Considering the opinion of the Supreme Council of the Territorial Public Service of 28 April 2010;
Considering the opinion of the Standards Advisory Board of 6 May 2010;
The State Council (Section of Administration) heard,
Decrete:
Territorial technicians are a Category B technical employment framework within the meaning of section 5 of the aforementioned Act of 26 January 1984.
This employment framework includes the ranks of technician, senior 2nd-class technician and senior 1st-class technician.
They are governed by the provisions of decree of 22 March 2010 referred to above and this decree.
I. ― Members of the employment framework of the territorial technicians are responsible, under the authority of a supervisor, for the conduct of the projects. They supervise teams and control the work entrusted to companies. They are involved in the implementation of accounting and management control. They may investigate matters relating to urban planning, development, maintenance and conservation of the community. They also participate in the implementation of actions related to the preservation of the environment.
They ensure control over the maintenance and operation of the works as well as the monitoring of equipment, repair and maintenance of mechanical, electrical, electronic or hydraulic installations. They can also monitor the public domain. To this end, they can be sworn to see the contraventions. They can participate in teaching and vocational training missions.
II. - The incumbents of the ranks of senior technicians of the 2nd and 1st grades are intended to occupy jobs that, within the areas of activity mentioned in I, correspond to a level of expertise acquired by initial training, professional experience or professional training throughout life.
They can provide direction for work on the ground, site control, equipment management and participate in the development of new or maintenance projects. They may conduct technical or scientific investigations, controls and measures.
They may also undertake studies and projects and be associated with programming work. They may be invested with personnel management or service management functions or part of services whose importance, level of expertise and responsibility do not justify the presence of an engineer.
The members of the employment framework exercise their functions in all areas of a technical nature in relation to the competences of a territorial community or a public institution by applying.
Recruitment by means of competition under section 36 of the Act of 26 January 1984 referred to in the rank of technician shall be carried out in accordance with the terms set out in 1° of section 4 and to Articles 5, 8 and 10 of the Decree of 22 March 2010 referred to above and in the manner defined in articles 5 and 6 of this Decree.
The external competition is a title contest with open trials, for at least 30% of the positions to be filled, to candidates with a technological bachelor's degree, or a professional bachelor's degree, or a degree approved at level IV that imposes technical-professional training, or a qualification recognized as equivalent under the conditions fixed by the decree of 13 February 2007 referred to above corresponding to one of the specialties open under Article 6 of this Decree.
The internal competition and the third competition are competitive examinations, which are open for up to 50 per cent and 20 per cent respectively.
When the number of successful candidates in one of these three contests is less than the number of places offered in this contest, the jury may change the number of places to the external, internal and third competitions, within 25% of the total number of places offered to these contests or at least one place.
The contests mentioned in Article 5 are open in one or more of the following specialties:
1° Buildings, civil engineering;
2° Networks, road and infrastructure;
3° Risk prevention and management, hygiene, restoration;
4° Urban planning and sustainable development;
5° Travel, transport;
6° Green and natural spaces;
7° Engineering, computers and information systems;
8° Technical services and intervention;
9° Métiers du spectacle ;
10° Craft and crafts.
They are organized by management centres within their geographical jurisdiction, or, where appropriate, within the scope defined by a convention concluded under the third paragraph of section 26 of the above-mentioned Act of 26 January 1984.
The Chair of the Management Centre sets out the organizational arrangements, discipline rules, the number of open positions and the date of the trials. It lists the candidates authorized to compete. He also stops the aptitude list.
Recruitment under 2° of section 39 of the above-mentioned Act of 26 January 1984 shall take place in the rank of technician according to the terms set out in 2° of section 4 and to Articles 8, 9 and 30 of the Decree of 22 March 2010 referred to above and as follows.
Can be registered on the aptitude list provided for in 2° of Article 4 above:
1° Public servants under the employment framework of territorial masters;
2° Employees under the employment framework of territorial technical assistants with the rank of Principal 1st Class Technical Assistant;
3° Employees under the employment framework of territorial technical assistants of educational institutions with the rank of Principal 1st Class Technical Assistant.
Employees mentioned at 1° must have at least eight years of effective service, in a position of activity or detachment in a local or state employment, of which at least five years as a territorial civil servant in a technical job.
Officials mentioned in 2° and 3° must have at least ten years of effective services, in a position of activity or detachment in a job of a territorial or state authority, of which at least five years as a territorial civil servant in a framework of technical employment.
Registration on the aptitude lists can only be done in the light of the certificates issued by the National Territorial Civil Service Centre stating that the officer has completed, in his or her original employment or employment, all of his or her professional training obligations for the periods ended.
Recruitment by competition in the rank of 2nd class senior technician shall be carried out according to the terms set out in 1st of Article 6 and to Articles 7, 8 and 10 of the Decree of 22 March 2010 referred to above and in the manner defined in articles 9 and 10.
The external competition is a title contest with open trials, for at least 50% of the positions to be filled, to candidates with a degree sanctioning two years of technical-professional training approved at level III or a qualification recognized as equivalent under the conditions fixed by the decree of 13 February 2007 referred to above corresponding to one of the specialties open under Article 10 of this Decree.
