Considering the education code, including its article L. 711-1;
Vu le Decree No. 2000-1264 of 26 December 2000 setting out the conditions under which public institutions of a scientific, cultural and professional character can take participation and create subsidiaries;
The State Council (inland section) heard,
Decrete:
The above-mentioned decree of 26 December 2000 is amended in accordance with articles 2 to 7 of this decree.
Section 1 is amended as follows:
1° In the first paragraph, the words: "In the conditions set out in the sixth paragraph" are replaced by the words: "In application";
2° In the second paragraph, the words "may be" are replaced by the word "is".
The second paragraph of section 2 is replaced by the following provisions:
"This deliberation is subject to the approval of the academy rector, chancellor of universities, and the territorially competent treasurer-payer-general, or, for the institutions that are directly attached to it, the minister responsible for higher education and the budgetary and departmental accountant."
Section 3 is amended as follows:
1° In the first paragraph, the words "to these two ministers. Each of the receiving ministers is replaced by the words: "to the rector of academy, the chancellor of the universities, and to the treasurer-payer-general of the region or, for the institutions that are directly attached to it, to the minister responsible for higher education and to the budgetary and departmental accountant who acknowledge their receipt";
2° In the second paragraph, the words: "Ministers" are replaced by the words: "the academy rector, the university chancellor, and the region's treasurer-payer-general or, for institutions that are directly attached to it, the minister responsible for higher education and the fiscal and departmental accountant controller" and the words: "one of the ministers" by the words: "the rector of academy, chancellor of universities
3° In the third paragraph, the words: "the Minister responsible for higher education or the Minister responsible for the budget" are replaced by the words: "the rector of academy, chancellor of universities, or the treasurer-payer-general of the region or, for the institutions that are directly attached to it, the Minister responsible for higher education or the budgetary and departmental accountant".
In the third paragraph of Article 4, the words: "in the conditions set out in the sixth paragraph of Article L. 711-1 of the Education Code" are deleted.
In the first sentence of Article 5, the words "defined in the sixth paragraph" are replaced by the words "available from activities defined in the eighth paragraph".
In the second paragraph of section 6, the last sentence is replaced by the following sentence: "The academy rector, university chancellor, and the territorially competent regional treasurer-payer-general or, for the institutions that are directly attached to it, the Minister for Higher Education and the budgetary and departmental accountant controller may communicate this report. »
The Minister of Higher Education and Research and the Minister of Budget, Public Accounts and Public Service are responsible, each with respect to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
