anzin, dated 3 October 2012;
In the light of the opinion of the Interdepartmental Commission on the Transport of Dangerous Goods dated 10 October 2012,
Stop it!

Article 1


The subsidiaries, establishments, agencies and branches of the Railway Certification Agency (CERTIFER) that may justify the accreditation referred to in 1.6 of section 20 of the above-mentioned TDG Order shall be granted the approvals set out in sections 2 to 9 of this Order.

Article 2


CERTIFER is an approved body to perform the inspections, tests and verifications under 6.8.2.4.5 and 6.8.3.4.16 of the aforementioned RID, on tanks of the tank cars, removable tanks and battery cars.

Article 3


To carry out the operations resulting from this approval, CERTIFER shall adhere to the procedures established in this regard by its care and forwarded to the Minister for Land Transport of Dangerous Goods.

Article 4


CERTIFER is required to observe procedures relating to the application of regulatory provisions, which are published in the Official Bulletin or notified to it by the Minister for Land Transport of Dangerous Goods.

Article 5


The provisions of this Order come into force on 1 January 2013.
This approval is valid until December 31, 2017.
However, it may be restricted, suspended or withdrawn in the event of a serious breach of the obligations established by the aforementioned RID, the above-mentioned TMD Order or this Order.

Article 6


The Director General of Risk Prevention is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
