Considering the constitution, convention and regulation of radiocommunications of the International Telecommunication Union;
Considering the post and electronic communications code, including articles L. 41, L. 41-3, L. 43, L. 97-2, L. 97-3, L. 97-4 and R. 52-3-1 to R. 52-3-21;
In view of the decision of 11 August 2006 on fees for the processing of applications for frequency assignments declared to the International Telecommunication Union and applications for authorization pursuant to Articles R. 52-3-1 and R. 52-3-4 of the Post and Electronic Communications Code;
Considering the Order of 11 August 2006 on the content of the application for permission to operate frequency assignments to satellite systems and satellite system information;
Having regard to the instruction file transmitted by the National Frequency Agency on May 3, 2010 to the Minister of Economy, Industry and Employment;
Considering the opinion of the Electronic Communications and Post Regulatory Authority dated 11 March 2010;
Considering the opinion of the National Centre for Space Studies of 9 March 2010;
Having regard to the opinion of the Ministry of Defence of 10 March 2010;
Considering the opinion of the senior administrator of the French Southern and Antarctic Lands of 1 March 2010;
The Ministry of Interior consulted;
The President and CEO of Weather-France consulted;
The Ministry of Higher Education and Research consulted;
The General Directorate of Competitiveness, Industry and Services Consulted,

Article 1


Eutelsat SA is authorized to operate the frequency assignments declared by France to the International Telecommunication Union at orbital position 13° Is under the conditions set out in the schedule to this Order.

The authorization shall be granted for a period of twenty years from the date of publication of this order subject to the conditions of amendment and decidity provided for in sections R. 52-3-13 to R. 52-3-15 of the Post and Electronic Communications Code. The conditions for renewal of this authorization are defined in section R. 52-3-12 of the Post and Electronic Communications Code.

    CONDITIONS RELATING TO THE AUTHORIZATION OF THE EXPLOITATION OF FREQUENCE ASSIGNATIONS FOR A SATELLITARY SYSTEM TO THE ORBITALE POSITION 13° EST

    Conditions


    Pursuant to sections L. 97-2 and R. 52-3-1 to R. 52-3-21 of the Post and Electronic Communications Code, the authorization is issued under the following conditions:
    (a) The relevant frequency assignments are limited to those at orbital position 13° East, which are included in the frequency bands:
    3,4-4,2 GHz, 17,3-17,7 GHz and 17,7-20,2 GHz in space to Earth direction for fixed satellite service;
    5,725-5,850 GHz, 5,850-6,700 GHz, 14-14,5 GHz and 27,7-30 GHz in the Earth-to-space direction for fixed-satellite service,
    and which have been declared by France in the applications for assignments provided below and are or will be registered in the International Frequency Reference File of the International Telecommunication Union (ITU).

    (b) The Earth stations operated are located in the service area as follows:
    The service area for frequency bands 3,800-4,200 GHz and 5,850-6,700 GHz corresponds to the Earth visible from orbital position 7° Is with an elevation angle of 5° (see Figure 1).
    The service area for the band 3,400-3,800 GHz corresponds to the Earth visible from orbital position 7° Is with an elevation angle of 5°, excluding French territories visible from this position: Metropolitan France (F), Guadeloupe (GDL), French Guiana (GUF), Mayotte (MYT), La Réunion (REU), the Eparses Islands (REU) Saint-Pierre-et-Miquelon (SPM), Crozet (CRO) and Kerguelen (KER) (see figure 2 below).
    The service area for the band 5.725-5.850 GHz corresponds to the area 1 visible from orbital position 7° Is, excluding the French territories of Region 1 visible from this position: Metropolitan France (F), Mayotte (MYT), La Réunion (REU), the Eparses Islands (REU) and Crozet (CRO) (see figure 3 below).
    The service area for the frequency band 17.3-17.7 GHz corresponds to Area 1 visible from orbital position 7° East (see figure 4 below).
    The service area for frequency bands 14-14,5 GHz, 17.7-20.2 GHz and 27.7-30 GHz corresponds to the Earth visible from orbital position 7° East (see figure 5 below).

    (c) Emissions do not radiate at any point in the space or surface of the globe from a power greater than that produced by the emissions corresponding to the frequency assignments whose characteristics are or will be entered in the International ITU Frequency Reference File, and receptions do not in any case require more protection than would require frequency assignments whose characteristics are or will be entered in the same file.
    (d) Frequency assignments shall be carried out in accordance with the coordination agreements concluded with other ITU member States or with other frequency assignment operators declared by France to the ITU, including those that would be after the date of issue of this authorization. This operation is subject to respect for the rights associated with assignments previously communicated to the ITU for the duration of their operation.
    (e) The operation of the frequency assignments concerned by the authorization is subject to compliance with the obligations set out in sections L. 97-2-II and R. 52-3-7 to R. 52-3-11 of the Post and Electronic Communications Code.
    (f) Eutelsat SA is the sole licensee and remains responsible for complying with the obligations related to the operation of these assignments, including where associated radio stations are held, installed or operated by third parties, or located outside France.
    (g) This authorization does not prejudge authorizations that are required to operate the system in the territories affected by the service area.
    (h) The authorization shall be granted for a period of twenty years from the date of publication of this order subject to the conditions of amendment and decidity provided for in sections R. 52-3-13 to R. 52-3-15 of the Post and Electronic Communications Code. The conditions for renewal of this authorization are defined in section R. 52-3-12 of the Post and Electronic Communications Code.
