Given the Labour Code, including its article L. 2261-15 ;
In view of the decree of 10 July 1991 and the successive decrees, including the decree of 27 October 2008, extending the collective agreement of the metallurgical industries of Valencien and Cambrésis of 13 July 1990 and the texts supplementing or modifying it;
Having regard to the admission of 30 June 2009 to the agreement of 9 July 1992 on annual guarantees, concluded under the above-mentioned collective agreement;
Having regard to the date of June 30, 2009, concerning the value of the point and the night basket bonus, to the aforementioned collective agreement;
Considering the request for extension submitted by signatory organizations;
Considering the opinion published in the Official Journal of 9 September 2009;6
Considering the opinions collected during the investigation;
In view of the reasoned opinion of the National Collective Bargaining Commission (subcommission of agreements and agreements), collected in accordance with the procedure provided for in Article R.R. 2261-5 of the Labour Code,
Stop it!
For all employers and employees included in the scope of the collective agreement of the metallurgical industries of Valencien and Cambrésis of 13 July 1990, as extended by the order of 10 July 1991, as amended by the date of 3 July 1995, and excluding the repair of electrical appliances for the household not associated with a sales store, the provisions of:
―the Act of 30 June 2009 to the Agreement of 9 July 1992 on Guaranteed Annual Compensation, entered into under the above-mentioned collective agreement, subject to the application of provisions of Article L. 2241-9 of the Labour Code which provides that the annual wage bargaining is also intended to define and programme measures to eliminate the pay gap between women and men by 31 December 2010;
― the date of June 30, 2009, relating to the value of the point and the night basket bonus, to the aforementioned collective agreement, subject to the application of provisions of Article L. 2241-9 of the Labour Code which provides that the annual wage bargaining is also intended to define and programme measures to eliminate the pay gap between women and men by 31 December 2010.
The extension of the effects and sanctions of the above-mentioned amendments shall be made on the date of the publication of this order for the remaining period of time and the conditions provided for by the said amendments.
The Director General of Labour is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
