Order of 20 April 2012 setting the conditions for the establishment, issuance and validity of the driver's licence

Audiences concerned: pedestrians and drivers of vehicles, traffic police authorities, road managers, driver's license candidates and driver's license holders.
Subject: conditions for the establishment, issuance and validity of the driver's licence, pursuant to Decree No. 2011-1475 of 9 November 2011 amended by introducing various regulatory measures to transpose Directive 2006/126/EC on the driver's licence.
Entry into force: the text comes into force as of January 19, 2013.
Notice: This Order sets out the new conditions for the validity of the driving titles and their renewal and issuance of the various categories of driving permits in accordance with the provisions of the above-mentioned Decree, which is the main objective of contributing to the improvement of road safety, providing minimum criteria for the examination of the driver's licence to be passed by the candidates, as well as for their level of training. Its major innovations are: taking into account the creation of the category AM in the application for a driver's license and for its issuance, the introduction of two administrative validity periods of the title: five or fifteen years according to the category, the introduction of a new model of driver's licenses, the identification of driving equivalences of each category, the uniformization of the time frames of presentation between two examinations: one day in case of success, one week in case

Application for a driver's licence

I. ― The French driver's licence is issued either after a successful examination, or following a training for the categories AM and A by progressive access, or by the conversion of the military driving patent, or after the exchange of a driver's licence issued by a State other than France, under the conditions defined by the Minister's orders in charge of road safety.
Its issuance is subject to at least one presentation in person of the applicant before a competent State officer.
II. - Any person wishing to obtain a driver's license sections R. 211-1, R. 221-1, R. 221-2 and D. 221-3 of the road code must apply to the prefect of the department of his or her normal residence or to the prefect of the department in which the examination will be tested if it is in a department other than that of his or her normal residence.
This application cannot be made before the age of 16, except for the category AM for which the age is 14 years old. For persons born after 31 December 1987, the application of the latter category comes after obtaining the road safety patent provided for in article R. 211-1 of the aforementioned code.
The request for a minor must be made by the person or institution invested with parental authority or custody. The emancipated minor must prove it.
This application, made on the regulatory form "application for a driver's licence by registration for the examination or certification of a training", sets out the name, first name(s), nationality, place of residence, place and date of birth of the applicant. With the exception of the only AM category, the application must include the statement on the honour that the candidate is not affected by a disability of one or more members or by a condition of which he or she is aware, likely to be incompatible with the obtaining or maintenance of the driver's licence, or to give rise to the issuance of a limited validity driving licence.
With the exception of the only AM category, the applicant must also indicate whether he is a civil or military disability pensioner.
In addition, it specifies the category or categories of permits requested.
A candidate subject to a medical check under sections R. 226-1 to R. 226-4 of the road code and who has been recognized as fit addresses his application for a driver's licence with the regulatory record.
III. - The regulatory record includes:
A. ― The justification for the candidate's civil status. Foreign candidates must be in a regular situation with respect to the legislation and regulations on the residence of foreigners in the national territory. They must also prove the existence of their normal residence or their student status for a period of at least six months in the national territory.
B. ― Where applicable, the above-mentioned medical notice.
C. ― His photograph, meeting the NFZ 12010 norm or the official technical standards in force in one of the Member States of the European Union or in a State belonging to the European Economic Area.
