Order of November 18, 2002 on the organization, nature and program of the tests of the technical and scientific police engineering competitions

The Minister of Interior, Homeland Security and Local Freedoms and the Minister of Public Service, State Reform and Land Management,
Considering the law of 23 December 1901 punishing fraud in public examinations and examinations;
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984, including its article 19;
Having regard to amended Act No. 97-1019 of 28 October 1997 on the reform of national service;
Having regard to Decree No. 86-442 of 14 March 1986 on the designation of registered physicians, the organization of medical committees and reform committees, the conditions of physical fitness for admission to public employment and the sick leave of civil servants;
Having regard to Decree No. 94-741 of 30 August 1994 concerning the assimilation, for access to the competitions of the public service of the State, of diplomas issued in other Member States of the European Community or parties to the agreement on the European Economic Area, as amended by Decree No. 98-485 of 12 June 1998;
In view of Decree No. 95-1197 of 6 November 1995 on the management of national police personnel, as amended by Decree No. 96-1141 of 24 December 1996;
Having regard to Decree No. 96-273 of 26 March 1996 establishing the common statutory provisions applicable to laboratory technicians of the state administrations and its public institutions, as amended by Decree No. 97-893 of 26 September 1997 and Decree No. 2000-1012 of 17 October 2000;
Having regard to Decree No. 97-109 of 6 February 1997 on the conditions of registration of persons authorized to conduct genetic imprint identifications in the context of a judicial procedure, as amended by Decree No. 99-147 of 4 March 1999;
Having regard to Decree No. 2002-811 of 3 May 2002 on the special status of the body of technical and scientific police engineers of the national police;
Having regard to the decision of 6 November 1995 on the deconcentration of national police personnel, as amended by the decrees of 9 November 1998 and 17 March 2000;

The recruitment of technical and scientific police engineers of the national police is carried out through three competitions, conducted externally, internally and reserved for candidates with professional experience, in accordance with the requirements listed in the following articles of this Order.

The number of positions to be filled and the dates of withdrawal and filing of applications are set by joint order of the Minister of Interior, Homeland Security and Local Freedoms and the Minister of Public Service, State Reform and Land Management.
The positions opened under the external examination are defined by post profile sheets published in the Official Gazette.

An order by the Minister of Interior, Homeland Security and Local Freedoms published in the Official Journal of the French Republic specifies the opening date of each session and the centres where the trials will take place.

Applications for participation in competitions should be addressed:
- for candidates in a department of the metropolis, to the General Secretariat for the Administration of the Police of which the department reports;
- for candidates from overseas departments, territories and territorial authorities, to the administrative and technical department of the competent police.

Applicants must apply for admission to compete in accordance with the model established by the administration. They certify the accuracy of the information contained therein and declare that any inaccurate declaration would make them lose the benefit of their possible success in the contest.
Applicants must also provide:
For the external contest and for the contest reserved for candidates with professional experience:
1° The application for judicial record extract provided by the administration, duly completed;
2° A reportable statement and military services or a copy of this document or the first pages of the military booklet if they request a reduction in the age limit based on the military services performed;
3° The census certificate and individual certificate of participation in the defence preparation appeal for candidates subject to the law of 28 October 1997;
4° The photocopy of the family booklet or a children ' s birth certificate dating from less than three months, or, where applicable, a personal civil status document certifying either widowhood, divorce or separation and non-remarriage, for candidates who have sought a reduction in age limits for expenses or family events;
A proof for high-level sports candidates seeking a reduction in the age limit;
5° For external contestants:
I. - A file with mandatory requirements:
- a curriculum vitae;
- a copy of the titles and diplomas acquired;
- a handwritten cover letter.
The candidate will mention the number and nature of the documents that make up the file.
II. - Eventually, the copy of the exhibits justifying an application for exemption from the graduation conditions:
- for mothers of at least three children whom they raise or raised effectively (Decree No. 81-317 of 7 April 1981);
- for high-level sportsmen (Law No. 84-610 of 16 July 1984);
- for candidates with equivalent degrees issued by a Member State of the European Union who are likely to be the subject of an assimilation (Decree No. 94-741 of 30 August 1994) and whose translation in French is authenticated;
6° The choice of speciality chosen;
7° For the contest reserved only:
A worksheet established in accordance with the model established by the administration to specify the content, nature and duration of the work activity, as certified by the employer(s);
8° In addition, for disabled workers:
- a certificate of recognition of the quality of disabled worker issued by COTOREP;
- a certificate issued by the Commission stating that the disability is not incompatible with the performance of the post-employment functions.
In the event of a doubt about the accuracy of the information provided, the administration reserves the opportunity to require the production of an original or certified copy.
For the internal competition:
A detailed state of the public services carried out mentioning their duration, grade and quality.
The photocopy of the last administrative order.
Applications must be submitted by way of a hierarchical approach.

