Order of 16 December 2002 approving the merger involving transfers of portfolios of membership bulletins to regulations and mutual contracts

Considering the code of mutuality, including articles L. 212-11 and L. 212-12;
See the requests presented by the mutual company SEDIVER, whose head office is in Saint-Yorre, 32, rue de la Verrerie, the mutual surgical trust ARAC, whose head office is in Montluçon, 53, rue Saint-Jean, la Mutuelle de Contigny, whose head office is in Saint-Pourçain-Sioule (03500),
Considering the deliberation of 23 September 2002 of the Extraordinary General Assembly of the SEDIVER Corporate Mutual;
Considering the deliberation of 23 September 2002 of the extraordinary general assembly of the surgical mutual ARAC;
Considering the deliberation of 25 September 2002 of the extraordinary general assembly of the Mutuelle de Contigny;
In view of the deliberation of 25 September 2002 of the extraordinary general assembly of the staff of the USSRAF of Allier;
Considering the deliberation of 23 September 2002 of the Extraordinary General Assembly of the Mutual of the National Union of Allier Fighters;
In view of the deliberation of 18 September 2002 of the extraordinary general assembly of the staff of the SAGEM factory;
In view of the deliberation of September 25, 2002 of the extraordinary general assembly of the staff of CPAM of the Allier department;
Considering the deliberation of 26 September 2002 of the Extraordinary General Assembly of the Bourbonnais Mutuals;
Considering the opinion published in the Official Journal of 12 October 2002 inviting creditors of the mutual funds concerned to submit their comments on the proposed transfer;
Having regard to the solvency certificate of 4 November 2002 issued by the Commission for the Control of Mutuals and Provident Institutions;
Considering the supporting parts, including the merger treaties and the report of the Merger Commissioners,
Stop:

Article 1

Is approved the merger with the transfers, under the conditions set out in the article L. 212-11 of the code of mutuality, with their rights and obligations, of the portfolios of newsletters to join the regulations and contracts of the mutual company SEDIVER, of the mutual surgical mutual ARAC, of the Mutuelle de Contigny, of the mutual staff of the USSRAF of the Allier,

Article 2

The Director of Social Security is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
