In light of Directive 98/34 of the European Parliament and of the Council of 22 June 1998 providing for an information procedure in the field of standards, technical regulations and rules relating to the services of the information society together with notification No. 2010/0321/F of 27 May 2010;
Considering Council Directive 98/83/EC of 3 November 1998 on the quality of water for human consumption;
In light of Commission Directive 2003/40/EC of 16 May 2003, setting the list, concentration and labelling limits for natural mineral water constituents and the conditions for use of ozone-enriched air for the treatment of natural mineral water and source water;
Having regard to Directive 2009/54/EC of the European Parliament and the Council of 18 June 2009 on exploitation and trade in natural mineral waters;
Vu le Consumer codeincluding article L. 214-1;
Vu le Public Health Codeincluding articles R. 1321-2, R. 1321-3, R. 1321-84, R. 1321-85, R. 1321-88, R. 1321-91, R. 1322-3, R. 1322-32, R. 1322-44-10 and R. 1322-44-13;
In view of the Order of March 14, 2007 on the criteria for the quality of conditioned water, the special treatments and labelling of natural and source mineral water and natural mineral water distributed in public buvette;
Considering the opinion of the French Food Safety Agency dated 17 December 2008,

Section 2 of the above-mentioned Order of March 14, 2007 is supplemented by the following paragraph:
"The contamination is defined by the presence in natural mineral water of one or more organic pollutants:
- at a concentration greater than 1 μg/l for trihalomethane, tetrachloroethylene and trichloroethylene (for each identified substance);
- at a concentration greater than 0.1 μg/l for the sum of pesticides and their metabolites;
- at a concentration greater than 30% of the quality limits and references set out in Table B-2 of Appendix I for other organic pollutants, including benzene, benzo(a) pyrene, 1,2 dichloroethane and polycyclic aromatic hydrocarbons. »

In application of theArticle R. 1322-32 of the Public Health Code, Article 5 of the above-mentioned Order of 14 March 2007 is supplemented by a paragraph written as follows:
"The treatments authorized under the 5th of this article are the elimination of arsenic and manganese by selective adsorption on filtration support covered with metal oxide.
Commission Regulation (EU) No. 115/2010 of 9 February 2010 sets out the conditions for the use of activated alumina for the disposal of fluorides in natural mineral waters and source waters. »

In application of theArticle R. 1322-44-10 of the Public Health Code, Article 10 of the above-mentioned Order of 14 March 2007 is supplemented by a paragraph written as follows:
"The labelling of natural mineral water and source water that has been the subject of fluoride disposal treatment includes, near the indication of analytical composition, the mention: "water subject to an authorized absorption technique". »

Annexes I, III and IV to the above-mentioned Order of 14 March 2007 are amended as follows:
1° In Table A "Microbiological Quality Limits" of Appendix I, in the column "Notes", the lines: "In the course of marketing, the total content can only result from the normal evolution of its content to the emergence, the analyses to be started at least within twelve hours after the conditioning" and "In the course of marketing, the analyses to be started within twelve hours following the conditioning;" are replaced »
2° Table B-1 "Physico-chemical quality limits of natural mineral water conditioned or distributed as a public bush" in Appendix I is replaced by the table in Appendix I to this Order.
3° Table B-2 "Physico-chemical quality limits for source water and water made safe by conditioned treatment" and Table B-3 has "Chemical and organoleptic parameters" in Appendix I are amended as follows:
In the "Units" column, the references "Mg/l" are replaced by the references "mg/l".
4° In the table in Appendix III "Disclaimer of the Conditioned Natural Mineral Water", it is inserted after the "Sodic" line the following line:


"Suitable for a low sodium diet."

Sodium content below 20 mg/l (in Na+).


5° The table "Quality Requirements and Labelling Requirements for Infant Feeding" in Appendix IV is replaced by the table in Appendix II to this Order.

Natural mineral water conditioned and distributed in public buvette and conditioned source water that does not meet the requirements of Article 1 and 4 of this Order may be marketed for a period of twelve months.

The Director General of Competition, Consumption and Suppression of Frauds and the Director General of Health are responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
