Order dated 5 December 2007 approving the Association of Independent Controllers for the Control of Large Bulk Containers for the Transport of Dangerous Goods by Land and Maritime

Minister of State, Minister of Ecology, Development and Sustainable Development,
Considering the 1974 International Convention for the Protection of Human Life at Sea (SOLAS 74) as amended, including the International Maritime Code of Dangerous Goods (IMDG Code);
Having regard to Council Directive 94/55/EC of 21 November 1994 amended on the approximation of the legislation of member States concerning the transport of dangerous goods by road;
Having regard to Council Directive 96/49/EC of 23 July 1996 amended on the approximation of the legislation of member States concerning the transport of dangerous goods by rail;
Considering Act No. 263 of 5 February 1942 on the transport of dangerous substances;
Vu la Act No. 83-581 of 5 July 1983 modified on the safeguarding of human life at sea, the habitability on board ships and the prevention of pollution;
Vu le Decree No. 84-810 of 30 August 1984 modified to safeguard human life at sea, habitability on board ships and prevent pollution;
See?Decree of 23 November 1987 amended on the safety of ships, including Division 411 of its annexed Regulations on the carriage by sea of dangerous goods in packages;
Having regard to the amended decision of 1 June 2001 on the transport of dangerous goods by road, said "ADR order";
Having regard to the amended decision of 5 June 2001 on the transport of dangerous goods by rail, says "R RID Order";
Having regard to periodic inspection of large bulk containers for the transport of dangerous goods;
Considering the application dated 3 September 2007 of the Association of Independent Controllers (ACI), located 22 East Street, 92100 Boulogne;
In view of the opinion of the Inter-Ministerial Commission on the Transport of Dangerous Goods in its session of 27 November 2007,

Article 1


Within the framework of Chapter 6.5 of Annexes A to the ADR and I Order of the above-mentioned RID Order and under paragraphs 2.1.2 and 2.2 of Article 411-4.05 of Division 411 referred to above, the Association of Independent Controllers (ACI) shall be a registered body to perform periodic tests and inspections of the large bulk containers referred to in subsections 6.5.4.4 and 6.5.4.5 of Annexes A

Article 2


The ICA shall, in order to carry out the operations arising from this approval, comply with the terms and conditions set out in the procedures established in this regard by its care and transmitted to the Minister for Transport and to the Minister for the Merchant Navy.

Article 3


The ICA is required to observe procedures relating to the application of regulatory provisions that are published in the Official Bulletin or are notified to it by the Minister for Transport and by the Minister for Merchant Marine.

Article 4


This approval may be withdrawn, suspended or restricted in the event of a serious breach of the obligations established by this Order, by the above-mentioned ADR and RID Orders or by the amended dated 23 November 1987 concerning the safety of ships.

Article 5


The provisions of this Order, revocable at any time, are in force until 31 December 2012.

Article 6


The Director General of the Sea and Transport is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
