Having regard to Council Regulation (EC) No. 1234/2007 of 22 October 2007 concerning the joint organization of markets in the agricultural sector and specific provisions with regard to certain products of that sector ("one MMC regulation"), as amended by Council Regulation (EC) No. 361/2008 of 14 April 2008;
Having regard to Commission Regulation (EC) No. 1580/2007 of 21 December 2007 on the modalities for the application of regulations (EC) No. 2200/96, (EC) No. 2201/96 and (EC) No. 1182/2007 in the fruit and vegetable sector;
Considering the rural code and the maritime fisheries, including title V of Book V;
Having regard to the decree of 17 October 2008 on producer organizations, producer organizations and producer groups and amending Book V of the Rural Code and Maritime Fisheries (regulatory part);
Considering the decree of 4 December 2008 recognizing the association of producer organisations CERAFEL as an association of producer organisations of the fruit and vegetable sector;
Given the minutes of the deliberation of the board of directors of 25 November 2009 relating to the application for extension of the rules referred to in section 125 septies of Regulation (EC) No 1234/2007, enacted by the AOP CERAFEL, to all producers of artichokes, broccoli, cauliflowers, apple cabbage, shallots, semi-secberg beans, milk
Considering the application by the AOP CERAFEL;
Considering the advice of the specialized technical committee of the Higher Council for the Guidance and Coordination of the Agricultural and Food Economy of 17 June 2010,
Stop:
The following rules, enacted by the association of producer organisations CERAFEL, are extended to all producers of artichokes, broccoli, cauliflowers, apple cabbage, shallots, semi-secret beans, iceberg lettuce and winter pears, established in the departments of Côtes-d'Armor, Finistère, Ille
1° Rules of knowledge of production:
A. ― Provision by the relevant regional section of the AOP CERAFEL, on a fixed date, of a state of the area planted by variety and planting type, in accordance with the attached schedule.
B. ∙ Provision for the dates fixed by the relevant regional section in accordance with the attached annex:
- crop forecast declarations by variety;
― statements of tonnage harvested by variety;
- periodic reports, from the beginning to the end of the campaign, tonings harvested per period (total and intended for marketing).
2° Production rules:
Compliance with the production rules (choice of varieties) defined by the relevant regional section.
3° Commercialization rules:
A. ― Compliance with the packaging, presentation and packaging rules defined by the relevant regional section of the CERAFEL AOP for the first market.
B. ― Obligation, at certain times, to remove from the market non-compliant products under the above-mentioned rules and to comply with the market intervention procedures applied by the regional section.
C. ― Obligation to market or market the product with apposition marking of an identification label conforming to the model approved by the CERAFEL AOP.
This label is affixed to packagings on delivery or marketing and is a justification for the application of the prescribed rules.
The issue of the label cannot be denied to producers who respect the rules.
4° Environmental Protection Rules:
Obligation to comply with the relevant rules:
- the use of fertilizers and fumurs;
- the use of phytosanitary products and other methods of crop protection;
- the maximum residue content of phytosanitary and fertilizer products;
- the elimination of used by-products and materials;
– the destruction of products removed from the market.
As part of the extension of the above mentioned rules, the CERAFEL AOP is authorized to collect from producers who are not members of adhering producer organizations, contributions intended to:
- the administrative management fund (operation and control) established by the AOP CERAFEL to ensure its administrative operation;
– to the promotion, study and research fund established by the AOP CERAFEL to cover general shares benefiting all producers of the electoral district.
The amount of these contributions is determined by order of the Minister of Food, Agriculture and Fisheries, by reference to contributions received by the producer organizations of the CERAFEL AOP to which they cannot be higher.
Without prejudice to the legislative and regulatory provisions applicable to the retention period of documents, the producer must keep for a minimum of three years, a copy of the delivery vouchers and a copy of the invoices indicating tonings and prices by size and category.
The Director General of Competition, Consumer Affairs and the Suppression of Frauds in the Ministry of Economy, Industry and Employment and the Director General of Agricultural, Agri-Food and Territories Policies in the Ministry of Food, Agriculture and Fisheries are responsible, each with respect to it, for the execution of this Order, to be published in the Official Journal of the French Republic.
