Considering the European Agreement No. 69 of 12 December 1969 on the maintenance of the payment of scholarships to students pursuing their studies abroad;
Given the education code, including its book VIII and its article L. 821-1 ;
Vu le Decree No. 87-155 of 5 March 1987 relating to missions and the organization of academic works;
Vu le Decree No. 97-34 of 15 January 1997 amended on the deconcentration of individual administrative decisions, including article 2;

Decrete:
Higher education grants on social criteria and specific aids may be granted to students in higher education institutions who fall within or part of Book VII of the Education Code and are placed under the guardianship or educational control of the Ministry responsible for culture.
Scholarships on social criteria are awarded to students who meet the conditions of study, age, residence and nationality set by order of the Minister for Culture and the conditions of resources set by joint order of the Minister for Budget and the Minister for Culture.
The joint order in the first paragraph also sets the rates of scholarships, depending on the nature of the training followed, as well as the resources, expenses and geographical origin of the student and his or her family.
Specialized education allowances are instituted by an order of the Minister responsible for culture that sets out the amount and conditions of study, age, diploma, residence and nationality.
These grants are not cumulative with socially-based scholarships.
The Minister for Culture determines by order the conditions under which may also be allocated:
(a) Financial aids to national and international mobility;
(b) Helps to purchase educational materials;
(c) Emergency assistance to students in difficulty.
It is decided on the requests for scholarships or specific assistance from students enrolled in public institutions of the State, other than Villa Arson, the Ecole nationale supérieure de la photographie and the Ecoles nationales supérieure d'art de Bourges, Cergy, Dijon, Limoges-Aubusson and Nancy, by decision of the directors of these institutions. The decision on other applications is made by the regional prefect after consultation with the director of the educational institution.
The provisions of the first paragraph apply to applications for the maintenance of scholarships and grants based on Article 3 of the European Agreement referred to on 12 December 1969.
A Minister of Culture Order sets out the award and payment procedure for scholarships and grants. A convention between the Ministry of Culture and the National Centre for Academic and Academic Works can mandate the regional centres of academic and academic works to instruct scholarship applications.
The provisions of Articles 1 to 5 come into force from the academic year 2009-2010.
The provisions of this Decree, with the exception of those conferring jurisdiction to the regional prefect provided for in Article 5, may be amended by decree.
The Minister of Culture and Communications and the Minister of Budget, Public Accounts and Public Service are responsible, each with respect to it, for the execution of this Order, to be published in the Official Journal of the French Republic.
