Considering Directive 2002/22/EC of 7 March 2002 on universal service and user rights in relation to electronic communications networks and services;
Having regard to Act No. 2003-1365 of 31 December 2003 on the Public Service Obligations of Telecommunications and France Télécom;
Having regard to Act No. 2004-669 of 9 July 2004 on electronic communications and audiovisual communication services;
Considering Act No. 2005-516 of 20 May 2005 on the regulation of postal activities;
Having regard to the Code of Posts and Electronic Communications, including articles L. 32 (15°), L. 35-3 and R. 20-31 to R. 20-39, in their drafting by Decree No. 2004-1222 of 17 November 2004 on Public Service Obligations and Financing of the Universal Electronic Communications Service and amending the Code of Posts and Electronic Communications;
In view of the Minister's decision of November 25, 2004, setting out the monthly amount of the telephone rate reduction for certain categories of persons under the universal electronic communications service;
In view of the Minister's decision to the industry dated November 25, 2004, setting the maximum amount of appropriations available by department for the management of telephone debts;

Having regard to Decision No. 2005-0789 of the Electronic Communications and Post Regulatory Authority dated 7 October 2005 setting the final value of the rate of pay of capital for the calculation of the final net cost of the universal service for the year 2004 provided for in Article R. 20-37 of the Post and Electronic Communications Code published in the Official Journal of 19 October 2005;
Having regard to Decision No. 2005-0865 of the Electronic Communications and Post Regulatory Authority dated 7 October 2005 publishing the rules used for the application of the methods referred to in Articles R. 20-33 to R. 20-39 of the Post and Electronic Communications Code for the calculation of the final cost of the universal service for the year 2004 published on its website on 7 October 2005 and referred to in the Official Journal of 19 October 2005;
Having regard to Decision No. 2005-0921 of the Electronic Communications and Post Regulatory Authority dated 18 October 2005 issuing for the years 2003 and 2004 certificates of compliance of costs in the individualized accounts and operating accounts by product or service established by France Télécom as part of its regulatory obligations;
Having regard to opinion No. 2000-531 of the Telecommunications Regulatory Authority dated 9 June 2000 on Tariff Decision No. 00086E on France Télécom's request to propose social tariffs and to the deletion of France Télécom's "low consumption line" subscription;
In view of Notice No. 2003-1112 of the Telecommunications Regulatory Authority dated 15 October 2003 at the request of UPC France to propose the management of telephone debts to its subscribers;
After deliberating on 27 October 2005,


I. - Introduction
I.1. On the universal service financing mechanism


Section L. 35-3 of the Posts and Electronic Communications Code, in its drafting of Act No. 2003-1365 of 31 December 2003, defines the net cost-financing mechanism attributable to universal service obligations.
Methods for calculating this net cost are set out in articles R. 20-31 to R. 20-39 of the Post and Electronic Communications Code, in their drafting by the provisions of Decree No. 2004-1222 of 17 November 2004 on public service obligations and the financing of the universal electronic communications service and amending the postal and electronic communications code. These methods are specified by rules, which, pursuant to the provisions of Article R. 20-40 of the Post and Electronic Communications Code, must be published beforehand by the Authority.
The purpose of this decision is to assess the final net cost of universal service obligations for the year 2004.
The rules used to calculate the final cost of universal service for the year 2004 were adopted by the Authority, following a public consultation conducted from 14 to 30 September 2005, in its decision No. 2005-0865 of 7 October 2005 published on its website on 7 October 2005 and referred to in the Official Journal on 19 October 2005.