In accordance with the provisions of 1° of Article 5 of the above-mentioned Decree of 3 May 2002, the diplomas or titles to be justified by candidates for the external examination of technical and scientific police engineer of the national police are:
A national diploma sanctioning a third cycle of graduate studies in the scientific fields or equivalent diploma issued by one of the Member States of the European Union or parties to the agreement on the European Economic Area whose assimilation with a national diploma sanctioning a third cycle of graduate studies in the scientific fields has been recognized by the commission provided by the decree of 30 August 1994 referred to above;
Degree of engineer issued by a school, institute or university authorized by the commission of engineering titles pursuant to Article L. 642-1 of the Education Code;
Doctor of Medicine State Diploma;
State diploma in pharmacy;
State degree of veterinary doctor.

The candidates are summoned individually to the trials.
However, the failure to receive the summons could not lead to the responsibility of the administration: the candidates have, upon registration, knowledge of the dates of the tests.
If the summons is not received eight days prior to the start of the tests, they must inquire of the examination site and the schedules to be summoned to the service having collected their registration.

The monitoring of the tests is under the responsibility of the administration responsible for organizing the contest.

For the internal competition and competition for candidates with professional experience, the following provisions are implemented:
- the subjects of the written tests are identical in all examination centres; they are sealed and transmitted in all examination centres, where they can only be opened in the presence of candidates at the beginning of each test;
- at the beginning of the first written test, it is read to the candidates of the text of the law of 23 December 1901 punishing fraud in public examinations and examinations. Any communication of candidates between them or with the outside is formally prohibited during the duration of the tests, as well as the use of books or notes, apart from the documentation that may be distributed.
Applicants must lend themselves to the necessary monitoring and verification.
Candidates are prohibited from leaving the examination rooms without authorization from the supervisors responsible.
Any infringement of the regulation, fraud or attempted fraud that has been duly recognized results in the exclusion of the contest, without prejudice, if any, of the application of the criminal provisions provided for in the Act of 23 December 1901 referred to above.
The same measure may be taken against the accomplices of the main perpetrator of fraud or attempted fraud.
No immediate sanction is taken in case of flagrante delicto; the responsible supervisor prepares a report that he transmits to the president of the jury.
The exclusion of the contest is pronounced by the jury. No decision can be made without the individual being summoned and put in a position to present his defence.
The reasoned decision is notified without delay to the person concerned by registered letter with acknowledgement of receipt.
In addition, any copy appearing suspicious, in the course of correction, is reported by the corrector to the president of the jury; in the event of a recognized fraud, the author is excluded from the competition under the conditions set out above.

At the beginning of each written test, the sealed fold containing the subjects of the said test shall be opened in the presence of the candidates.
Applicants arriving after the opening of this fold are not allowed to compete.
The time granted begins to run when all candidates are in possession of the subjects to be treated.
The compositions are written on sheets provided by the administration and only the brouillon leaves provided by the administration can be used.
At the close of each test, the compositions, whether completed or not, are rendered in anonymous form and placed, in the presence of the members of the supervisory board and two candidates, in the envelopes provided for this purpose and immediately sealed. Sealed folds are subject to the signature of the members of the monitoring commission.
A report is forwarded to the Director of the National Police Administration under separate and sealed fold, accompanied by envelopes containing the compositions.

The specialties for which technical and scientific police engineers can be recruited include:
For the external contest:
Biology, physics, chemistry, documentary management and scientific, electronic, computer, toxicology, quality, signal processing, phonetics, telecommunications, life and earth sciences, hygiene and security, typing, photography, ballistics, documents.
For the internal competition and for the contest reserved for candidates with professional experience:
Biology, analytical chemistry, physical measurements, toxicology, typography, photography, ballistics, documents, quality.
Candidates choose a speciality at the time of registration among those offered.
The program of specialties of internal competitions and reserved for candidates with professional experience is annexed to this Order (1).
The list of specialties is likely to be updated on the occasion of each competition.

I. - External competition on titles and works.
The national jury designates, within it, qualified personalities to conduct the individual examination of applications to include personal studies and work in the chosen specialty.
On the basis of the proposals made, the national jury assigns to each file a rating of 0 to 20 (any rating less than 8 out of 20 is eliminated) and establishes the list of candidates definitively selected, in order of merit, as well as a supplementary list.


