The Energy Regulatory Commission (ERC) was seized on 16 December 2011 by the Ministers responsible for The economy and energy of a draft decree on regulated prices for the sale of natural gas supplied by companies purchasing the GDF Suez tariff.
The draft order amends Article 2 of the tariff orders Regulated for sale of natural gas from the following local distribution undertakings: Gédia, Gaz et Electricité de Grenoble, Gazelec de Péronne, Energies et Services de Seyssel, Villard-Bonnot.



1. Background


Order No. 2009-1603 of December 18, 2009 determines the regulatory framework for regulated rates for the sale of natural gas. It provides in section 4 that for each supplier at regulated rates, a formula for estimating the cost of supply is published by order.
If the supply cost estimate formula is changed, then a new Formula must be published by order.


2. Comments


The suppliers involved in the draft order all source the GDF Suez STS tariff. The order establishing their tariff formula provided for in Article 2 that " The evolution of the term " m representing the costs of supply of natural gas is determined under the same conditions as in Article 2 of the decree of 29 December 2010 on the regulated prices for the sale of natural gas for subscription of GDF Suez ".
A new formula for calculating the cost of supply of GDF Suez for its subscription rates comes into effect on January 1, 2012, on which the CRE has delivered a favourable opinion today.
The order under review refers to the GDF Suez formula in force and not the one fixed by the decree of 29 December 2010, in order to That suppliers who purchase the STS tariff may pass on, without delay, actual changes to this tariff in their regulated rates of sale.


3. CRE Notice


The CRE gives a favourable opinion to the draft order submitted to it.
