Judgment of 12 January 2009 approving the merger with a portfolio transfer of membership bulletins to regulations and contracts of pension institutions

Vu le Social Security Codein particular Article L. 931-16;
Considering the application by Réunica Foreseeance, institution of foreseeance whose head office is located 154, rue Anatole-France, 92500 Levallois-Perret, and Bayard Foreseeance, institution of foreseeance whose head office is located 154, rue Anatole-France, 92500 Levallois-Perret, for the approval of the transfer, by way of fusion-absorption, with their rights
In view of the deliberation of 9 September 2008 of the General Assembly of the Bayard Provident Institution;
Considering the deliberation of 23 September 2008 of the General Assembly of the Reunica Provident Institution;
Considering the opinion published in the Official Journal of 9 November 2008 inviting creditors of the institutions concerned to submit their comments on the proposed transfer;
Considering the solvency certificate of 15 December 2008 issued by the Insurance and Mutual Control Authority;
Given the supporting documents, including the merger treaty,

Is approved the transfer, by means of fusion-absorption, under the conditions provided for inArticle L. 931-16 of the Social Security Code, with their rights and obligations, from the portfolio of newsletters to the regulations and contracts of the Bayard Provident institution Provided for the benefit of the Reunica Provident institution.

Article 2


The Director of Social Security is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