The internal competition and the third competition are competitive examinations, which are open for up to 30 per cent and 20 per cent respectively.
When the number of successful candidates in one of these three contests is less than the number of places offered in this contest, the jury may change the number of places to the external, internal and third competitions, within 25% of the total number of places offered to these contests or at least one place.

Recruitment under the 1st of section 39 of the above-mentioned Act of 26 January 1984 shall take place in the rank of second-class principal technician according to the terms set out in the 2nd of section 6 and to the Articles 8, 9 and 30 of the Decree of 22 March 2010 referred to above and as follows.
Can be entered on the fitness list provided for in 2° of Article 6 above, after admission to a professional examination:
1° Public servants under the employment framework of territorial masters;
2° Employees under the employment framework of territorial technical assistants with the rank of senior technical assistant at grade 1 or senior technical assistant at grade 2;
3° Employees under the employment framework of the territorial technical assistants of educational institutions with the rank of senior technical assistant at the 1st grade or senior technical assistant at the 2nd grade level.
Employees mentioned at 1° must have at least eight years of effective service, in a position of activity or detachment in a local or state employment, of which at least five years as a territorial civil servant in a technical job.
Officials mentioned in 2° and 3° must have at least ten years of effective services, in a position of activity or detachment in a job of a territorial or state authority, of which at least five years as a territorial civil servant in a framework of technical employment.
The management centres are responsible for organizing professional examinations.
Registration on the aptitude lists can only be done in the light of the certificates issued by the National Territorial Civil Service Centre stating that the officer has completed, in his or her original employment or employment, all of his or her professional training obligations for the periods ended.
Candidates on the suitability list provided for in sections 6 and 10 and recruited on a job of one of the public authorities or institutions referred to in section 2 of the Act of 26 January 1984 referred to above shall be appointed interns technician and senior 2nd interns technician respectively as defined in the terms and conditions set out in theArticle 10 of the Decree of 22 March 2010 referred to above.
Candidates on the suitability list provided for in sections 7 and 11 and recruited on a job of one of the public authorities or institutions referred to in section 2 of the Act of 26 January 1984 referred to above shall be appointed interns technician and senior technician of 2nd interns, respectively, as defined in section 11 of the same decree.
Their classification and titularization shall take place in accordance with the terms set out in chapter III and article 12 of the same decree, respectively.
Within two years of their appointment by one of the routes referred to in section 12 or by way of detachment or direct integration, the members of this employment framework are required to undergo vocational training in the first employment, under the conditions provided by the decree of 29 May 2008 referred to above and for a total duration of five days.
In the event of an agreement between the officer and the territorial authority to which he or she relates, the period referred to in the preceding paragraph may be extended to a maximum of ten days.
At the end of the two-year period provided for in the previous article, the members of this employment framework are required to undergo vocational training throughout the career, under the conditions provided by the decree of 29 May 2008 referred to aboveat two days per five-year period.
When they reach a position of responsibility, within the meaning ofarticle 15 of the decree of 29 May 2008 referred to above, the members of this employment framework shall be required, within a period of six months from their assignment to the employment in question, to be trained, for a period of three days, under the conditions prescribed by the same decree.
In the event of an agreement between the officer and the territorial authority to which he reports, the duration of the formations mentioned in the preceding two articles may be extended to a maximum of ten days.
I. - The increment is made according to the conditions provided by thearticle 24 of the decree of 22 March 2010 referred to above.
II. - The advance to the rank of senior technician of the second class is made according to the conditions provided for in Article 25 of the same decree.
III. - The advance to the rank of senior technician of 1st class is made according to the conditions provided for in Article 25 II of the same decree.
IV. - For the assessment of the seniority conditions required for the advancement of the rank of the technicians' employment framework, the actual services performed in their original bodies by the agents under the provisions of the Decree No. 2005-1785 of 30 December 2005 relating to the indefinite detachment of State officials pursuant to theArticle 109 of Act No. 2004-809 of 13 August 2004 relating to local freedoms and responsibilities are considered to be services performed in the rank and employment of territorial technicians.
Territorial labour controllers belonging to the employment framework governed by the Decree No. 95-952 of 25 August 1995 are integrated into this employment framework in accordance with the following mapping:

Employees detached from their former employment executives of territorial labour controllers and territorial superior technicians are placed in detachment positions in this employment framework for the duration of their remaining detachment. They are classified in accordance with the correspondence tables in articles 18 and 19.
The services performed by the persons involved in the position of detachment in their previous employment and grade frameworks are assimilated to services performed in the position of detachment in employment and degree of integration.
I. ― Candidates received for access to the employment framework of territorial work controllers governed by the Decree No. 95-952 of 25 August 1995, opened before the date of entry into force of this decree, retain the possibility of being appointed interns in this employment framework at the rank of technician.
II. - Candidates received for access examinations to the employment framework of the territorial superior technicians governed by the Decree No. 95-29 of 10 January 1995, opened before the date of entry into force of this Order, retain the possibility of being appointed a trainee in this Job Framework at the rank of Senior 2nd Class Technician.