I.2. On the procedure followed by the Authority


The information required to prepare cost assessments for the universal service components for the calculation of the final cost of the universal service for the year 2004 was provided by France Télécom on 30 September and on 3, 7, 10 and 14 October 2005.
In addition, the accounting of France Télécom used to calculate the net cost of universal service obligations was audited by an independent agency designated by the Authority in Decision No. 2005-0140 dated 10 February 2005, pursuant to Article I L. 35-3 of the Post and Electronic Communications Code. The audit focused on the cost and revenue data of the services taken into account in assessing the cost of universal service obligations, as well as on the methods for collecting data related to network characteristics and traffic, from the information system of France Télécom. The corresponding audit report was submitted to the Authority on 7 October 2005.
In parallel with this work, the Authority has issued a statement of the relevant turnover for the calculation of final contributions to the universal service fund for the year 2004. This notice of declaration was the subject of a public consultation that took place from 8 to 22 July 2005, before being adopted by decision No. 2005-0680 of 26 July 2005. The Authority has also conducted an external monitoring of the statements of the business figures of the electronic communications services of the contributors to the universal service fund for the year 2004, which were used to determine the contributions of these operators to the universal service fund. This control focused on the statements of 37 contributors. The report for this mission was submitted to the Authority on 11 October 2005.
Finally, in its decision No. 2005-0789 of 7 October 2005, the Authority assessed the final value of the capital rate for 2004 provided for in article R. 20-37 of the Post and Electronic Communications Code.


II. - Evaluation of the net costs of universal service components
II.1. Assessment of the net cost of the corresponding tariff equalization obligations
the obligations of geographical equalization


The net cost of this component is assessed using the method set out in section R. 20-33 of the Post and Electronic Communications Code. It is equal to the sum of the relevant net costs in non-profit areas that would not be served by an operator acting under market conditions.


Net cost assessment model for non-profit areas


As indicated in its decision No. 2005-0865 of 7 October 2005, the Autorité maintained for 2004 the choice of cutting in local distribution areas. The Autorité then used a model representing the economy of the France Télécom network with 35 classes of local distribution areas characterized by their demographic density.
The model reflects the behaviour of an operator subject to a geographical equalization of its tariffs and acting under market conditions, which develops the network from areas of higher population density to the less dense areas. For each class of local areas, a net cost appears as long as the additional cost incurred by the operator to serve this category of local areas is higher than the direct and indirect revenues withdrawn by the service of this class of local areas. The model considers that the operator seeks to maximize its profit by stopping its deployment when any additional extension of its network decreases it.
Unprofitable areas are by definition those that the operator would not serve under these conditions, and the net cost of the tariff equalization obligation is the sum of the net costs of unprofitable areas.
The cost and revenue data recorded in 2004 provided by France Télécom and audited were introduced into the model used by the Autorité.
The model is also based on the rules adopted by the AMF in its decision of 7 October 2005, adopted following the public consultation conducted from 14 to 30 September 2005.
The final net cost of non-profit zones for the year 2004, before taking into account intangible benefits, is €57.465 million, representing 1.3 million analog subscribers, or 4.6% of the number of analogue main lines, and located in local areas with less than 21.5 inhabitants per km2.
In its above-mentioned decision No. 2003-1119, this cost was assessed in a provisional manner to €180.207 million for the year 2004, including €5.358 million for non-profit subscribers in profitable areas.


II.2. Assessment of the net cost of the requirement to offer specific rates to certain categories of subscribers
to ensure access to telephone service


The Authority had retained a provisional cost for this component of €36.295 million, corresponding to the amount of the last known final assessment of this component.


Reduction of telephone bill


The offer of specific tariffs provided for in R. 20-34 was implemented on 1 July 2000. Potential beneficiaries, who receive a certificate sent by their social organization (National Family Allowance Fund, National Industrial and Commercial Employment Union or Central Agricultural Social Mutual Fund), refer it to the agency providing the rate social reduction if they wished to benefit from the scheme. The rate social reduction implemented by France Télécom in 2004 amounted to 5.02 euros excluding taxes per month and per beneficiary.

As part of the assessment of the net cost of the universal service, the amount taken into account for the compensation of the operators is 4.21 euros per month and per beneficiary, in accordance with the Minister's decision to the industry dated 25 November 2004. In December 2004, 706,505 allocatories benefited from the telephone rate reduction, which totalled €35.497 million for the year 2004.
Section R. 20-34 of the Post and Electronic Communications Code states that "the amount of compensation paid to each operator by the universal electronic communications service fund is equal to the net cost of the tariff offer to which the management costs set out by the management agencies and by the service provider responsible for the management of the tariff reduction device on behalf of the operators are added".
These management costs amounted to €2.752 million in 2004. These fees are for the management costs of social organizations and those of the rate social reduction organization. They correspond to the costs of contracting the certificate and to the staff costs of employees of the social organizations assigned to this operation and the manager of the tariff reduction system.


