Considering Directive 2006/123/EC of the European Parliament and the Council of 12 December 2006 on services in the domestic market;
In view of the rural and maritime fishing code, including its article R. 171-12;
Vu la Act No. 66-879 of 29 November 1966 relating to professional civil societies, including article 4;
Vu la Act No. 90-1258 of 31 December 1990 relating to the exercise, in the form of societies, of liberal professions subject to legislative or regulatory status or whose title is protected, including Articles 5 and 5-1;
Vu le Decree No. 86-636 of 14 March 1986 applying to the profession of agricultural and land expert and forest expert Act No. 66-879 of 29 November 1966 relating to professional civil societies;
Vu le Decree No. 92-789 of 4 August 1992 for the application to the profession of agricultural and land expert or forest expert of the provisions of the Act No. 90-1258 of 31 December 1990 relating to the exercise, in the form of societies, of liberal professions subject to legislative or regulatory status or whose title is protected;
The State Council (section of public works) heard,
Decrete:
The above-mentioned decree of 14 March 1986 is thus amended:
1° In the fourth paragraph of Article 1, the words: "The number of partners cannot exceed five. » are deleted;
2° Article 41 reads as follows:
"A partner may practise his profession individually; it can also be a member of another professional civil society. »
Article 5 of the above-mentioned Decree of 4 August 1992 is replaced by the following provisions:
"Art. 5.-The majority of the capital of the liberal exercise companies constituted for the exercise of the profession of agricultural and land expert or forest expert, with limited or anonymous responsibility, must be held by agricultural and land experts or forest experts in exercise. »
Article R. 172-12 of the Rural Code is replaced by the following provisions:
« 6. An extract of judicial record No. 3 or for professionals who are nationals of a Member State of the European Union or of another State Party to the Agreement on the European Economic Area, a certificate certifying that its holder shall not, on the date of its issuance, prohibit, even temporary, from exercising; "
The Minister of Food, Agriculture and Fisheries is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