III. - Trainees who have started their internship in the employment frameworks of the territorial labour controllers or the above-mentioned territorial superior technicians continue their training in their employment and degree of integration.
I. ― Public servants on a fitness list or who have completed the tests of a professional examination for access to the employment framework of the territorial work controllers governed by the Decree No. 95-952 of 25 August 1995, under section 39 of the aforementioned Act of 26 January 1984, retain the possibility of being appointed to the rank of technician of the integration employment framework.
II. - Officials on a suitability list or having completed the tests of a professional examination for access to the employment framework of territorial superior technicians governed by the Decree No. 95-29 of 10 January 1995, under section 39 of the above-mentioned Act of 26 January 1984, retain the possibility of being appointed as the second-class senior technician of the integration framework.
III. - By derogation from the provisions of the II, the incumbents of the rank of Chief Work Comptroller retain the possibility of being appointed as the Principal Technician of the 1st Class of Integration Employment Framework.
Contractual officers recruited under the seventh paragraph of section 38 of the above-mentioned Act of 26 January 1984, who are to be held in the rank of territorial Comptroller or, where applicable, in the rank of territorial superior technician, shall be held in office and shall be held respectively in the ranks of second-class technician and technician.
I. ― The progress tables at the grades of main work controller and chief work controller, established for the year in which the integration in this employment framework is pronounced, remain valid until December 31 of that year, under the integration framework, respectively at the grades of senior 2nd class technician and senior 1st class technician.
II. - The progress tables at the ranks of Senior Technician and Senior Technician, established for the year in which integration is pronounced in this employment framework, remain valid until December 31 of that year, under the integration framework, at the rank of Principal 1st Class Technician.
III. - Agents promoted under the preceding subparagraphs are classified in the grades of advancement of this employment framework taking into account the situation that would have been theirs if they had not ceased to belong to their former employment framework until the date of their promotion, and then promoted in the grades of advancement of this employment framework in accordance with the provisions of the decree of 22 March 2010 referred to above, and finally reclassified to that same date in their framework of integration jobs.
Officials who, in their original employment frameworks, have satisfied a professional examination for the advancement of the rank of the primary territorial controller or for the advancement of the rank of chief territorial superior technician retain the possibility of being appointed respectively to the rank of senior 2nd class technician and to the rank of senior 1st class technician of this employment framework.
The appointments thus pronounced apply, respectively, to the number of appointments to the rank of senior technician of the second class acting by the way mentioned to the 1° of Article 25 of the Decree of 22 March 2010 referred to above, and on the number of appointments to the rank of senior technician of the first class acting by the way referred to in 1° of II of Article 25 of the same decree.
Public servants are integrated into this employment framework by order of the territorial authority to which they report. This integration takes effect on the date of entry into force of this decree.
Article 8 of the aforementioned Decree of 9 February 1990 is amended as follows:
1° At 1° of the I, the words: "Territorial Superior Technicians and those of the Territorial Work Comptroller Framework" are replaced by the words: "Territorial Technicians";
2° At 2° of I, the words: "aged territorial superior technicians, on January 1 of the year of examination, at least forty years and" are replaced by the words: "territorial technicians";
3° The first paragraph of the second paragraph is replaced by a sub-item:
"Can be registered on the suitability list provided for in Article 6, 3° a, the members of the employment framework of the territorial technicians with the rank of senior technician at the 1st grade and with at least eight years of actual service as senior technician at the 2nd or 1st grade. »
I.-At 1° of Article 4 of the decree of September 14, 1995 referred to above, the words "main controllers and controllers" are replaced by the word "technical".
II.-At the 1st of Article 5 of the same decree, the words: "superior technicians, senior technicians and senior technicians, chief work controllers" are replaced by the words: "principal technicians of 2nd class and senior technicians of 1st class".
III.-The provisions of this article may be amended by decree.
Correspondence tables in I, II, III, IV and VAnnex to the above-mentioned Decree of 30 December 2005, in the column on the grades of the territorial public service hospitality framework:
1° The words: "Superior Territorial Chief Technician", "Main Territorial High Technician", "Main Territorial High Technician, 8th and 9th Provisional Stages" and "Territorial Chief Work Comptroller" are replaced by the words "Main Territorial Technician of 1st Class";
2° The words: "Territorial Superior Technician" and "Main Territorial Comptroller" are replaced by the words: "Second Class Territorial Technician";
3° The words: "Territorial Work Comptroller" are replaced by the words "Territorial Technician".
In the appendix to the above-mentioned Decree of 22 March 2010, the following mention is inserted: "Territorial Technicians".
The Decree No. 95-29 of 10 January 1995 bearing special status of the employment framework of the territorial superior technicians and Decree No. 95-952 of 25 August 1995 on the special status of the territorial labour controllers are repealed.
This Order comes into force on the first day of the month following that of its publication.
The Minister of the Interior, the Overseas and the Territorial Communities, the Minister of Labour, Solidarity and the Public Service, the Minister of Budget, Public Accounts and State Reform, the Secretary of State within and to the local authorities and the Secretary of State responsible for the Public Service are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