D. ― For the first obtaining of the AM category, in respect of persons born after December 31, 1987, the original of the SRO or its duplicate accompanied by a declaration of loss or flight, or the monitoring certificate of the practical training of the road safety patent accompanied by the first or second level road safety certificate or road safety certificate.
E. ― The practical training monitoring certificate provided for inArticle D. 221-3 of the Road Code for persons in the A2 category for at least two years.
F. ― For candidates aged 16 to 18 years old, a copy of the census certificate or individual certificate of participation in the Defence and Citizenship Day (JDC, formerly JAPD) or the individual certificate of exemption.
For candidates who are 18 years of age who are 25 years of age who are not completed, a copy of the individual certificate of participation in the JDC or the provisional certificate "pending on convocation" to the JDC or the individual certificate of exemption.
As of 25 years, none of the above-mentioned supporting documentation is required.
Candidates in the AM category, between 14 and 16 years old, are exempted from the presentation of these evidence.
G. ― For candidates with a French driver's licence or issued by a Member State of the European Union or the European Economic Area for less than five years, copy of their title.
H. ∙ For candidates in category C of the driver's licence, a copy of the driver's licence in category B and, possibly, a copy of the certificate recognizing the completion of a driver's training by road, in accordance with the provisions of the Decree No. 2007-1340 of 11 September 2007 amended on the initial qualification and continuing training of drivers of certain vehicles assigned to road freight transport.
I. ― For candidates in category CE, a copy of the driver's licence in category C and, possibly, a copy of the certificate recognizing the completion of a driver's training by road, in accordance with the provisions of Decree No. 2007-1340 of 11 September 2007 amended on the initial qualification and continuing training of drivers of certain vehicles assigned to road freight transport.
J. ― For candidates in category D1, a copy of the driver's licence in category B and, possibly, a copy of the certificate recognizing the completion of a passenger transport driver training, in accordance with the provisions of Decree No. 2007-1340 of 11 September 2007 modified for the initial qualification and continuing training of drivers of certain vehicles for passenger transport.
K. ― For candidates in category D1E, the copy, driver's licence in category D1 and, possibly, the copy of the certificate recognizing the completion of a passenger transport training, in accordance with the provisions of the Decree No. 2007-1340 of 11 September 2007 modified for the initial qualification and continuing training of drivers of certain vehicles for passenger transport.
L. ― For Class D candidates, a copy of the Class B driver's licence and, possibly, a copy of the commitment certificate to follow the initial qualification or copy of the certificate recognizing the completion of a passenger transport driver training, in accordance with the provisions of the Decree No. 2007-1340 of 11 September 2007 modified for the initial qualification and continuing training of drivers of certain vehicles for passenger transport.
M. ― For candidates in category DE, a copy of the Class D driver's licence and, possibly, a copy of the commitment certificate to follow the initial qualification or copy of the certificate recognizing the completion of a passenger transport driver training, in accordance with the provisions of the Decree No. 2007-1340 of 11 September 2007 modified for the initial qualification and continuing training of drivers of certain vehicles for passenger transport.
N. ― For candidates in category D who have not attained the age of 24 but have the age-related provisions authorizing the conduct of these vehicles in the Decree No. 2007-1340 of 11 September 2007 modified for the initial qualification and continuous training of drivers of certain vehicles assigned to the passenger transport, the copy of the commitment certificate to follow the initial qualification or copy of the certificate recognizing the completion of a passenger transport driver training.
O. ∙ For candidates in category BE or C1, copy of the Class B driver's licence.
P. ∙ For category C1E candidates, a copy of the Class C1 driver's licence.



