Decree No. 2010-491 of 14 May 2010 on Technical Committees in the Departments of Labour, Solidarity and the Public Service, Health and Sports and Youth and Active Solidarity

The Prime Minister,
On the report of the Minister of Labour, Solidarity and Public Service, the Minister of Health and Sports and the Minister of Youth and Active Solidarity,
Vu le Public Health Code ;
Vu la Act No. 83-634 of 13 July 1983 amendments to the rights and obligations of civil servants, together with Act No. 84-16 of 11 January 1984 amended with statutory provisions relating to the public service of the State;
Vu le Decree No. 78-457 of 17 March 1978 Amending the provisions applicable to contractual agents of the central administration and the decentralized services of the Ministry of Labour and the Ministry of Health and Solidarity;
Vu le Decree No. 82-452 of 28 May 1982 modified on technical committees of parity;
Vu le Decree No. 2007-995 of 31 May 2007 amended on the powers of the Minister of State, Minister of Ecology, Energy, Sustainable Development and the Sea, in charge of green technologies and climate negotiations;
Vu le Decree No. 2007-996 of 31 May 2007 amended on the powers of the Minister of Economy, Finance and Employment;
Vu le Decree No. 2007-1002 of 31 May 2007 amended on the duties of the Minister of Health and Sports;
Vu le Decree No. 2008-1390 of 19 December 2008 on the technical committees of the Departments responsible for social affairs, youth, sports and associative life and extending the term of office of their members;
Vu le Decree No. 2010-352 of 1 April 2010 the duties of the Minister of Labour, Solidarity and the Public Service;
Vu le Decree No. 2010-353 of 1 April 2010 relating to the functions of the Minister of Budget, Public Accounts and State Reform;
Vu le Decree No. 2010-354 of 1 April 2010 relating to the powers of the Minister of Youth and Active Solidarity;
Considering the advice of the Joint Ministerial Technical Committee to the Ministry of Labour and Social Affairs in joint training with the Departmental Joint Technical Committee on Youth and Sports of 16 April 2010;
Considering the advice of the Single Departmental Joint Technical Committee of the Ministry of Economy, Finance and Employment and the Department of Budget, Public Accounts and Public Service of April 1, 2010;
The State Council (Section of Administration) heard,

By derogation fromarticle 2 of the decree of 28 May 1982 referred to above, a ministerial-level technical committee shall be established with the Minister of Labour to hear, under heading III of the same decree, matters of interest to all central and decentralised services under the exclusive authority of the Minister or under the joint authority of the Minister and another Minister, with the exception of the ministers referred to in section 5.

The number of members of the Technical Parity Committee established pursuant to section 1 is as follows:
1° Representatives of the administration: fifteen incumbent members and fifteen alternate members;
2° Staff representatives: fifteen incumbent members and fifteen alternate members.
The composition of this committee shall be determined by order of the Minister for Labour.

By derogation fromarticle 3 of the decree of 28 May 1982 referred to above, it is established, with the Director of General Administration and Modernization of Services under the Minister of Labour, a central technical committee responsible for knowing, within the framework of Title III of the same Order, issues of interest to central services under the exclusive authority of the Minister or under the joint authority of the Minister and another Minister, with the exception of the ministers referred to in Article 7.

In application of thearticle 17 of the decree of 28 May 1982 referred to above, the departmental Joint Committees referred to in Articles 1 and 5 of this Order shall meet in joint training to examine the statutory rules relating to the common bodies of these departments and the organizational and operational matters common to them.

For the establishment of each of the ministerial technical committees referred to in articles 1 and 5 of this decree, the following are consulted:
1° Holding and non-binding officers in a service under the authority of either of the ministers referred to in Articles 1 and 5 to which the departmental technical committee is placed;
2° Officials who hold the State in one of the administrative public institutions under the supervision of one of these ministers and who belong to a body whose management is the responsibility of that minister;
3° Contractual public law officers of regional health agencies.
Agents performing their duties in a joint service or in a public administrative department or institution under the joint authority or guardianship of several ministers are consulted only for the establishment of the departmental technical committee placed with the Minister in charge of their management.
In addition, incumbents in normal position of activity and non-responsive agents Decree of 17 March 1978 assigned to the General Delegation for Employment and Vocational Training are consulted for the establishment of the Departmental Joint Technical Committee established with the Minister for Labour pursuant to section 1 and the incumbents made available to departmental houses of persons with disabilities for that of the Departmental Joint Technical Committee placed with the Minister in charge of the management of the body to which they belong.

For the establishment of each of the Central Joint Technical Committees referred to in Articles 3 and 7 of this Order, the officers performing their functions in one of the central administration departments under the authority of one of the Ministers concerned shall be consulted.
Officers in a central administration department under the joint authority of several ministers are consulted only for the establishment of the central technical committee to deal with issues relating to central services under the authority of the Minister in charge of their management.

Until the establishment of the parity technical committees established by this decree, which will intervene no later than 31 December 2010, the parity technical committees referred to in Articles 1 to 4 of the above-mentioned decree of 19 December 2008 shall remain competent to hear matters for which they were established.
The term of office of their members is, as necessary, extended until the same date.
The term of office of the members of the Joint Technical Committees referred to in the 3rd and 4th of Article 5 of the same decree, which are established in the Ile-de-France and in the overseas territorial authorities, is also extended by 31 December 2010.

The Decree No. 2002-1453 of 13 December 2002 establishing the Departmental Joint Technical Committee on Youth and Sports is repealed on the date of the establishment of the Joint Technical Committees established by this Order.