II. - Internal competition
A. - Eligibility tests


Test number 1:
Study of a technical dossier with at least one theoretical question in the chosen specialty.
(Duration: three hours; coefficient 3, score less than 5 out of 20 eliminates.)
Test 2:
Dissertation on a topical topic to appreciate the general culture and synthesis spirit of the candidate.
(Duration: three hours; coefficient 1, score less than 5 out of 20 eliminations.)
Test number three:
Short answer questions to assess the notions of the candidate in criminal law and criminal procedure related to the activity of the technical and scientific police.
(Duration: one hour; coefficient 1, score less than 5 out of 20 eliminations.)


B. - Intake test


Candidate interview with jury members.
It will allow to appreciate:
- its technical and/or scientific knowledge in the chosen specialty;
- his knowledge of the missions of the Central Directorate of the Judicial Police and the general employment regulations of the National Police;
- its qualities of reflection and its motivations to perform the postulated functions.
(Preparation: 30 minutes; duration: 30 minutes; coefficient 3, score less than 5 out of 20 eliminates.)


III. - Contest reserved for candidates
with professional experience
A. - Eligibility tests


Test number 1:
Study of a technical dossier with at least one theoretical question in the chosen specialty.
(Duration: three hours; coefficient 3, score less than 5 out of 20 eliminates.)
Test 2:
Dissertation on a topical topic to appreciate the general culture and synthesis spirit of the candidate.
(Duration: three hours; coefficient 1, score less than 5 out of 20 eliminations.)


B. - Intake test


Candidate's interview with the jury, covering his studies and personal work in the chosen specialty, his activities and professional experiences, allowing him to appreciate his qualities of reflection and his abilities and motivations to perform the functions of an engineer.
(Duration: forty minutes; coefficient 3, score less than 8 out of 20 eliminates.)
The candidate may, if he or she wishes, resort to the use of transparent materials, excluding any other medium.
The presence of the psychologist is mandatory during this trial.
Candidates to the internal and reserved competitions may pass at the time of the oral test, and upon request made at the time of their registration, an optional test consisting of a translation and/or a discussion with the jury in a foreign language (preparation: twenty minutes; duration: twenty minutes; coefficient 1).
The languages allowed are: German, English, Spanish, Italian and Arabic. The candidate indicates his or her choice in his or her application to the contest.

The jury, whose composition is identical for the three competitions, ensures the selection of subjects, the rating of individual applications and written and oral examinations; includes:
- the director of the administration of the national police or his representative, president;
- the Central Director of the Judicial Police or his representative, Vice-President;
- the National Police Training Director or his representative;
- the Deputy Director of the Technical and Scientific Police or his representative;
- the directors of the national police laboratories or their representatives;
- a psychologist;
- qualified personalities.

The decision appointing the members of the jury may provide qualified examiners for the rating of certain trials.
No one may be a member of a jury if, within the meaning of the civil code, a parent or ally of a candidate. This relationship of kinship or alliance must be reported to the administration so that the composition of this body can, in due course, be modified.

It is assigned to each internal competition test and reserved a rating from 0 to 20. The sum of the points obtained per test, multiplied by the established coefficients, forms the total of the points for all the tests.

The jury determines, by speciality and alphabetical order, the list of candidates eligible for internal and reserved competitions.

At the end of the admission examinations, the jury draws, for the internal and reserved competitions, the list by speciality and order of merit of the candidates admitted, as well as, possibly, a supplementary list.
If several candidates total the same number of points, the priority is given to the one who obtained the best rating in the eligibility test #1 and, in case of new equality, the admission test; Then, in the event of a new equality, the candidate who obtained the highest rating in the Eligibility Test 2 is selected.
Unsupplied jobs as a result of one of the three competitions may be awarded to candidates from other competitions;
The positions of a speciality that would not have been filled may be postponed to another speciality of the same contest, in accordance with the aforementioned decree of May 3, 2002 (art. 6).

Applicants admitted to the external and reserved engineering competitions must, within fifteen days after notification of their success, provide the following documents:
- the photocopy of their identity card;
- where applicable, a reportable statement and military services or a copy of this document or the first pages of the military booklet; for candidates who did not perform military service, born before 31 December 1978, a document that noted their situation with regard to the provisions on national service.

The appointment of the recipients remains subject to the approval of the Minister of the Interior and the final recognition of their physical fitness by a national police doctor.

This Order repeals and replaces the Interdepartmental Order of 29 January 1993 on the organization, nature and program of tests of the National Police Laboratory Engineering Competitions.

The Director General of the National Police is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