Technical reviews

I. ― Candidates to the driver's licence in any class, except for the category AM treated in I.4 below and category A obtained by provisions of Article D.221-3 of the Highway Code shall pass before a designated expert in accordance with the third paragraph of that same article of road code a technical review, under the conditions provided for in the same article, including:
A. ― A general theoretical test of eligibility relating to the knowledge of regulations concerning the movement and conduct of a vehicle as well as the good conduct of the driver.
In this regard, the vigilance and attitudes towards other road users, the perception, assessment and decision-making functions, the modification of the behaviours of the driver related to the effects of alcohol, drugs and drugs, emotional states and fatigue, the awareness of the risks with regard to the surrounding atmospheric conditions and the conditions of carriage are concerned.
The specific risks associated with the inexperience of other road users, the most vulnerable users, as well as those related to the specific characteristics of certain vehicle categories and the different visibility conditions of their drivers are also addressed.
Finally, applicants must be aware of the precautions to be taken by leaving the vehicle, the safety factors related to the loading of the vehicle and the persons transported, the rules of environmentally sound driving (sound level, fuel consumption and greenhouse gas emissions) and the regulations relating to the insurance obligation and administrative documents related to the use of the vehicle.
B. ― A practical intake test to control the knowledge, skills and behaviour of the candidates, necessary to operate independently and safely, taking into account the specific characteristics of each vehicle.
The objective of this test is to evaluate in any candidate:
compliance with the provisions of road code ;
- its knowledge of the category of the vehicle concerned and its ability to detect the most important technical defects;
― its ability to properly install in the driving station and to make the necessary adjustments according to the vehicle category and to ensure the safety of its passengers and cargo;
- its control and handling of the vehicle not to create dangerous situations;
- its ability to ensure its own safety and that of other users on any kind of road and in all circumstances, to perceive and anticipate the dangers caused by traffic and to act appropriately;
– its degree of autonomy in the realization of a journey;
– its ability to drive in a manner that respects the environment and to adopt a courteous and responsive behaviour towards other users, especially the most vulnerable.
During the practical test, if the candidate has not been subjected to a medical check, the expert conducts a test of the view to detect a possible impairment.
Only candidates who have obtained a favourable result for the general theoretical test set out in paragraph I-A can present themselves to the practical admission test described above.
By exception to the above principle, for category A2 holders for at least two years, the practical class A test is replaced by a seven-hour training, ensuring that they have a good mastery of the category A motorcycle. This training is provided by an accredited institution or association under theArticle L. 213-1 or L. 213-7 of the road code.
C. ― The practical test may include an off-road test (HC) and a running test (IRC). The off-road test is also commonly referred to as "plate". Only candidates who have obtained a favourable result for the off-road test can pass the practical test in circulation.
Subject to compliance with the other provisions of this Article 2, candidates who have obtained a favourable result for the off-road test of categories C1, C, CE, C1E, D1, D, DE, D1E shall retain the benefit for three tests in circulation and provided that a maximum period of one year has not elapsed since the completion of the off-road test. This period has been extended to a maximum of three years since success in the off-road test for categories A1, A2 and A of the driver's licence.
D. ― The SRO is the AM category of the driver's licence as defined in Directive 2006/126/EC of the European Parliament and the Council of 20 December 2006 on the driver's licence.
The obtaining of the SRO intervenes under the conditions specified in theR. 211-1 road code.
II. General administrative conditions.
A. ― Ages of presentation to the theoretical test.
The minimum age required for this test is:
― sixteen years for A1 and B1 driver's license candidates;
― sixteen years for candidates for the category B driver's licence following training according to the formula of early learning of driving;
seventeen years for other category B driver's licence candidates or category A2 driver's licence candidates.
B. ― Conditions of eligibility.
Candidates who have passed the general theoretical test are declared eligible.
The general theoretical test is declared successful when the candidate obtains a number of answers just above or equal to 35 out of a total of forty questions, numbered from 1 to 40 for each series. Candidates who have obtained a favourable result of the general theoretical test shall retain the benefit of their eligibility for five practical tests per class, provided that a maximum period of three years has not elapsed since obtaining this eligibility; a practical test is recorded at each failure to the off-road test of the categories concerned and at each failure to the test in circulation.
The benefit of eligibility remains acquired in the event of change:
- either training;
- a category of driver's license.
Drivers who meet the conditions set out in thearticle R. 224-20 of the road code must satisfy an examination with only the general theoretical test defined in paragraph I-A above.
Candidates with a French driver's licence or a licence issued by a Member State of the European Union or the European Economic Area are exempted from the general theoretical test provided that a maximum of five years has not elapsed since obtaining the last category. This provision is not valid for the AM and A categories obtained in progressive access.
The general theoretical test is also exempted from the examination of candidates for a driver's licence of categories A1, A2 or B1 in a supervised driving situation, provided that a maximum of three years has not elapsed since the success of the general theoretical test.
C. ― Timeliness for submission.
In the event of success in the general theoretical test or in a practical test of the categories of the driver's licence, the candidate may not be in the next test within one day (date to date).
In the event of failure to the general theoretical test or to a practical test of the categories of the driver's licence, the candidate may not be represented within seven days (date to date).
D. ― Coach.
A representative of the driving and road safety education institution or, in the case of a free candidate, a person who holds the driving licence in the category of the vehicle being presented and valid is required to attend the practical test.
When it is a representative of the educational institution of conduct, it must be linked to the educational institution that benefits from the examination places.
