The above-mentioned decision of 21 April 2009 is amended in accordance with the provisions of Articles 2 to 9 of this Order.
The last paragraph of Article 1 I and the penultimate sentence of the last paragraph of Article 6 II are supplemented by the words: "and the directions of companies, competition, consumption, work and employment".
In the second paragraph of Article 1 I, the words "industry and employment" are replaced by the words "financial and industry".
Section 3 is amended as follows:
1° In the fourth paragraph of the second paragraph, the words "develop" and "provisional account" are replaced, respectively, by the words "contribution" and "for the development of the provisional account".
2° The IV is thus amended:
(a) In the twelfth paragraph, after the words: "related issues", the words are inserted: "to the digital economy, in particular electronic and postal communications," and the words: ", as well as to the digital economy" are deleted;
(b) In the fifteenth preambular paragraph, the words "television, post" are deleted.
Section 4 is amended as follows:
1° II is thus amended:
(a) In the third sentence of the third paragraph, the words "who he assures the general secretariat with the Bank of France and the Office of Business and Insurance Intermediaries" are deleted;
(b) In the eleventh paragraph, the words: "in the best conditions. He participates in this work" are replaced by the words "in the best conditions and participates in the work";
2° The III is thus amended:
(a) At the end of the first sentence of the former preambular paragraph, the words: ", whether at the national, European or international level" are deleted;
(b) In the second sentence of the penultimate paragraph, the words: "to the work of the Observatory of payment deadlines and" are deleted;
(c) In the first sentence of the last paragraph, after the words: "with the Authority of Accounting Standards" are inserted the words: "and the High Council of the Office of the Auditors";
3° The IV is thus amended:
(a) In the first sentence and the last sentence of the third paragraph, the words "and aliens" and "land, sea and air" are deleted respectively;
(b) The sixth preambular paragraph shall be replaced by the following:
"He is responsible for matters relating to life insurance contracts and actuarial studies; It is also responsible for issues related to capitalization operations, pension, insurance, dependency, injury and health insurance. » ;
(c) The first sentence of the seventh preambular paragraph is deleted;
(d) The ninth preambular paragraph shall be replaced by the following subparagraph:
"He, in conjunction with the other ministerial departments concerned, exercises the guardianship of the Social Debt Fund (CADES), the Retirement Reserve Fund (FRR) and participates in the guardianship board of the additional public service pension institution (ERAFP). » ;
(e) In the second sentence of the penultimate paragraph, the words: "and the banking office" are deleted;
(f) The last paragraph is replaced by the following:
"He prepares and conducts European negotiations on insurance companies, notably within the framework of the European Insurance and Vocational Pensions Committee, and ensures the coordination of French positions in European and international bodies dealing with the field of insurance. »
Section 5 is amended as follows:
1° II is thus amended:
(a) In the fifth paragraph, the words: "the management of the state account at COFACE" are replaced by the words: "the monitoring of the State's claims on foreign countries by the French Insurance Company for Foreign Trade (COFACE)";
(b) The second sentence of the fourteenth preambular paragraph is deleted;
2° In the second sentence of the tenth paragraph of the III, the words "managed and" are deleted and the sentence is supplemented by the words: "with the support of the Agency for International Business Development (Ubifrance)";
3° The IV is replaced by the following:
"IV. ― The development evaluation unit assesses development activities that are piloted or implemented by the general management. It contributes to the evaluation of the whole of French public development assistance alongside the other administrative evaluation units (in particular the Ministry of Foreign and European Affairs and the French Development Agency) as well as to the harmonization and development of good practices and to the conduct of international evaluation work.