Support for telephone debts


The amount of support for telephone debt amounts to €0.949 million for the year 2004, based on the figures provided by France Télécom.
According to the information available to the AMF, UPC, which had proposed to be a service provider of part of the telephone debt management component, did not realize a benefit in computing the cost of universal service in 2004.


Synthesis


In total, under the final cost for the year 2004, the net cost of the social tariff component, before taking into account intangible benefits, is €39.198 million. This net cost does not exceed the limit set at 0.8% of the turnover of the telephone service to the public of the year, in accordance with section R. 20-34 of the code.


II.3. Assessment of the net cost of bonds to provide service to the territory
telephone booths installed in the public domain


The evaluation of this component is based on the rules adopted by the above-mentioned Authority's Decision No. 2005-0865 and based on the operating accounts of the publishing activity and the number of telephones per commune, information provided by France Télécom and audited.
The final net cost of this component for the year 2004 is €18.598 million before taking into account intangible benefits. It corresponds to the inclusion of 26,468 cabins in the 2,521 municipalities for which the number of cabins meets the standard set out in Decree No. 2004-1222 of 17 November 2004 referred to above and for which the public-phone activity is deficit.
This figure is in sharp decrease compared to the provisional valuation of this component, which was €23.839 million. This decrease is due to the reduction of costs and the increase in the rates of the publication implemented from August 2004 (see Opinion No. 2004-634 of 22 July 2004 on Tariff Decision No. 2004104).


II.4. Assessment of the net cost of obligations for the provision of an information service
and a directory of subscribers in print and electronic form
The perimeter


Excluding induced and off-duty calls "Yellow Pages", the "Directory and Information Services" component is a deficit of 45 million euros.


Induced calls


France Télécom's 2004 activity report indicates that the site "pagejaunes.fr" is the subject of 31.9 million visits per month. Data on the consultation of paper and minitel directories are also available for previous years.
Based on information provided by France Télécom, the Autorité considers that a consultation of the products "White Pages" or "Yellow Pages", in printed or electronic form, or a visit to the site "pagejaunes.fr" is followed by a call in 40% of the cases on average.
Based on the available data, and taking into account an estimate of the share of the induced calls made on alternative networks of that of France Télécom, we can assess the net profit of the induced calls to more than 45 million euros.


Yellow Pages products


France Télécom's 2004 financial report indicates that the turnover in France for Yellow Pages is 908 million euros. It also specifies the business figures including the international and subsidiaries, which amount to 984 million euros, as well as the operating income on the same perimeter, amounting to 403 million euros. The only "Yellow Pages" products in the French territory represent a result of exploitation of several hundred million euros.


Evaluation of the net cost of the component


As a result, after taking into account induced calls and "Yellow Pages" products, the "Booking and Information Service" component is beneficial.
As a result, the net cost of the component is zero.


II.5. Evaluation of the benefits induced by being a universal service operator


Pursuant to section R. 20-37-1 of the Post and Electronic Communications Code, the intangible benefits include:
- the technical and commercial benefit resulting from the scope of the network, in relation to an operator acting under market conditions, for the connection of new subscribers;
- the benefit linked to the improvement in time of the economic capacities of subscribers enjoying universal service;
- the benefit derived from the exploitation of subscriber data, for market knowledge;
- the profit from the brand image associated with the position of universal service operator.
The AMF has conducted work on intangible benefits since 1998:
- in particular, it defined in 1999 a method for assessing the benefit associated with the brand image;
- following the judgment of the Court of Justice of the European Communities, it assessed all intangible benefits for the final periods 1998, 1999, 2000, 2001, 2002 and 2003.
She also took note of studies conducted by firms on behalf of AFORS, or France Télécom, and conducted an international review of evaluations in this area.

