Judgment of December 28, 2009 setting out the terms and conditions for organizing the certificate of fitness for faculty of physical and sport education

The external competition, the internal competition and the third competitive examination for teachers of physical and sport education to obtain the certificate of fitness for faculty of physical and sport education, instituted by the decree of 4 August 1980shall be organized in accordance with the provisions of this Decree.

The number of places offered to the external, internal and, where applicable, the third contest and the closing date of the registration registers are fixed by order of the Minister responsible for education, after the Minister responsible for the public service, in accordance with the conditions set by the Minister responsible for educationarticle 2 of the decree of 19 October 2004 referred to above.
The opening date of the sessions, the terms and conditions of registration and the centres in which the tests are undergoing are fixed by order of the Minister responsible for education. Applicants are required to register under the conditions and time limits set by these Orders.

The external competition includes two eligibility tests and two admission tests.

The description of each of the external and internal examinations and of the third competition is set out in annexes I, II and III to this Order.

For each competition, when the admission examinations involve the realization of one or more physical benefits, the candidates must give the jury, before the intake examination begins, a medical certificate, dating from less than four weeks, from non-indication to the practice of physical, sporting and artistic activities in which they must perform a physical performance. Candidates are not allowed to perform physical benefit in an activity for which they did not produce the required medical certificate. The choice of the sport activity formulated during the registration cannot, in any case, be changed after the closing date of the registration records.

A jury is established for each external, internal and third competition. However, a jury may be common to the external competition and the third competition.

Each jury includes a chair and, as appropriate, one or more vice-presidents appointed by the Minister of Education, on the proposal of the Director of Teachers' Staff. They are selected from the Inspectors General of National Education, the Academy Inspectors-Regional Educational Inspectors and the Research Teachers.

Members of the jury, appointed by the Minister for Education, are selected, on the proposal of the President, from among the Inspectors General of National Education, the inspectors of academies and regional educational inspectors, the management staff of educational institutions or training under the Minister for Education, the members of the higher education teachers' bodies, the Associate professors, the teachers of physical and sports education,
Juries may also include persons chosen according to their specific skills.

When the chair of the jury is unable to continue his or her mission, a vice-president or other member of the jury belonging to one of the categories of officers referred to in section 9 shall be appointed without delay by the Minister on the proposal of the director for teachers to replace him.

The chair, vice-chairs or members of the jury may not participate in more than four consecutive sessions. On an exceptional basis, their mandate may be extended for one session.

The subjects of the written examinations are chosen by the Minister for Education on the proposal of the President of the jury.
They are established taking into account the existing educational programs in the colleges and high schools.

When the jury is in groups of examiners, each group includes at least two examiners, without being able to exceed three examiners on average for all groups of this jury. For the same test, each group consists of the same number of examiners throughout the session.

The tests are rated from 0 to 20. For all tests, the zero mark is eliminated. When a test has multiple parts, the zero rating obtained from either of the parties is eliminated.

The failure to participate in a trial or part of a trial, to present itself late after the opening of the envelopes containing the subjects, to render a blank copy, to omit to render the copy at the end of the trial, not to respect the choices made at the time of registration or not to hand over to the jury a record or report or any document to be provided by the candidate within the time and in the manner prescribed for elimination of the contest

Written examinations of candidates are made anonymous before being subjected to a double correction.
Following the completion of the proof of eligibility, the jury, after deliberation, sets out the list of candidates admitted to the examinations.
The anonymity of the trials is only lifted after the jury's deliberation. At the end of the admission examinations and after deliberation, the jury, depending on the total number of points that the candidates obtained at all the two rounds of tests and within the limits of the contested places, sets out in order of merit the list of candidates he proposes to the Minister responsible for education for admission to the contest.
The Minister for Education, in order of merit, determines the list of candidates declared admitted to the competition.

If several candidates have obtained the same number of points, they are departed as follows when the admission list is established:
1° For the external contest:
The priority is given to the one who obtained the highest rating in the second admission test; in the event of equality of points in the second admission test, the priority is given to the candidate who obtained the best score in the first written eligibility test; if equality remains, they are departed by the best score obtained at the first admission test.
2° For the internal competition:
The priority is given to the one who obtained the highest rating in the admission test.
3° For the third contest:
The priority is given to the one who obtained the highest rating in the admission test; in the event of equality of points to this test, the priority is given to the candidate who obtained the best rating in the eligibility test.

In the tests, candidates are prohibited:
1° Introduce any document, note or material not authorized by the jury of the contest;
2° To communicate with each other or receive information from the outside;
3° To leave the room without authorization from the responsible supervisor and without being accompanied by another supervisor;
4° To disrupt by their behaviour the proper conduct of the trials.
Applicants must lend themselves to the necessary monitoring and verification.

