Purpose: An exceptional end-of-year assistance to the recipients of the Mayotte Department's RSA.
Entry into force: the text comes into force on the day after its publication.
Explanatory Notice: The Government has decided to allocate exceptional year-end assistance to the recipients of the Mayotte Department's RSA. This assistance is allocated to the recipients of the RSA who are entitled to this allowance for the month of November 2012 or, if not, for the month of December 2012, provided that the amount due under these periods is not zero and provided that the resources of the home do not exceed the lump sum mentioned in the 2nd of Article L. 262-2 of the Code of Social Action and Families (fixed to January 1, 2011). Only one help is due by home. The amount of this exceptional assistance is set at €152.45 for one person alone. It is increased when the home includes several people, depending on its composition. The allowance will be paid by the Family Allowance Fund of La Réunion, competent for the Department of Mayotte.

Considering the code of social action and families, including article L. 262-24;
Vu le Social Security Code ;
Vu la Act No. 2008-1249 of 1 December 2008 generalizing active solidarity income and reforming integration policies;
See?Order No. 2011-1641 of 24 November 2011 extending and adapting active solidarity income to the Department of Mayotte;
Considering the advice of the Board of Directors of the National Family Allowance Fund dated 4 December 2012;
Considering the referral of Mayotte General Council dated 26 November 2012,
Decrete:
An exceptional assistance is provided to allocataries of the active solidarity income of the Department of Mayotte who are entitled to this allowance for the month of November 2012 or, if not, for the month of December 2012 provided that the amount due under these periods is not null and provided that the resources of the household, valued according to the provisions made under articles L. 262-3 and L. 542-6 of the code of social action and families, 2
Only one help is due by home.
The amount of assistance is equal to €38.11 for a single person, increased by 50% when the home consists of two persons and 30% for each additional person present at the home, provided that these persons are the spouse, the partner bound by a civil pact of solidarity or the concubin of the person concerned or are at his or her expense.
When the home has more than three children or persons under twenty-five years of age, with the exception of the spouse, the partner bound by a civil covenant of solidarity or the concubine of the person concerned, the increase to which each child or person is entitled is set at 10% from the fourth child or the fourth person.
The exceptional aids governed by this decree are the responsibility of the State. They are paid by the debtor agency of the benefit referred to in section 1.
Any undue payment of exceptional assistance granted under this decree shall be recovered on behalf of the State by the agency responsible for the service of the State. Debt may be remitted or reduced by the organization, in the event of good faith or precariousness of the debtor's situation, unless that debt is a result of fraudulent manoeuvre or false declaration.
The Minister of Economy and Finance, the Minister of Social Affairs and Health, the Minister of Overseas, the Minister Delegate to the Minister of Economy and Finance, responsible for the budget, and the Minister Delegate to the Minister of Social Affairs and Health, responsible for persons with disabilities and the fight against exclusion, are responsible, each with respect to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