The unit follows issues related to the evaluation and effectiveness of official development assistance and, where appropriate, represents the general management in the relevant bodies such as the OECD Development Assistance Committee and the European Aid Evaluation Group. The unit follows and mobilizes relevant knowledge, analysis, studies and research in the development economy in order to inform management's decisions on official development assistance. »
Section 6 is amended as follows:
1° II is thus amended:
(a) The third paragraph is replaced by the following:
"It designs and implements export guarantee and financing procedures. He develops the credit policy that the Minister responsible for the economy has established. It directs and coordinates the activities of the various stakeholders responsible for a public service mission in these areas, in particular that of the COFACE acting on behalf of the State and that of the Natixis Institutional Affairs Department. It ensures State control over the activities of the COFACE managed on its behalf pursuant to theArticle R. 442-1 of the Insurance Code, in accordance with the expertise in this matter at the office of debt, international financing and the secretariat of the Paris Club. It also manages the state account to COFACE. » ;
(b) In the first sentence of the fourth preambular paragraph and the second sentence of the ninth preambular paragraph, the words: “inter-ministerial commission of guarantees” are replaced by the words: “guardian commission”;
(c) The last three sentences of the sixth preambular paragraph are replaced by the following:
"In this capacity, it manages the budgetary procedures for financing French benefits that contribute to the realization of priority projects for the development of beneficiary countries, through intergovernmental loans from the Emerging Country Reserve (ERP), or to the preparation of such projects, through donations or repayable advances from the study fund and assistance to the private sector (FASEP-studies). It provides budgetary and accounting management of loans to foreign states and external aid donations. It conducts the screening assessment of projects with bilateral aid instruments to which it is responsible and serves as the secretariat of the RPE and FASEP Project Review Committee. » ;
(d) In the second sentence of the ninth preambular paragraph, after the words: "when it is made", the words "in particular" are inserted;
2° The second to ninth paragraphs of the III are replaced by the following:
"The office of the Mediterranean and Southern Africa
It is responsible for countries belonging to the constituencies of the regional economic service leaders of the Maghreb, the Near East and southern Africa and the Mediterranean regional dimension.
The office of Turkey, the Balkans, the CIS and the Middle East
It is responsible for countries belonging to the electoral districts of the regional economic service leaders of Turkey, the Balkans, the Commonwealth of Independent States (CIS) and the Middle East.
The office of Asia and Oceania
It is in charge of countries belonging to the exchanges of heads of regional economic service of the Chinese world, Japan, the Association of Southeast Asian Nations (ASEAN), South Asia and Oceania.
The Americas office
It is responsible for countries belonging to the electoral districts of the heads of regional economic service of Canada, the United States, Brazil, the South Cone, Mexico and Central America, and Andean America and the Caribbean. » ;
3° In the second sentence of the IV, the words "He also assures", are replaced by the words: "He determines and implements the strategy of the public authorities with regard to the countries of his jurisdiction and assures,".
Section 9 is amended as follows:
1° I is thus modified:
(a) The first paragraph is replaced by the following:
"I. ― The General Secretariat manages human resources, budget and information systems. It implements the modernization projects of general management, both in central administration and in the network. » ;
(b) The fourth preambular paragraph is replaced by the following:
"In conjunction with the Human Resources Directorate of the General Secretariat of the Economic and Financial Departments, it provides human resources management, including recruitment, vocational training, forecast management of jobs, staffing and skills, and professional mobility of staff in the central management of the general management. » ;
(c) After the eighth preambular paragraph, a sub-item reads as follows:
"In close liaison with all branches of the general management, he participates in the implementation of the acts granting the state guarantee. » ;
(d) The last two paragraphs are replaced by the following:
"The Office Strategy, Studies and Pilotage
It is responsible for preparing and piloting the implementation of the modernization projects decided by the General Directorate, in close coordination with the relevant departments and other offices of the General Secretariat. He is involved in the development of the overall management strategy.
It coordinates the implementation of the proposed General Secretariat service.
It contributes, in conjunction with all relevant services, to the management of the international network (including cartography, letters of mission, strategic plans). It establishes the programme of comparative studies and international foresights entrusted to economic services and pilots their implementation, dissemination and evaluation. It also provides support to the relevant services for the thematic or regional meetings of the Heads of Economic Service and Regional Economic Service.
It contributes to the preparation of the general management inspection missions and the monitoring of the implementation of its recommendations.
As far as it is concerned, he is piloting the relationship with the main national institutional partners of the general management (e.g., preparation of the inter-ministerial committee of the international networks of the State-CORINTE, implementation and monitoring of conventions with partners, including the Ministry of Foreign and European Affairs, the Ministry of the Environment and the Ministry responsible for agriculture).
In liaison with the general secretariat of the economic and financial ministries, he is responsible for updating the organizational texts of the general management. » ;
2° II is replaced by the following:
"The general inspection, whose reports and recommendations are addressed to the Director General, is attached to the Secretary General. It monitors and evaluates the activities of the foreign services of the Ministry of Economy, Finance and Industry, and contributes, for its purposes, to the control and evaluation of the regional branches of enterprises, competition, consumption, work and employment, and the directions of companies, competition, consumption, work and employment, within the framework of the directions defined by management. It promotes reflection on their missions, organizations and working methods. It ensures any audit, study or advisory mission that the Director General or Secretary General assigns to the Director General on central administration and services abroad and in the region. »
In Article 10, after the words: "national jurisdiction services," the words are inserted: "as well as the monitoring mission of financial activities".
The Secretary General of the Economic and Financial Departments and the Director General of the Treasury are responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