Any infringement of the regulations, fraud or attempted fraud that has been duly recognized results in the exclusion of the contest, without prejudice to the application, if any, of the criminal provisions provided for in the Act of 23 December 1901 punishing fraud in public examinations and examinations and the possible disciplinary penalty if the candidate is already in the service of an administration. The same measure may be taken against the accomplices of the main perpetrator of fraud or attempted fraud.
No immediate sanction is taken in the event of a flagrant offence. The responsible supervisor shall prepare a report that the academy rector shall transmit to the Minister for Education.
No decision can be made without the individual being summoned and put in a position to present his defence.
The exclusion of the contest is pronounced by the Minister responsible for education, on the proposal of the president of the jury.
The reasoned decision is notified without delay to the person concerned by registered letter with acknowledgement of receipt.

Any suspicious copy appearing in the course of correction is reported by the corrector to the president of the jury. In the event of a recognized fraud, the author is excluded from the competition under the conditions set out in the last three paragraphs of Article 20.

    A N N E X E I
    EXTERNAL CAPEP CONCOURS
    A. ― Written proof of eligibility


    1° Dissertation on the sociohistorical and epistemological foundations of physical education.
    The purpose of the test is to assess the ability of the future teacher to place his/her professional action in relation to the permanences and transformations of physical education, under the influence of endogenous and exogenous determinants of the education system.
    Duration: five hours; coefficient 2.
    2° Dissertation or case study on the teaching of physical and sports education using knowledge relevant to the human and social sciences and, among them, the sciences of intervention, the sciences of life and the technical and technological fields specific to the physical activities of sports and art, the institutional fields.
    The purpose of the test is to assess the ability of the future teacher to mobilize the scientific, technical and professional knowledge necessary to understand the conditions of teaching and learning, in order to promote the acquisitions of students in the context of the implementation of the second degree physical and sports education programs.
    Duration: five hours; coefficient 2.
    The program of these two events is set annually and published in the Official Bulletin of the Ministry of National Education.


    B. ― Admission test


    1° Physical benefits and speciality lesson:
    Total duration of the test: three hours (cumulative duration of physical benefits: sixty minutes; duration of the presentation: one hour; oral duration: one hour).
    Duration of the speciality oral: one hour (exposed: fifteen minutes maximum); maintenance: a maximum of forty-five minutes, including a maximum of fifteen minutes for the second phase; coefficient 4.
    The test consists of three physical benefits and a special maintenance. The lesson presented by the candidate during the speciality maintenance must meet the training needs for a unique group of students. This group is defined by a class level, a level of practice, characteristics observed in the practice of sports and artistic physical activity (APSA) retained by the candidate.
    The purpose of the test is, on the one hand, to assess the level of performance of the candidate in two APSAs among those listed in the contest program list and on the other, to assess the level of technical, educational and scientific expertise of the future teacher who tries to solve the problem posed in the statement of the initial question support of the special lesson.
    Each part of the test counts for half in the award of the score.
    Physical benefits:
    The three physical benefits are carried out in three APSAs listed in the competition program, one comes from a speciality list and the other two from the versatility list. The activities selected for the three benefits must be matched by two specific competencies (CPs) at the different SEPs among the four specific competencies selected for this test: CP 1, CP 2, CP 3, CP 4. In no case does it fall within the jurisdiction of CP 5. The APSA lists are stopped for two years and are renewable or editable for part. They are published in the National Education Bulletin.
    In order to achieve the three physical benefits, the candidate chooses, at the time of registration to the contest, an APSA in each of the four first physical and sport education skills identified in the disciplinary programs (CP 1 to CP 4).
    Among these four APSAs, he holds one as a specialty activity, the other three forming the support of the jury's draw for the second and third physical performance. The APSAs drawn by lot are notified to the candidate in his roadmap, at the time of the reception of the candidates by the jury president.
    The evaluation of each physical benefit is carried out, according to the relevant ASAs, either by means of a scale when performance is directly measurable and quantifiable, or by using a repository when performance is valued and judged.
    At the end, the candidate's performance of the two versatility benefits, only the lowest benefit rating is retained.
    The final score of physical benefits is the average between the speciality physical benefit rating and the lowest degree of versatility benefit.
    Specialty maintenance:
    Only the specialty service is associated with an oral question, composed of a lesson presentation followed by an interview with the jury.
    The question asked by the jury and the documents provided, written, photographic or video, lead the candidate to found and present his answer in the form of a speciality lesson. The candidate must be able to analyze the activity of the students, propose one or more learning situations to solve the problem posed by the question and justify his or her choices. It must also demonstrate its ability to use a framework for reflection that allows the continuity or rupture of its responses during the two phases of maintenance.
    Based on the lecture, the interview appreciates the level of scientific, technical, educational and institutional knowledge control available. It consists of two phases:
    A phase of interrogation aimed at deepening the candidate's response to the initial question, defined by his APSA, his level of students by a type of problem to be solved. It can extend, as much as necessary, to the different levels of practice encountered in second-degree teaching.
    During the second phase of the interview, the questioning is extended to all or part of the SAPs within the SAP's specific competence to which the activity of the presentation is linked. In this second time the interview allows the candidate to show his ability to use a framework of reflection articulated in continuity or rupture, with that retained in the answer to the initial question.
    2° Test with two parts: 14 points are assigned to the first part and 6 points to the second (out of physical benefit: preparation of the two questions: two hours; duration of the test: one hour thirty minutes; coefficient 4).
    Part I: Physical and sport education lesson referring to college and high school EPS programs, declined in a setting and organized by an EPS educational project (exposed: 20 minutes maximum); maintenance: 50 minutes maximum).
    The purpose of the test is to verify the level of mastery of the teaching, teaching and scientific knowledge of the future teacher in order to propose a lesson of SEP in a context of establishment and for a population of students, with a view to acquiring skills, referred to in the teaching programs. The institution is represented by the priorities identified in the project, its academic results, its educational project of EPS and finally its project as a sports association. The population of the class concerned is defined by its EPS skills, especially in the physical and sports activity concerned by the lesson, its previous experience, but also by the singular attitudes of the students and their academic results.
    The presentation is based on a question asked by the jury, based on an institution file presented as a written, photographic and/or audiovisual document. The second degree teaching context is provided by the jury, physical, sports or artistic activity; institutional projects, physical and sport education project, sports association project; class project or group of students; characteristics of students; programming of activities of the class or group of students.
    The APSA lesson support cannot be drawn from the three SEP-specific skills already selected for the first admission test (selected activity on the one hand, random activities on the other); It therefore belongs to one of the two remaining clean skills among the five that exist in EPS.
    Part II: The test consists of an interrogation concerning the competence "to act as a state official and ethically and responsibly" (presentation: ten minutes, interview with the jury: ten minutes).
    Based on a question previously asked by the jury during the preparation phase, the candidate made a presentation of a maximum of ten minutes, followed by an interview of up to ten minutes.
    The question is put on the basis of a document provided by the jury on the topics grouped around the defined knowledge, abilities and attitudes, for the above-mentioned competence, in item 3 of the annex to the Order of December 19, 2006: "The professional skills of the masters". The question and answer are located in the context of the establishment file used for the SPS lesson.
    The objective of the test is to assess the candidate's ability to translate into professional acts in the logic of the EPLE and in accordance with existing regulations, his response to the initial question.
    The presentation continues with an interview with the jury for ten minutes.

