Order of December 9, 2009 establishing a financial services centre within the management of staff and the adaptation of the professional environment

Minister of Economy, Industry and Employment and Minister of Budget, Public Accounts, Public Service and State Reform,
Vu le Decree No. 87-389 of 15 June 1987 modified for the organization of central administration services;
Vu le Decree No. 2006-948 of 28 July 2006 creating a staff management and adaptation of the professional environment in the Ministry of Economy, Finance and Industry;
Having regard to the amended decision of 10 December 2001 to establish a revenue and advance authority with the staff, modernization and administration of the Ministry of Economy, Finance and Industry;
Having regard to the amended decision of 28 July 2006 on the organization of staff management and adaptation of the professional environment;
In view of the amended decision of 18 December 2007 setting out the accounting designation of expenditures and revenues on the departmental budget and accounting controller placed with the Ministry of Economy, Finance and Employment and the Department of Budget, Public Accounts and the Public Service;
Considering the advice of the Central Joint Technical Committee of the Central Administration of the Ministry of Economy, Industry and Employment and the Ministry of Budget, Public Accounts, Public Service and State Reform of 9 December 2009,

It is created, within the management of staff and the adaptation of the professional environment, a financial benefit centre, directly placed with its director.

I. ― On behalf of the central departments of the Ministry of Economy, Industry and Employment and the Ministry of Budget, Public Accounts, Public Service and State Reform and, where appropriate, independent national and administrative authorities under the said ministries, as described below as prescriptor services, the Financial Services Centre is designed to provide budgetary and financial activities in the following areas:
1° Assistance in budgetary planning and programming;
2° Participate in the exercise of the function of a non-taxable expense and revenueordinator, and followed by them;
3° Capital management.
The effective management of these budgetary and financial activities shall, for each budget or prescriptive service program concerned, result in the signing of a service contract between the Director of Staff and the adaptation of the professional environment and the authorities or heads of service concerned. This document sets out the specific nature of the insured benefits, including those related to the exercise of the duties of the insurer, as well as the respective obligations of the service provider and the service prescriptors and the conditions under which the performance of such benefits is reported.
These service contracts and the list of prescriptive services are published.
II. ― On behalf of the program manager concerned, the Financial Services Centre operates the budgetary program's "conduct and management of economic and financial policies".
III. ― The Financial Benefits Centre operates the management of the internal accounting control system of the staff management and the adaptation of the professional environment, as part of the departmental and management action plans.
IV. ― On behalf of the fact-finding service in the Departmental Budgetary and Accounts Service, the Financial Services Centre may carry out transactions not directly related to the performance of the accounting function, including administrative registration transactions related to claims for payment.
V. ― Employee management advances and revenues and adaptation of the professional environment are placed at the Financial Benefits Centre.
VI. ― The Financial Benefit Centre ensures the quality of the procedures it implements for the performance of its missions.

The financial benefit centre is composed of four poles, which can be organized in sectors.



The "Help to Pilotage and Programming" Pole


It is responsible for producing the necessary analytical elements for the definition and monitoring of budgetary programming carried out by budgetary officials.
It ensures the return of information relating to the monitoring of budget programming and the execution of expenditures and revenues with respect to prescriptor services.


The Management Pole


He is responsible for the financial performance of the purchase or grant decisions of the prescriptor services, in conjunction with the fact-finding service referred to in Article IV. The organization of work between the Financial Benefit Centre and the FIF service is specified in a service contract co-signed by the Director of Personnel and the Adaptation of the Professional Environment and the Departmental Budget and Accountant; where appropriate, this document refers to the operations referred to in IV above.
He is responsible for the financial performance of non-tax revenues.
For investment expenses, it is responsible for updating the asset accounting.
It participates in the end-of-management work and ensures the return of information relating to acts relating to the execution of expenses and revenues against prescriptor services.
The directors of advances and revenues referred to in Article 2 V are attached to it.


The "Program Driver"

It is responsible for the budgetary synthesis of this programme.
Under the authority of the program manager and in consultation with the operational budget managers, he coordinates the development and monitoring of the implementation. It also coordinates the work of operational budget managers on performance measurement and management control; it monitors the results.


The "Transverse Affairs" pole


In addition to managing general cases, the Office is responsible for the quality of internal procedures and the monitoring of the activities of the Financial Benefits Centre.
It ensures the implementation of the accounting internal control system for the management of staff and the adaptation of the professional environment.

The provisions of this Order come into force on 1 January 2010.

The Secretary General and the Director of Personnel and the Adaptation of the Professional Environment are responsible, each with respect to him, for the execution of this Order, which will be published in the Official Journal of the French Republic.