These elements led the Authority, within the framework of this decision, to favour continuity in the use of the methods it had already used. In that spirit, she updated her previous assessments.
It will focus in 2006, in consultation with the sector, on deepening the methodology for assessing these benefits.


The technical and commercial benefit resulting from the scope of the network (duty-related effect)


The technical advantage is taken into account in the model for calculating the cost of geographical equalization, by modelling in avoidable costs (see decision No. 04-1066 above).
Therefore, it is not necessary to take this advantage into account again and in isolation.
France Télécom can withdraw a commercial advantage from its status as a universal service operator when a subscriber moves from a non-profit zone to a profitable area: this subscriber will more easily address France Télécom because he knows that France Télécom is present. However, this advantage is primarily related to the fact that France Télécom is the dominant historical operator or operator, rather than its status as a universal service operator.
The Autorité considers that this advantage is very low, in particular because the number of access per competing local loop of France Télécom remains marginal. It assesses it to 0.12 million euros.


The benefit related to the improvement in time of the economic abilities of subscribers
benefiting from universal service (life-related effect)


An operator acting under market conditions may wish to connect a non-profitable area or telephone in advance of the future development of its cost and revenues.
For areas, this effect can be taken into account by projecting total costs and revenues over a five-year study horizon: only those areas that are in the study period should be considered unprofitable. In other words, the life-cycle benefit is equal to the net cost of areas that are not cost-effective over the year being considered, but are in the entire period taken into account. For 2004, as a result of the changes in France Télécom's costs and revenues, there would be no unprofitable area in 2004 over a five-year period.
The revenues of the telephones are declining steadily, particularly as a result of the development of mobile phones, and will likely continue to decline. Unprofitable in 2004 will likely be even more in the future. Therefore, the advantage associated with the evolution in the time of the economy of non-profit publishers is zero for the year 2004.
Therefore, there is no need to take into account life-cycle effects in assessing the cost of universal service 2004.


The benefit derived from the exploitation of subscriber data


The advantage taken by France Télécom of the data available to it can only be taken into account as long as these data relate to the only non-profit areas.
The Autorité assesses 0.202 million euros the benefit derived from the exploitation of subscriber data for 2004.


The profit from the brand image associated with the operator position
of universal service


The assessment of the benefits derived from the brand image in 2004 was based on a methodology developed by the AMF, which is based on the results of the survey conducted by a survey institute at the end of 2000. Applied to France Télécom's turnover on the residential segment, this methodology valued at €81.664 million the advantage, in terms of brand image, that France Télécom withdraws from its status as a universal service operator in 2004.

II.7. Compensation


The cost of universal service, intangible benefits deducted, amounted to €33.284 million in 2004. It is decreasing compared to previous years (125 million in 2002 and 53 million euros in 2003), in particular due to the lower costs of geographical equalization and publicity.
The Autorité considers that the compensation mechanism must be implemented in accordance with Article L. 35-3-III of the Code.


II.8. Management costs


The contributions are to increase the management costs of the Caisse des dépôts et consignations, which amount to 29,301 euros, the level of the amount validated by the Board of Control of the Fund as of 10 November 2004.
It should be noted that the Caisse des dépôts et consignations no longer charges VAT for its management fees.


II.9. Impended


Article R. 20-39 of the Post and Electronic Communications Code states that "in the event of an operator's failure, and if the amounts due by that operator are not recovered within one year of the failure as referred to in Article R. 20-43, they are charged in the following year following this finding on the accounts of the other operators on the prorated balance of the same amount of time calculated on the part of each of the specified time".
No unpaid claims identified during the final year of 2002 correspond to an operator in judicial liquidation, and the debt recovery process for the final year of 2003 is still under way. The amount of the mutualized unpaid is therefore null.


III. - Distribution of contributions between operators


The full cost of universal service for the 2004 fiscal year is funded through the universal service fund. The operators communicated to the Authority their business figures for electronic communications services in accordance with article R. 20-39 of the code. These values allow each operator to determine its net contribution to the universal service fund.