This link must be of a professional nature, whether it is a work contract, an internship agreement or any legal link that has a relationship with the operation of the training institution for road driving and road safety or the company.
Verification of the quality of the attendant does not constitute a screening by the expert.
Role of the attendant:
The attendant must contribute to the proper conduct of the tests.
He accompanies the candidates and establishes their order of passage.
In the event that the time allocated to the establishment would not allow the examination of all candidates (panne, weather...), it determines the candidate(s) that it is not possible to examine.
The attendant is present in the vicinity of the candidate during the course of the tests and during the announcement of the result, if applicable.
He demonstrates total neutrality in the performance of the candidate and the expert's decisions.
The local department responsible for the organization of the driver's license reviews ensures that this neutrality is maintained and takes all appropriate measures, under the examination police, to stop any breach of this principle.
Legal role:
In the sense of Act No. 85-677 of 5 July 1985 For the improvement of the situation of traffic accident victims and the acceleration of compensation procedures, the training establishment of driving and road safety is deemed to have entrusted the custody of its vehicle of examination to that attendant.
If applicable, the attendant fills the friendly observation.
Educational role:
The main objective of the accompanying person's presence during the tests is to establish a pedagogical link with the training of candidates.
In case of failure, this presence strengthens the trainer's ability to fix the work axes.
The attendant and the expert do not express any disagreement of a pedagogical nature in the presence of the candidates.
E. ― Persons authorized to attend the trials.
In addition to the expert and the accompanying person, may attend the examinations after informing the candidate evaluated:
an inspector of the driver's licence and road safety, in the context of the initial or ongoing training of experts;
- a road education delegate, within the framework of the hierarchical control of experts or their initial or ongoing training;
- any other person, designated by the Minister in charge of road safety or by the local department in charge of the organization of the driver's licence examinations and for which the examination is of a professional interest;
― a student preparing the patent for the exercise of the teaching profession of driving and road safety (BEPECASER), on presentation of his learning booklet.
These persons authorized to attend the tests do not intervene in any way in the course of the trial or in the determination of its outcome.
F. ― Presentation of candidates.
Generally speaking, the training institution for road driving and road safety is responsible for the presentation of candidates to the driver's licence inspector.
In the case of individual candidates, it is up to them to register with the local department in charge of the organization of the driver's license examinations.
The order of passage of the candidates presented by the same educational institution of driving and road safety is the choice of the teacher or representative of the school of conduct.
The organisation and distribution of the tests outside and in circulation, when several establishments are convened at the same time, are subject to the expert's choice.
G. ― Miscellaneous prohibitions.
Smoking is strictly prohibited inside the test vehicle. This prohibition is also valid in its immediate vicinity during off-road trials. Mobile phones must be switched off or placed in a "silver" position.
With the exclusion of data from chronotachyographs or geolocation devices equipping vehicles of the heavy group, which cannot be neutralized, any recording of the examination is prohibited.
III. ― Provisions common to all examination vehicles.
The practical tests of the driver's license examinations are passed with examination vehicles whose technical characteristics are defined by decrees of the Minister for Road Safety.
Vehicles used for examinations must be subject to an insurance policy covering without limit the damage that may result from accidents caused to third parties as well as to persons within the vehicle, in the course of the practical tests.
The insurance certificate is only required for individual candidates. It's presented to the expert.
It must be an original document obligatory to:
– the social reason of the insurance company;
― the name and name of the candidate receiving the insurance policy;
- the registration number of the covered vehicle and its trailer, if applicable;
the date of the examination, with reference to the individual convocation of the candidate;
― the type of insurance (covering all damages that may be caused to third parties during the examination);
– the stamp and signature of the representative of the insurance company.
Examination vehicles must be clean and in perfect working condition. If the expert finds a vehicle failure, he informs the attendant, outside the presence of the candidates, of the impossibility of conducting or continuing the examination in the condition.
If the expert finds that the vehicle does not meet any of the technical characteristics defined by the above-mentioned orders or does not have any of the specific equipment made mandatory by these same orders, he shall inform the attendant, outside the presence of the candidates, of the impossibility of conducting the examination in the condition.
In all cases, the attendant may correct the failure or provide a replacement vehicle, provided that the time required for these operations is deducted from the time provided to the establishment for the current review session.
The double accelerator control must be neutralized at the beginning of the test. In case of necessity and if the equipment permits, the expert may use it.
Driving aid devices equipped with examination vehicles may be put into action on the initiative of the candidate.
However, the expert may request deactivation, if the equipment permits, for the purposes of the evaluation.
IV. ― Practical methods specific to each licence category.
Each category of driver's license is subject to specific practical terms defined by decrees of the Minister for Road Safety.
The holder of Class B who wishes to drive a package with a maximum permissible weight of more than 3,500 kg and not exceeding 4,250 kg, must justify having completed a seven-hour training to ensure his or her ability to safely drive this type of vehicle, the terms of which are provided by order of the Minister for Road Safety.
V. The weather.
Where the weather conditions are likely to jeopardize the safety of users and public service officers of the driver's licence examinations or to prevent the normal course of testing, the examinations are cancelled.
The cancellation decision may be taken by the prefect or by the expert's initiative in relation to the specific local conditions, after the advice of the attendant.
Examinations may be cancelled for all or part of the department or session.



