Decree No. 2011-1326 of 18 October 2011 amending Decree No. 2010-1441 of 22 November 2010 relating to the controlled label of origin " Champagne"

The Prime Minister,
On the report of the Minister of Agriculture, Food, Fisheries, Rurality and Land Management,
Having regard to Council Regulation (EC) No. 1234/2007 of 22 October 2007 as amended bringing together markets in the agricultural sector and specific provisions with regard to certain products of that sector (the Single CMO Regulations);
Considering the rural code and the maritime fisheries, including title IV of Book VI;
Vu le Decree No. 2010-1441 of 22 November 2010 relative to the controlled label of origin « Champagne » ;
Considering the proposal of the permanent commission of the national committee of the labels of origin relating to the wines and alcoholic beverages, and of the life-saving waters of the National Institute of Origin and Quality dated 16 June 2011,

The 2nd of chapter I, chapter I, of the annex to the above-mentioned decree of November 22, 2010 is replaced by the following provisions:
« 2° Performance, average maximum load on the plot and individual yield increase as part of a mandatory reserve:
(a) Until the end of the 2011-2012 campaign:
- the yield referred to in 1° of point VIII of this specifications is set at 12,400 kilograms of grapes per hectare;
― the average maximum load to the plot is 21,700 kilograms per hectare. The number of clusters per square metre of vine surface in production is less than or equal to 18;
(b) Until the end of the campaign 2016-2017, when a reservation is created under Article 113 quater of Regulation (EC) No 1234/2007 of 22 October 2007 bringing together the common organization of markets in the agricultural sector and specific provisions with regard to certain products of this sector, the maximum volume of basic wines that can be subject to a reservation by an operator is less than or equal to 8,000 kilograms of grapes per hectare. However, until the end of the 2015-2016 campaign, this maximum volume is increased to 10,000 kilograms of grapes per hectare.
When a removal for renewal is carried out, the surface to be taken into account to determine the maximum volume of basic wines that an operator can put in reserve is the sum of the surface in production and of the surface replanted or plucked provided that the replantation occurs at the latest in the second campaign following the ripening.
Any operator wishing to supply this reservation may request, for this purpose, to benefit individually from an increase in efficiency in relation to the annual performance of the name fixed in application of the 1 or 3 of the a du II of the article D. 645-7 of the rural code and the marine fisheries within the limit of the score yield referred to in the 2° of the VIII of this specifications, and as long as it can demonstrate a qualitative control of its returns.
The increase in performance granted individually to the operator is, as the case may be, 2° or 4° of the II of Article D. 645-7 of the Rural and Maritime Fisheries Code.
The increase in efficiency to feed the reserve, which is set annually, does not exceed 25% of the performance provided for in this specifications and is determined in accordance with Article D. 645-7 of the Rural and Maritime Fisheries Code. This individual yield increase cannot lead to more than the maximum amount that can be reserved by the operator.
The basic wines put in reserve cannot claim to the controlled label of origin " Champagne ” only at the time of their release from the reservation and after having been the subject of a claim declaration valant declaration of bottled print.
The basic wines that have been subject to a mandatory reserve cannot be claimed with the indication of a vintage.
The basic wines are subject to qualitative monitoring. »

The Decree No. 2007-1413 of 1 October 2007 bearing special provisions for the wines of controlled label of origin "Champagne" is repealed.