III.1. Cost distribution of universal service among contributors


The drafting of Article L. 35-3 of the Post and Electronic Communications Code provides in the second paragraph that: "the contribution of each operator to the financing of the universal service shall be calculated on the basis of its turnover in respect of electronic communications services, other than that made in respect of interconnection and access benefits under the conventions defined in Article I of L. 34-8 and other services charged for third parties". This same section states that this new distribution key applies from the final assessment of the year 2002.
Decree No. 2004-1222 of 17 November 2004 on Public Service Obligations and Financing for the Universal Electronic Communications Service and amending the Post and Electronic Communications Code, published in the Official Gazette on 19 November 2004, specifies the modalities for the application of the new legal regime applicable to the calculation of the cost of universal service.
Thus, section R. 20-39 of the amended Post and Electronic Communications Code states: "The operators who contribute to the universal service fund are the operators of open networks to the public and electronic communications service providers to the public.
Each operator's contribution to the financing of the universal service is calculated on the basis of its turnover for electronic communications services, excluding:
1° Revenue from interconnection and access benefits under the agreements defined in Article L. 34-8 I and other benefits realized or invoiced on behalf of third party operators;
2° Revenues generated for the delivery and dissemination of radio and television services and the operation of collective antennas.
As part of offerings involving radio or television services to electronic communications services, the operator's contribution is based on the sole revenue associated with electronic communications services.
For the calculation of the contribution, it is practiced a reduction of 5 million euros on the annual revenue thus calculated. »
Decision No. 2005-0680 of 26 July 2005 referred to above adopted the statement of relevant turnover for the calculation of the final contribution to the universal service fund for 2004 taking into account the regulatory provisions set out in Decree No. 2004-1222 of 17 November 2004.


III.2. Contributors: electronic communications operators


Universal service contributors are operators as defined by Article L. 32 (15°) of the Post and Electronic Communications Code: "any natural or legal person operating an electronic communications network open to the public or providing the public with an electronic communications service."


III.3. What is credited to operators


France Télécom alone provides all components of the universal service. Accordingly, France Télécom is credited with the total net cost of the universal service calculated in II.6.
The amount credited to France Télécom includes the costs of managing social organizations and the provider of the rate social reduction, amounting to €2.752 million, charging France Télécom to remit them to the organizations and providers concerned.
For its part, UPC France did not provide the Data Authority with respect to the costs it would have incurred for the handling of telephone debts and therefore cannot claim compensation.


III.4. What is carried to the flow of operators
Evaluation of the relevant turnover of each reporting entity


The relevant turnover to determine the contribution of each registrant is obtained from the statements made by the operators according to the rules set out in the notice adopted by the Autorité (decision No. 2005-680 of 26 July 2005).
The relevant turnover taken into account is equal to that reported by the operator, retired if any by the Authority following the audits carried out.


Slaughter


Any declarant for whom the relevant turnover is less than or equal to the amount of the €5 million reduction defined in Article R. 20-39 of the Post and Electronic Communications Code is not a contributor.
Any declarant for whom the relevant turnover is strictly higher than the amount of the slaughter is contributor. Its reported turnover is reduced by the amount of slaughter (5 million euros) to obtain a final turnover. This final turnover serves as the basis for calculating the contribution of each operator.
The total relevant turnover communicated by all operators, and withdrawn as appropriate by the Authority following the audits carried out, amounted to 33,538.440 million euros. Due to the decrease of €5 million, the turnover for the calculation of the share of each contributor in the financing of the cost of the universal service is at the end of €33,190.217 million, an increase of 5.16 per cent compared to the amount of the year 2003.


Assessment of the gross contribution of each contributor


The prorata of each contributor is determined as the ratio of its final turnover (deducted deduction) to the sum of the final business figures of all contributors.
This ratio is applied to the net cost of the universal service (33,283 million euros) plus management costs (29,301 euros) to determine the gross contribution of each operator.
The total amount (€33.313 million) reported in total reference turnover (after abatement), or €33,190, €217 million, represents a sample rate of approximately 0.10 per cent in 2004 (compared with 0.17% in 2003 and 0.42% in 2002).


