Decree No. 2012-1487 of 27 December 2012 on the duration of insurance required to receive a full-rate pension and the duration of the services and bonuses necessary to obtain the maximum percentage of a civil or military pension applicable to insured persons born in 1956

The public concerned: the insured persons born in 1956 of the general regime, the aligned regimes (agricultural wages, craftsmen, traders), non-farm workers, liberal professions, lawyers, the state public service regime, the pension schemes of territorial and hospital officials and the workers of the state and the social regime of ministers of worship.
Subject: insurance period required for insured persons born in 1956 to receive a full-rate pension.
Entry into force: the text comes into force on the day after its publication.
Notice: The purpose of the text is to set 166 quarters of the required insurance period for insured persons born in 1956 to benefit from their undetected pension (called "full rate"). In accordance with provisions of Article 5 of Act No. 2003-775 of 21 August 2003 reform of pensions, as amended byArticle 17 of Act No. 2010-1330 of 9 November 2010 With pension reform, this number of quarters is set to keep the report recorded in 2003 constant between, on the one hand, the duration of insurance required or the duration of the services and bonuses required to receive a full-rate pension and, on the other hand, the average retirement period.

Having regard to the Civil and Military Pension Code, including articles L. 24 and L. 25;
In view of the rural and maritime fishing code, including articles L. 732-18, L. 732-25 and L. 742-3;
Vu le Social Security Codeincluding articles L. 161-17-2 and L. 351-1;
Vu la Act No. 2003-775 of 21 August 2003 amended to reform pensions, including article 5 in its drafting Act No. 2010-1330 of 9 November 2010 reforming pensions;
Considering the advice of the Board of Directors of the National Health Insurance Fund for Employees dated 23 October 2012;
Considering the opinion of the Central Board of Directors of the Agricultural Social Mutuality of 24 October 2012;
Having regard to the advice of the Board of Directors of the National Old Age Insurance Fund of Employees dated 13 November 2012;
In light of the Board's technical advice of 25 September 2012,
Decrete:

The duration of insurance required to receive a full-rate pension and the duration of the services and bonuses required to obtain the maximum percentage of a civil or military pension is 166 quarters for insured persons born in 1956.

The Minister of Economy and Finance, the Minister of Social Affairs and Health, the Minister of Agriculture, Agri-Food and Forestry, the Minister of State Reform, Decentralization and Public Service, and the Minister Delegate to the Minister of Economy and Finance, responsible for the budget, are responsible, each with respect to it, for the execution of this Decree, which will be published in the French Republic.
