Decree No. 2010-1019 of 30 August 2010 amending Decree No. 2008-940 of 12 September 2008 on the special status of the corps of arms officers of the army of land

The Prime Minister,
On the report of the Minister of Defence,
Vu le Defence code ;
Vu le Decree No. 2008-940 of 12 September 2008 bearing special status of the corps of arms officers of the army of land;
Having regard to the advice of the Supreme Council of the Military Service dated 19 June 2009;
The State Council (Section of Administration) heard,
Decrete:

Article 4 of the above-mentioned decree of 12 September 2008 is amended as follows:
1° At 3°, the words: "master's degree" are replaced by the words: "master's degree, or an equivalent degree or title";
2° It is inserted a last paragraph, as follows:
« 4° By one or more title contests, on the proposal of the commission referred to in section 32, open to candidates holding a graduate degree of general secondary education, or a degree recognized as equivalent, or another title or diploma classified at least at level IV and up to nineteen years of age. »

Article 5 of the same decree is replaced by the following provisions:
“Art. 5. ― Admission to the Inter-Military Military School is made:
« 1° By one or more competitive examinations open to non-commissioned members who are at least twenty-three years of age and not more than twenty-nine years of age, who have a graduate degree in general, technological or professional secondary education or a diploma recognized as equivalent, or another title or diploma classified at least level IV, and who have completed at least three years of effective military service;
« 2° By one or more title contests, on the proposal of the commission referred to in section 32, open to non-commissioned members who have completed at least three years of effective military service and at least twenty-three years of age and not more than twenty-nine years of age, having validated the first four semesters of the general or technological higher education licence or holders of a title or diploma graded at least level III or a title or diploma recognized as equivalent
“(a) Has an entrance examination at a school entitled to issue a graduate engineering title, in accordance with articles L. 642-1 et seq. of the Education Code;
“(b) Has an entrance examination at a school created and administered by the Chambers of Commerce or a private institution authorized to issue an official diploma referred to by the Minister responsible for higher education;
"(c) At the entrance competition at the Military Special School, the Air School, the Polytechnic School or the Naval School. »

Article 12 of the same decree is supplemented by a last paragraph as follows:
« 5° Students admitted under 4th of Article 4 follow a six-year officer training course. This curriculum, which includes preparation in France within the Ministry of Defence, is dispensed by the school of a land army of a foreign country, under conditions fixed by decree of the Minister of Defence.
"These students are appointed to the rank of assistant lieutenant on 1 August of the end of the fourth year of the course and then to the rank of lieutenant on 1 August of the end of the fifth year. »

The 2nd of Article 17 of the same decree is abolished. The third becomes the second.

The first paragraph of Article 19 of the Decree is replaced by the following two paragraphs:
"The required qualifications or qualifications of candidates for recruitment are assessed and verified by December 1 of the year of admission to the initial training school or, for recruitment at the choice, on the date of recruitment in the body.
"By derogation from the provisions of the preceding paragraph, the conditions of title or diploma required of candidates for recruitment under the 1st of Article 4 and 1st of Article 5 shall be checked at the closing date of registration. »

The 2nd of Article 22 of the Decree is replaced by the following provisions:
« 2° Officers graduated from the Military Special School and recruited under the 4th of Article 4, with a year of seniority; "

In Article 23 of the same decree, the words "3° of Article 17" are replaced by the words "2° of Article 17".

Article 24 of the same decree is supplemented by a second paragraph, as follows:
"The appointments resulting from the 2° recruitment of section 5 cannot exceed one third of the number of places offered the previous year to the competition provided for in section 5. »

The 4th of Article 25 of the Decree is replaced by the following provisions:
« 4° Lieutenants recruited under the 4th of Article 4 among graduate students of the Military Special School.
"They rank among themselves on the list of seniority of their rank, according to the classification mentioned in Article 13; "

In Article 26 of the same decree, the words "3° of Article 17" are replaced by the words "2° of Article 17".

Article 41 of the same decree is supplemented by two last paragraphs as follows:
« VII. ― By derogation from the provisions of Article 30, the minimum duration of troop time as an officer shall be four years until December 31, 2014.
« VIII. ― Military personnel serving under a contract, who have already been admitted to a training course for officers provided by the school of a land army of a foreign country on the date of publication of this decree, may, until 31 December 2010, be admitted to the Military Special School under the 4th of Article 4. »

The Minister of Labour, Solidarity and the Public Service, the Minister of Defence, the Minister of Budget, Public Accounts and State Reform and the Secretary of State for the Public Service are responsible, each with regard to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.
