President of the Republic,
On the report of the Prime Minister and the Minister for Foreign and European Affairs,
Seen them Articles 52 to 55 of the Constitution ;
Vu le Decree No. 53-192 of 14 March 1953 amended on the ratification and publication of international commitments undertaken by France;
Vu le Decree No. 77-527 of 13 May 1977 publishing the cultural agreement between the French Republic and the Libyan Arab Republic, signed in Tripoli on 22 March 1976,
Decrete:

Article 1


The agreement on cultural, scientific and technical cooperation between the Government of the French Republic and the Great Socialist People's Libyan Arab Jamahiriya, signed in Paris on 19 April 2004, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign and European Affairs are responsible for the execution of this decree, which will be published in the Official Journal of the French Republic.



A C C O R D


CULTURAL, SCIENTIFIC AND TECHNICAL COOPERATION BETWEEN THE GOVERNMENT OF THE FRENCH REPUBLIC AND THE GREAT LIBYAN AREA
The Government of the French Republic and the Great Socialist People's Libyan Arab Jamahiriya wishing to promote cooperation between the two countries in the fields of education, culture, science, administration, economy, environment and the valorization of historical and natural heritage,
Attached to the strengthening of friendship between the two countries on the basis of mutual respect and considering the cultural agreement signed in Tripoli on 22 March 1976,
agreed on the following:


Article 1


The two countries agreed to strengthen and extend their cooperation in the areas of education, science, technology, culture, training of managers to contribute to a deeper understanding of their respective civilizations and cultures and the development of their human resources.


Article 2


Recognizing the importance of the role of the Cultural Centres in disseminating the culture, the arts and the language of the other country, both parties are working to encourage the creation of a Libyan Cultural Centre in Paris and the development of the activities of the French Cultural Institute in Tripoli.
Both sides are committed to working in this direction without delay.


Article 3


Each of the two parties encourages in its own education system the study of the language and culture of the other party through, inter alia, adapted programs within public secondary and higher education institutions and cultural institutes in both countries.


Article 4


The two sides are committed to strengthening existing cooperation between organizations and institutions of secondary and higher education, academic institutions, research and vocational, cultural and artistic training in the fields of theatre, music and plastic arts, within the framework of joint programmes.
In order to implement this cooperation and to provide their support to the formation of elites in the productive and administrative sectors, the two parties offer missions and invitations of teachers, researchers, experts and artists respectively.
These different areas of cooperation can also be the subject of meetings, seminars and seminars in both countries.


Article 5


The two parties offer each year, to the extent of their budgetary availability, scholarships and training or research courses to students, researchers, teachers, academics, artists.
Desiring to broaden the framework of the existing university cooperation between the two countries and to promote their respective higher education systems, to ensure the best conditions for students in the other country, the two parties agree to form a "Joint Higher Education and Scholarships Commission" to define the priorities of academic cooperation and the selection of scholarships in terms defined by a common agreement.


Article 6


Both parties encourage the establishment under this Convention of cooperation agreements in the field of scientific and technical needs between universities and research centres in both countries to facilitate and strengthen student exchanges and expert missions.


Article 7


Both parties encourage the organization of scientific, artistic and cultural exhibitions as well as the holding of congresses, scientific, literary and educational seminars and the invitation of specialists in these different fields.
They facilitate school exchanges and youth delegations in institutes, universities and other organizations through travel, visits and the organization of cultural and educational events.


Article 8


Both parties agree to promote cooperation between museums, libraries, historical archives, publishing houses, as well as the exchange of reference books, books, journals, publications, scientific and literary works and encourage the translation of books from the other country.


Article 9


Both parties encourage audio-visual cooperation in the areas of radio, satellite television and cinema through exchanges of television films and cultural, scientific and educational broadcast programs as well as between the press agencies.
They are particularly interested in training staff on new technologies and training journalists.


Article 10


Aware of the importance of paleontological, archaeological wealth, including in the submarine and historical environments that they possess, and of the importance of their preservation and development, both parties strive to strengthen cooperation in the field of heritage development.
In this context, both parties encourage the strengthening of cooperation between museums, archaeological services and historical archives. They exchange specialists in this area.


Article 11


Wishing to transmit to future generations a preserved and convinced living environment of the importance of natural heritage - and particularly Mediterranean - common to both parties, they decide to make the environment a new axis of cooperation. Priority is given for controlled water resources management. Both parties strive to bring together the positions expressed within the regional and international bodies concerned with the environment of which they are members, exchange their experiences and promote contacts between environmental experts in both countries.


Article 12


The authorities of both countries will facilitate, within the framework of the regulations in force, obtaining visas for the persons and students concerned by this Agreement.


Article 13


A joint, cultural, scientific and technical commission, made up of representatives from both countries, is responsible for defining the main priorities of bilateral cooperation, guiding its actions, establishing and coordinating the programmes, defining the implementation plan and monitoring the implementation of this agreement.
This commission meets at least once every three years alternately in Paris and Tripoli, unless the two parties wish to meet before this deadline.


Article 14


This Agreement shall be valid for a period of five years renewable by tacit renewal for the same period if one of the two parties has not notified the other party of its intention to amend or denounce it with a notice of at least three months before its expiry.


Article 15


Each Contracting Party shall notify the other of the fulfilment of the constitutional procedures required for the entry into force of this Agreement, which shall take effect on the first day of the second month following the day on which the second notification is received.
Done in Paris on 19 April 2004, in duplicate, in French and Arabic, both texts being equally authentic.