Restrictive conditions of use

I. ― Vehicle with automatic clutch or automatic speed change.
A. ― Candidates to the driver's license can pass the practical test on a vehicle with automatic clutch or automatic speed change.
B. ― If the examination is passed on a vehicle with an automatic clutch, after having satisfied the test, the candidates are granted a valid driving licence only for the driving of vehicles with an automatic clutch.
Candidates are exempted from this restriction from the driver's licence categories BE, C1E, CE, D1E and DE if they are respectively holders of the categories of driver's licence B, C1, C, D1 and D valid for the conduct of vehicles with manual clutch.
C. ― If the examination has passed on a vehicle with a change of automatic speeds, after having satisfied the test the candidates are issued a valid driving licence only for the driving of vehicles with a change of automatic speeds.
Candidates are exempted from this restriction from the driver's licence categories BE, C1E, CE, D1E and DE if they are respectively holders of the categories of driver's licence B, C1, C, D1 and D valid for the conduct of vehicles equipped with a manual velocity change.
D. ― The person who wishes to remove these restrictions must regulate his or her track driving licence for vehicles of categories A1, A2 and A and in circulation for vehicles of other categories. The expert verifies, in the first case, that the mechanical clutch is effectively used by the candidate and, in the second case, that the non-automatic speed change is effectively used by the candidate and mentions it in the notice to the prefect.
II. ― Candidates to the driver's licence specially designed vehicles to take into account their physical disability pass the examination defined in section 2-IV above. Prerequisitely tested, the expert verifies that the proposed vehicle layouts following the medical check defined in R. 226-1 to R. 226-4 are suitable.
During the test, the expert verifies that the modifications of the vehicle he defined are used effectively and mentions them in the prefect notice.
A driver who holds the driver's licence from one or more of the following categories: A1, A2, A, B1, B, BE, C, D, CE, DE, C1, D1, C1E, D1E, and subsequently reaches the issuance of the driver's licence for a condition that would make it necessary to fit the vehicle to take into account its physical handicap must regulate its driver's licence.
The expert verifies that the modifications of the proposed vehicle have the result of the medical check provided for in R. 226-1 to R. 226-4 are adapted.
During a driving exercise, the expert verifies that the modifications of the vehicle that he has defined are used effectively and mentions them in the prefect notice.
The person who wishes to remove these restrictions must once again regulate the driver's licence. The expert verifies that the orders are used effectively by the candidate and mentions it in the prefect notice.
III. - Codified restrictive records are included on the licence held by the interested party.

At the conclusion of the technical examination provided for in Article 2 above, the candidate's file is forwarded to the prefect with the expert's opinion on the suitability of the candidate's conduct.
The expert may ask the prefect that the candidate conducts a medical check if, during the practical test, he felt that the candidate's condition seemed to be incompatible with the driving of motor vehicles.
In this case:
― if the test of the practical test is unfavourable, the prefect sends a medical notice form to the candidate, stating that before any new practical test he must pass a medical check under the conditions defined in sections R. 226-1 to R. 226-4 of the road code;
― if the practical test is favourable, the prefect informs the candidate that the issuance of the driver's licence will take place after favourable notice following a medical examination of suitability for the conduct performed under the conditions defined in sections R. 226-1 to R. 226-4 of the road code.



