In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State, in particular its articles 15 and 17;
Having regard to amended Decree No. 82-452 of 28 May 1982 concerning the technical committees of parity;
In view of Decree No. 2003-734 of 1 August 2003, establishing and organizing the deconcentrated services of the Central Police Directorate at the Borders;
Having regard to the advice of the National Police Central Joint Technical Committee dated 19 February 2004;
The State Council (Finance Section) heard,
Decrete:
Pursuant to Article 4 bis of the above-mentioned Decree of 28 May 1982, is established, on the one hand, a special technical committee for the police services at the borders of the direction of the aerodromes of Charles-de-Gaulle and Le Bourget and, on the other hand, a special technical committee for the services of the police at the borders of the direction of the Orly aerodrome which are governed by the decree of 28 May 1982
By derogation from article 18 of the decree of 28 May 1982, these special technical committees are chaired respectively by the prefect of the Seine-Saint-Denis and the prefect of the Val-de-Marne or their representative, member of the prefectural body.
I. - By derogation from articles 8 and 11 of the decree of 28 May 1982 referred to above:
(a) The Special Joint Technical Committee for Police Services at the Borders of Charles-de-Gaulle and Le Bourget aerodromes is composed of sixteen incumbent members and sixteen alternate members. Of the eight incumbents and eight alternate staff representatives, six incumbents and six alternates are staff representatives of the active bodies and two incumbents and two alternates from staff of the administrative, technical and scientific bodies;
(b) The Special Joint Technical Committee for Police Services at the Orly Airfield Borders is composed of twelve incumbent members and twelve alternate members. Of the six incumbents and six alternate staff representatives, four incumbents and four alternates are representatives of the active staff and two incumbents and two alternates from the staff of the administrative, technical and scientific bodies.
II. - The special technical committees established by this decree shall include equal numbers of the representatives of the administration appointed by the prefect who chair each of them and representatives of the staff appointed by the trade union organizations.
The representativeness of the trade union organizations called to sit on the one hand at the special parity technical committee competent for the police services at the borders of the aerodromes of Charles-de-Gaulle and Le Bourget and, on the other hand, at the special parity technical committee competent for the police services at the borders of the Orly aerodrome is determined on the basis of the results found in each of these services. The seats are divided according to the terms defined in III below.
III. - Among the seats allocated to the representatives of the active bodies a seat is assigned to the majority trade union organization in the national police control and enforcement corps and a seat to the majority trade union organization in the command and supervision corps of the national police. The other seats are distributed among representative trade union organizations according to the rules of proportion to the highest average applied to the results of consultation of police personnel at the borders assigned to each special technical committee established by this decree.
A joint order of the Prime Minister and the Minister of the Interior, Internal Security and Local Freedoms specifies the terms and conditions for consultation with these personnel.
In accordance with the regulations, the special technical committees established by this decree shall give their opinion:
(a) On the issues of interest to the directions of the police at the borders of Charles-de-Gaulle and Le Bourget aerodrome and Orly aerodrome respectively;
(b) On the terms and conditions for the implementation, in the direction of these branches, of departmental instructions on the organization and working conditions adopted after advice from the Central Joint Technical Committee. If they issue the opinion that these instructions should be adapted to local specificities and constraints, this notice is subject to the review of the Central Joint Technical Committee.
Questions of common interest to the police management at the borders of the aerodromes of Charles-de-Gaulle and Le Bourget and at least one of the departmental services of the Seine-Saint-Denis National Police and justifying coordination fall within the advisory competence of the departmental technical committee of the Seine-Saint-Denis.
Questions of common interest to the police management at the borders of the Orly aerodrome and at least one of the departmental units of the national police of Val-de-Marne and justifying coordination fall within the advisory competence of the departmental technical committee of Val-de-Marne.
The Minister of Interior, Homeland Security and Local Freedoms and the Minister of Public Service and State Reform are responsible, each with regard to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.
