Having regard to Article 19 of Order No. 59-2 of 2 January 1959, which deals with the Organic Law on Financial Laws;
Considering Decree No. 95-171 of 17 February 1995 on the remuneration of certain services rendered by the National Institute of Statistics and Economic Studies;
In view of the amended decision of 10 October 2000 on the provision of electronic databases of the National Institute of Statistics and Economic Studies to the public for rebroadcasting purposes;
Considering the decision of 3 November 2000 on non-recurrent publications on paper and electronic media and the electronic databases of the National Institute of Statistics and Economic Studies;
In view of the decision of 23 March 2001 on the tariffs of standardized products, custom products and support services of the National Institute of Statistics and Economic Studies;
Having regard to the amended decision of 26 February 2002 on non-recurrent publications on paper and electronic materials and the electronic databases of the National Institute of Statistics and Economic Studies,
Stop it!
1.1. The electronic databases referred to in Articles 3 and 4 of the above-mentioned Decrees of 3 November 2000 and 26 February 2002 and those presented in the form of standardized and custom products provided for in Articles 1 to 7 of the above-mentioned Decree of 23 March 2001, carried out by the National Institute of Statistics and Economic Studies on the basis of data from:
- general population censuses prior to 1999;
- statistical surveys or the exploitation of administrative sources carrying results at a regional or subregional level,
shall be made available to the public, as from the date of publication of this Order, under the following conditions:
(a) Their availability price is the sale price for final use;
(b) Their rebroadcasting, including for commercial purposes, is authorized without licence and without royalty payments. However, the redistribution of the database in the state, in whole or in part substantial, for free or against payment is prohibited;
(c) This rebroadcasting is subject to respect for the integrity of the data and the mention of the source in the form: "Source: INSEE - [base name]".
These conditions of availability to the public also apply to the geographical nomenclatures of accompaniment to the above-mentioned statistical products and referred to as "matches...", "addresses and correspondences...", "IRIS-islots".
1.2. As from the publication of this Order, the products referred to in paragraph 1 above shall no longer be subject to the provisions of Articles 12 and 13, relating to the redistribution of information, of the aforementioned Order of 10 October 2000.
The database of the 1998 municipal inventory, France in its entirety, referred to in Article 8 of the above-mentioned Order of 10 October 2000, shall, from the date of publication of this Order, be proposed for commercial redistribution under the following conditions:
(a) The base is available to the public at a cost of EUR 609.80;
(b) The redistribution of this base, including for commercial purposes, is authorized without licence and without royalty payments. However, its redistribution in the state, in whole or in part substantial, for free or against payment is prohibited;
(c) The rerun is subject to respect for the integrity of the data and the reference to the source in the form: "Source: INSEE - Municipal Inventory of 1998".
The decision of 11 July 2001 on the provision of the electronic database of the National Institute of Statistics and Economic Studies known as "REPLIC" to the public for use in rebroadcasting is repealed.
The Director General of the National Institute of Statistics and Economic Studies is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
