Having regard to Order No. 58-1270 of 22 December 1958 on the Organic Law on the Status of the Judiciary;
Considering the Administrative Justice Code;
In view of Book IV of the Commercial Code on Freedom of Price and Competition, including Article L. 440-1;
Considering Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
In light of the amended Decree No. 2001-1370 of 31 December 2001 on the organization of the Trade Practice Review Board,
Decrete:
The chair of the Business Practice Review Board may receive a monthly lump sum allowance.
This allowance is exclusive to other forms of compensation provided for in this Decree.
In the event of the absence or incapacity of the Chairman of the Commercial Practices Review Board, the magistrate who is called to effectively supple him at a plenary session of the Board may receive compensation.
Judges who preside over the boards of examination of the commercial practice review board may receive compensation for each session of the boards in which they participate effectively.
Qualified non-public servants may receive compensation for each plenary session of the Board or each session of the Examining Chambers in which they participate effectively.
Rapporteurs to the Commercial Practice Review Board may receive compensation for each file they report. The amount of this remuneration is equal to the product of the number of hourly vacations by their unit rate.
During the sessions in which their reports are examined, qualified non-public servants designated as rapporteurs are paid on the basis of the allowances per session referred to in Article 3 of this Decree and not as rapporteurs.
The number of hourly vacations is fixed by the chairman of the commission, according to the time actually required for the preparation of the report. This number is stopped at the nearest unit or half unit.
The total amount of remuneration received annually by the same rapporteur may not exceed 200 hourly vacations.
The amounts of the allowances, the rate of the hourly vacations and the maximum annual number of meetings set out in the preceding sections are determined by order of the Minister for Economy, the Minister for Public Service, the Minister for Budget and the Minister for Trade.
The Minister of Economy, Finance and Industry, the Minister of Public Service, State Reform and Land Use Planning, the Minister Delegate for Budget and Budget Reform and the Secretary of State for Small and Medium Enterprises, Trade, Crafts, Professionals and Consumer Affairs are responsible, each with respect to it, for the execution of this decree, which takes effect on April 4, 2002.
