Order of 14 December 2007 with the approval of Apave Group for tanks and multi-element gas containers for the transport of dangerous goods and hoses

Minister of State, Minister of Ecology, Development and Sustainable Development,
Considering the 1974 International Convention for the Protection of Human Life at Sea (SOLAS 74) as amended, including the International Maritime Code of Dangerous Goods (IMDG Code);
Considering Act No. 263 of 5 February 1942 on the transport of dangerous substances;
Vu la Act No. 83-581 of 5 July 1983 modified on the safeguarding of human life at sea, the habitability on board ships and the prevention of pollution;
Vu le Decree No. 84-810 of 30 August 1984 modified to safeguard human life at sea, habitability on board ships and prevent pollution;
See?Decree of 23 November 1987 amended on the safety of ships, including Division 411 of its annexed Regulations on the carriage by sea of dangerous goods in packages;
Having regard to the amended decision of 1 June 2001 on the transport of dangerous goods by road, said "ADR order";
Having regard to the amended decision of 5 June 2001 on the transport of dangerous goods by rail, says "R RID Order";
Considering the application, dated 14 September 2007, of Apave Groupe, 191, rue de Vaugirard, 75738 Paris Cedex 15;
In view of the opinion of the Inter-Ministerial Commission on the Transport of Dangerous Goods in its session of 27 November 2007,

Article 1


Under Article 38, paragraph 3, of the ADR Order, Article 30, paragraph 2, of the RID Order and Article 411-6.02 of Division 411 referred to above, Apave Group has the status of an approved body to issue certificates of type of portable tanks provided for in 6.7.2.18.1, 6.7.3.14.1 and 6.7.4.13.1 of the ADR Order, In this context, Apave Group is empowered to act and decide in place of the competent authority under the conditions set out in section 411-6.02 of Division 411.

Article 2


Under paragraph 3 of Article 38 of the ADR Order, paragraph 2 of Article 30 of the RID Order and under Article 411-6.08 of Division 411 referred to above, Apave Group has the status of an approved body to issue the type approval certificates of the multi-element gas containers (CGEM) provided for in 6.7.5.1DG1.1 of the ADR Order, of the IM and In this context, Apave Group is empowered to act and decide in place of the competent authority under the conditions set out in section 411-6.08 of Division 411.

Article 3


Apave Group is a registered body, under section 411-6.05 of Division 411 referred to above, to issue certificates of IMO 4, 6 and 8 road tank vehicles provided for in 6.8.3.1.3.2, 6.8.3.2 and 6.8.3.3.3.2 of the IMDG Code. In this context, Apave Group is empowered to act and decide in place of the competent authority under the conditions set out in section 411-6.05 of Division 411.

Article 4


Article 38, paragraph 6, of the ADR Order, Article 30, paragraph 5, of the RID Order and Article 411-6.09 of the above-mentioned Division 411, Apave Groupe has the status of an approved body to issue the initial, periodic or exceptional inspection certificates of the "IMO" and "UN" type portable tanks as well as of the CGEM at the end of the inspections.19 and These inspections and tests are carried out under the conditions set out in section 411-6.09 of Division 411.

Article 5


Apave Group is an expert approved under 6.8.2.4.5 and 6.8.3.4.16 of ADR and RID Orders.

Article 6


Apave Group is a registered body under Article 30, paragraph 3, of the ADR Order.

Article 7


Apave Group is an expert approved under paragraphs 3.1 (4), 4 and 5.2 of Appendix D.1 of the ADR Order.

Article 8


Apave Group is a registered body under paragraph 2.6 of Annex D. 8 of the ADR Order.

Article 9


Pursuant to Article 39 of the ADR Order, the regional directorates of industry, research and the environment (DRIRE) control the activity of Apave Groupe in relation to Articles 5 to 8.

Article 10


Apave Groupe shall, in order to carry out the operations resulting from this approval, comply with the terms and conditions set out in the procedures established in this regard by its care and transmitted to the Minister for Transport and to the Minister for the Merchant Navy.

Article 11


Apave Groupe is required to observe the procedures for the application of the regulatory provisions notified to it by the Minister for Transport or by the Minister for Shipping.

Article 12


This approval may be withdrawn, suspended or restricted in the event of a serious breach of the obligations established by this Order, by the above-mentioned ADR and RID Orders or by the amended dated 23 November 1987 concerning the safety of ships in accordance with the provisions of Articles 39 of the ADR Order, 31 of the RID Order and 411-2.01 of Division 411 referred to above.

Article 13


The provisions of this Order, revocable at any time, are in force until 31 December 2012.

Article 14


The Director General of the Sea and Transport is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