Operators not reporting


The Autorité notes that almost all operators have forwarded their statements and that the statements that have not been made correspond to operators whose relevant turnover is likely to be less than the amount of the slaughter. In the event that the Authority would not have received a statement in time, it, if possible, assessed it on the basis of the statements of previous years and the overall increase in the relevant market declared. The Authority also reserves the opportunity to initiate appropriate sanctions procedures against non-reporting operators pursuant to Article L. 36-11 of the Post and Electronic Communications Code.


III.5. The net contribution of an operator


Pursuant to articles L. 35-3 and R. 20-39 of the Post and Electronic Communications Code, if an operator's credit is greater than its debit, the operator is creditor to the universal service fund.
Conversely, if an operator's credit is less than its debit, it is debtor to the universal service fund. The difference between its debit and credit is its net contribution to the universal service fund.
In other words, the net contribution of a contributor, positive or negative, is equal to the reduced gross contribution, if any, of the net cost of providing the universal service benefits it provides.
The attached schedule defines the contributions made under this decision.
The difference between the sum of the amounts due by the debtor operators and that due by the creditors corresponds to the fund management costs and the unpaid.


III.6. Regularization


Any discrepancy between the final values and the reserve values of the net cost of universal service obligations leads to regularization. This may be translated for a particular contributor, either by a contribution balance to be paid (net debiting), or by the reimbursement of a overpayment (net credit regulation).
The calculation of the amount of this regularization takes into account the day of its assessment:
- the amounts (not updated) referred to in the instalments and the dates of these deadlines;
- the amounts actually paid for the instalments and the actual dates of such payments;
- the amounts (unreacted) referred to as late interest due under one or more lateral, partial and/or unpaid payments, and the dates of these interest dates;
- interest of actual delay and dates of such payments;
- the interest, for each of the two instalments, on the amount of the difference between the amount claimed during that timeframe and half of the final contribution, covering the period between the date of that instalment and that of the final regularization, pursuant to section R. 20-39 (the interest only applies to contributors who have been notified of an instalment appeal);
- the net contribution (unreacted) due.
This regulation is notified to the contributors concerned.
For contributors with net debiting regulation (if a balance is due), the due notification that is sent to them in the date. Any delay in payment is a legal interest that increases the amount initially notified, regardless of the sanction procedures for non-compliance with the universal service's funding requirement.
Contributors with net credit regulation receive their share of the amounts collected from other contributors within ten days of the due date or later in the case of late payments from other contributors. It should be noted that, on the one hand, in the case of a late payment, contributors with a net credit contribution are recipients of the delayed interest earned, and on the other hand, because of the potential defaults of some contributors, the amounts actually collected by contributors with a net credit contribution may ultimately be less than the amount initially notified by the Authority.
It is up to the newly contributors to the 2004 provisional assessment (including internet service providers, prepaid card operators and data carriers) that would have been indirectly charged by an authorized operator in 2004 with a share in the provisional cost of the 2004 universal service, to assert their new situation with the latter.


IV. Conclusion


The Authority, by this decision, assesses, on a final basis for the year 2004 and, after taking into account the intangible benefits, the net cost of universal service obligations to 33,283 million euros including:
57.465 million euros for tariff bonds for geographical equalization obligations;
39,198 million euros for social tariffs;
18.598 million euros for the service of the territory in telephone booths installed in the public domain;
0 euro for the cost of obligations related to the provision of an information service and a directory of subscribers in print and electronic form;
81,978 million euros in decrease in the cost of universal service, all components, for intangible benefits.
This sum of 29,301 euros should be added to the Fund's management fees for deposits and consignations.
The difference between the provisional valuation of the cost of universal service for the year 2004 and its final assessment is mainly due to the decrease in the geographic equalization and publicity components, and specifically in the case of the geographic equalization component, the decrease in the net cost of analog telephone service in non-profit areas.
Decides:

Article 1


The net cost corresponding to the obligations of the universal service for the year 2004, increased management costs, is €33,283 million. This amount constitutes an excessive charge and provides compensation.

Article 2


The net contributions of operators to the universal service fund for the year 2004 are those contained in annex I to this decision.

Article 3


The Director General of the Autorité is responsible for the application of this decision, which will be published in the Official Journal of the French Republic and notified to the operators listed in the annex.