    OVERVIEW OF THE CAPEP CONCOURT
    A. ― Written proof of eligibility


    Composition relative to the teaching of physical and sports education, in relation to the professional experience acquired by the candidate in the discipline.
    The event draws on the candidate's knowledge of physical, sporting or artistic activities, the teaching of physical and sports education, its curriculum, its organization and its implementation in the second degree.
    The event is based on a two-year program that relates to the high school and college program.
    Duration: four hours; coefficient 2.


    B. ― Oral Intake Test


    Analysis of an educational situation.
    This test includes a presentation followed by an interview; It focuses on an experience of organizing the teaching of physical and sport education in a second degree institution.
    The test is based on a file made by the candidate. The dossier focuses on an organizational experience of physical and sport education in a college or high school and includes, in addition, two sequences of teaching carried out or observed in one or more classes of the level of education (collège or high school) chosen by the candidate and based on two distinct physical activities chosen for each in two different groups of activities in reference to the programs of discipline in high schools and colleges.
    A program valid for two years sets the list of activities that can be used as a support for the two teaching sequences: this list cannot exceed sixteen activities and is based in accordance with the programs of discipline on the reality of the most commonly taught activities in colleges and high schools.
    The jury chose to question the candidate on one or more of the elements of the file.
    The file, typed, includes elements related to regulation, didactic and pedagogy that justify the implementation of this teaching, as well as the preparation of lessons learned and teaching content. In addition, it has three summary notes, not exceeding two typed pages each, and corresponding, respectively, to the organizational experience of physical and sport education and to each of the teaching sequences presented. The entire file, the three summary notes included, must not exceed twenty typed pages.
    Eligible candidates must submit, by post, their file, including the three summary notes, to the jury chair under the conditions and time limits set by the jury. Failing to send the file to the jury within the time and manner set out in this article results in the removal of the candidate.
    The interview is based on the chosen educational situation: it covers the technical and educational aspects of the chosen activity and is extended to other aspects of the candidate's professional experience.
    The file and the summary notes do not give rise to a rating, only the presentation and maintenance are noted.
    Preparation duration: two hours.
    Duration of the test: one hour maximum fifteen minutes (exposed: thirty minutes; maintenance: up to 45 minutes; coefficient 2.

    The two admission tests must also allow the candidate to demonstrate that he or she has reflected on the contribution that his or her professional experience constitutes for the exercise of his or her future profession and in his or her relations with the school institution, integrating and enhancing the achievements of his or her professional experience and knowledge in his answers to the questions of the jury.
