Order of 16 December 2002 approving the merger involving transfers of portfolios of membership bulletins to regulations and mutual contracts

Considering the code of mutuality, including articles L. 212-11 and L. 212-12;
In view of the requests presented by the mutual Laborieuse, whose head office is in Lapalisse (03120), the multipurpose room of Saint-Brix, the Mutuelle n° 103, whose head office is in Varennes-sur-Allier (03150), the municipality, the mutual Les Ouvriers de Saint-Aubin-le-Monial, whose head office is in Bourbon-l'Archambault (03160)
Considering the deliberation of 18 September 2002 of the extraordinary general assembly of the mutual La Laborieuse;
Considering the deliberation of 20 September 2002 of the Extraordinary General Assembly of Mutual No. 103;
Considering the deliberation of 20 September 2002 of the extraordinary general assembly of the mutual Les Ouvriers de Saint-Aubin-le-Monial;
Considering the deliberation of 23 September 2002 of the Extraordinary General Assembly of the Yzeure Mutual;
Considering the deliberation of 20 September 2002 of the extraordinary general assembly of the Mutuelle de Saint-Yorre;
Considering the deliberation of 19 September 2002 of the Extraordinary General Assembly of Mutual No. 119;
Considering the deliberation of 26 September 2002 of the Extraordinary General Assembly of the Bourbonnais Mutuals;
Considering the opinion published in the Official Journal of 12 October 2002 inviting creditors of the mutual funds concerned to submit their comments on the proposed transfer;
Considering the solvency certificate of 4 November 2002 issued by the Commission for the Control of Mutuals and Provident Institutions;
Considering the supporting parts, including the merger treaties and reports of the Merger Commissioners,
Stop:

Article 1

Is approved the merger with the transfers, under the conditions provided for in article L. 212-11 of the code of mutuality, with their rights and obligations, of the portfolios of newsletters to join the regulations and contracts of the mutual Laborieuse, of the Mutuelle n° 103, of the mutual Les Ouvriers de Saint-Aubin-le-Monial, of the Mutuelle d'Yzeonnaist

Article 2

The Director of Social Security is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