Cases of invalidity

The examinations given by a candidate in the following cases are considered null:
I. - During the period in which the candidate is deprived of the right to conduct by a decision to cancel or suspend a previous licence or to suspend a licence or class of a licence or to prohibit the application of a licence. On the other hand, drivers whose driver's license has lost its validity for zero-point balance may, during the invalidation period, present themselves to the driver's licence tests;
II. – On false identification indications, substitution or attempted substitution of persons under examination;
III. – On false statements when the conversion of a military driving licence to a civil driving licence of the same category has already been obtained or is pending to obtain;
IV. - On false statements when the exchange of a foreign driver's licence against a French driver's licence in the same category has already been obtained or is pending.
Accordingly, any driver's licence issued in any of the above-mentioned or fraudulently obtained cases must be immediately withdrawn without prejudice to the criminal proceedings of the applicant.

The issuance of the driver's licence may be subject to medical control of the fitness to conduct under the conditions set out in sections R. 226-1 to R. 226-4 of the road code and their enforcement order jointly taken by the Minister in charge of road safety and the Minister of Employment, Labour and Health.

I. - Subject to the provisions of II below, the territorially competent prefect shall issue the driver's licence on favourable advice from an expert or in accordance with provisions of articles D. 221-3 and R. 211-1 of the road code.
The title issued is in accordance with the European Union model set out in Annex No. 3 to this Order.
II. - For candidates in categories D and DE of the driver's licence who have not reached the age of 24 but have the age-related provisions authorizing the conduct of these vehicles in the Decree No. 2007-1340 of 11 September 2007 Amended for the initial qualification and continuing training of drivers of certain vehicles assigned to the carriage of goods or passengers, the territorially competent prefect shall issue the driver's licence on the expert's favourable opinion and upon presentation of the original driver's qualification of certain vehicles assigned to the transport of passengers candidates to category D or DE.
III. ― Classes BE, C, C1, C1E, CE, D, D1, D1E, DE of the driver's licence are granted for a period of time that varies depending on the age of drivers or possible restrictions. At the expiry of this period, their validity may be extended by the territorially competent prefect, after medical fitness notices issued under the conditions defined in sections R. 226-1 to R. 226-4 of the road code.
IV. ― Additional or restrictive references must be indicated on the coded driving title. The codes used and their meaning are attached in Annex 1.
V. ― Any holder of a national driver's licence may apply for the issuance of an international driver's licence.
The international driver's licence allows the conduct of the same categories of vehicles as those of the national licence. It is only applicable abroad and must be accompanied by the national permit. It has a validity of three years.
The application for an international driving licence must be based on the appropriate CERFA form duly informed and signed and filed or addressed to the prefect of the department in which the applicant's domicile is located along with the following documents:
• photocopying of the French driver's license in validity;
- photocopying of the identity document for French nationals or the European Union or the European Economic Area or the residence permit or long-term visa, for applicants for other nationals in the process of validity;
– two recent photographs meeting the NFZ 12010 standard;
an enclosed envelope recommended with acknowledgement of receipt in the applicant's name and address if the request is made by correspondence.

I. ― The driver's licences issued before January 19, 2013 remain valid for the conduct of the categories of vehicles to which they relate, no later than January 19, 2033. The possible equivalences to which these permits are entitled in accordance with Appendix 2 to this Order are recognized in French territory, even if they are not mentioned in these titles.
It will be replaced by January 19, 2033, under the conditions established by a Minister of Road Safety order, to the driver's licences issued before January 19, 2013 a new driver's licence model, attached as Appendix 3.
In addition, the renewal of the title issued under a model prior to 19 January 2013 is mandatory against a driver's licence as set out in Annex 3 to this Order, in the following cases:
- loss or flight;
- deterioration of the original;
- extension of category;
- change of marital status;
– suspension or cancellation of a class by the prefect for a medical reason.
II. ∙ Renewal of securities issued after January 19, 2013 occurs without prejudice to provisions of Article R. 221-1 of the road code, on the occasion of each modification of the information on the securities or at the end of their validity period, and in any event every fifteen years from the date of issue.
III. ― Renewal is made on the application form for the renewal of the driver's licence. The list of documents to be produced in support of the renewal application is set by circular.
Where the extension of the validity of one or more categories BE, C, C1, C1E, CE, D, D1, D1E, DE, has not been requested or obtained by their licensee, the conduct is issued, upon request, unless otherwise indicated, for a period of fifteen years. In other cases, the validity of the title is five years.
IV. – Only persons with a category C, C1, C1E, CE, D, D1, D1E, DE that are valid may obtain, in the event of loss, theft or deterioration of their title, a duplicate whose validity expires on the same date as the replaced title. The list of parts to be produced in support of the duplicate application is fixed by circular.
V. ― By application of the provisions of Article 6 of Decree No. 75-15 of 13 January 1975 and by derogation from provisions of Article R. 221-4 of the Highway Codethe possession of the Class B driver ' s licence issued prior to 20 January 1975 authorizes the licensee to conduct vehicles for the carriage of persons, in addition to the driver ' s seat, with a maximum of eight seating places and with a total permissible load exceeding 3,500 kg.
VI. ― On the new title issued are deferred the categories obtained and their validity date, if any, the codes provided for in section 7-IV above.

