Summary


Act 94-577 of 12 July 1994 amending Act 70-631 of 15 July 1970 on the Polytechnic School specified the double mission of the institution: education and training on the one hand, research on the other. In this spirit, the organization of the School was amended by Decree 96-l 124 of 20 December 1996 on the organization and administrative and financial regime of the Polytechnic School.In its articles 12, 13 and 14, the latter provides for the terms and conditions of appointment and the powers of the holders of the jobs of Deputy Director General for Education, Deputy Director General for Research and General Secretary. The Deputy Directors General shall be appointed by order of the Minister of Defence, on the proposal of the Chairman of the Board of Directors of the Polytechnic School. They supervise, each in their area of allocation and under the authority of the Director General, the activities of the School. The Secretary General, appointed by order of the Minister of Defence, on the proposal of the Director General, shall be responsible for the administrative, financial and general services of the School and shall coordinate their activities. In order to complement the provisions of the above-mentioned Decree of 20 December 1996, this Decree lists the categories of agents that may be appointed to the above-mentioned jobs and the conditions and conditions for reclassification of the above-mentioned jobs.Repecified Order 83-173 of 03- 03-03-1983.

The Prime Minister,
On the report of the Minister of Defence, the Minister of Economy, Finance and Industry and the Minister of Public Service, State Reform and Land Management,
Considering the education code, including articles L. 675-1 and L. 755-1 and following;
Having regard to Act No. 72-662 of 13 July 1972, as amended, establishing the general status of the military;
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
Having regard to Decree No. 96-1124 of 20 December 1996 on the organization and administrative and financial regime of the Polytechnic School, as amended by Decree No. 2002-669 of 24 April 2002;
Considering the opinion of the Technical Committee of the Polytechnical School of 28 January 2002;
The State Council (Finance Section) heard,

Can be appointed to the positions of Assistant Director General for Education and Assistant Director General for Research under the conditions set out in articles 12 and 13 of the decree of 20 December 1996 referred to above:
1. Members of civilian and military bodies recruited through the Polytechnical School having reached the gross index 966 at a minimum;
2. State officials and public institutions that depend on them, belonging to a category A body whose terminal gross index is greater than 1015 and having completed at least eight years of actual service in that body;
3. Career soldiers who served for at least six years as superior officer and who reached the rank of colonel of the general military hierarchy or the corresponding rank in a particular military corps.

Can be appointed as secretary general under the conditions set out in article 14 of the decree of 20 December 1996 referred to above:
1. Employees who served for eight years in one of the bodies recruited by the National School of Administration;
2. State officials, territorial authorities and public institutions that depend on them, belonging to a category A body or employment framework whose terminal gross index is greater than 1015 and having completed at least eight years of actual service in category A;
3. Senior career or assimilated officers with a minimum gross index 852.

The appointment to one of the jobs referred to in Articles 1 and 2 shall be made for a maximum period of three years renewable once. Renewal shall be effected under the same conditions as the original appointment.

Officials and military officers appointed Deputy Director General or Secretary General of the Polytechnic School are placed in the position of detachment of their original bodies.
They are classified in their new employment at the level with equal or default treatment immediately higher than the one they receive in their original body or employment framework.
They shall maintain, within the limits of the service time required for access to the higher level of their new employment, the seniority acquired in their previous grade when the increase in treatment following their appointment is less than that which would result from a level advancement in their former situation.

Decree No. 83-173 of 3 March 1983 on conditions of appointment and advancement in the employment of director of teaching and research of the Polytechnic School is repealed.

The Minister of Defence, the Minister of Economy, Finance and Industry, the Minister of Public Service, State Reform and Land Management, and the Minister Delegate for Budget and Budget Reform are responsible, each with respect to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.