I. ― The permits issued by the French administrative services of the territories of the former French Union and the former protectorate countries as well as by the overseas and New Caledonia communities are valid, for the category or categories of vehicles to which they relate, throughout the metropolitan territory, overseas departments, Mayotte and Saint-Pierre-et-Miquelon.
A. ― To be recognized, these permits must meet the following conditions:
1° Being valid;
2° Not having been issued in exchange for a driver's licence of a State or territory not belonging to the European Union or to the European Economic Area, with which France has not entered into a reciprocity agreement. They are nevertheless recognized until the expiration of one year after the acquisition of normal residence in France. The conditions for their recognition and exchange are those set out in the decision on driver's licences issued by States not belonging to the European Union or to the European Economic Area.
B. ∙ In addition, their licensees must:
1° Having reached the minimum age required by the articles R. 221-5 and R. 221-6 of the road code, according to the category(s) of the inmate driving licence;
2° Observe, where applicable, the requirements, by a special mention or codification, for the validity of the driver's license to the port of certain appliances or certain modifications of the vehicle to take into account a disability;
3° Do not be subject to the territory that issued the driver's licence for a suspension, withdrawal or cancellation of the right to conduct;
4° Must not have been the subject in France, prior to obtaining a driver's licence, a cancellation or invalidation measure, pursuant to the provisions of the Criminal code or road code.
II. ― Licences quoted in I of this article may be exchanged for a permit issued by the competent authority of the State, the class or class.
A. ― For such exchange to be possible, the conditions referred to in A and B of I must be met.
B. ― Exchange may be requested by the title holder.
In this case, it must meet a medical control of fitness to conduct, in the event that such control is required by the regulations in force.
C. ∙ The exchange of title is mandatory in the following cases:
1° If the driver has committed, on the metropolitan territory, in an overseas department, in Mayotte or Saint-Pierre-et-Miquelon, an offence that has resulted in a measure of suspension, withdrawal, cancellation of the right to drive or withdrawal of points;
2° If the driver has obtained by examination in the same territories a new category of the driver's licence;
3° If the validity of the title, related to the obligation of a medical check or the regulation of a tax to the community that issued it, is expired.
D. ― The measures cited in the II-C are recorded in the European driver's license file and the national file; it shall be taken into account when publishing the title issued by the competent authority of the State.
III. ― During the issuance of the driver's licence referred to in II-D, the original driver's licence shall be withdrawn to the interested party and referred to the authorities who issued it, specifying the reasons for the exchange process.
IV. ∙ In the event of doubt about the authenticity of the driver's licence presented to the exchange:
A. ― The prefect consults, for permits issued by the French administrative services of the territories of the former French Union and the former protectorate countries, the national file and, for other permits, retains the conduct title presented to the exchange and seizes the competent services of the community having issued it. In the absence of a response within three months of the referral of the issuing authorities, the exchange of the permit may not take place.
B. ― When the prefect retains the conduct, a secure deposit certificate is issued to the licensee. It is valid for two months and renewable once. It is withdrawn after the exchange procedure.
C. ― No duplicate of this certificate will be issued in the event of loss or flight.

The provisions of this Order come into force as of January 19, 2013, when the Order of February 8, 1999 relating to the conditions for the establishment, issuance and validity of the driver's licence is repealed.
