Decree of 1 October 2002 on the declaration of public utility of the acquisitions and works necessary for the realization of the U 222 route between Milly-Mathis Avenue and Barnier Boulevard and the connection of the Tuileries Road to Saint-Antoine Avenue, on the territory of the commune of Marseille (Bouches-du-Rhône)

The Prime Minister,
On the report of the Minister of Interior, Homeland Security and Local Freedoms,
Considering the code of expropriation for public utility, including articles R. 11-14-1 and R. 11-14-3;
Considering the general code of territorial authorities, including article L. 5215-20;
Considering the prefectural decree of 7 July 2000 establishing the urban community of Marseille;
Considering the land occupancy plan of the commune of Marseille approved on 30 June 1981 and last revised on 22 December 2000;
In view of the deliberation of the municipal council of the municipality of Marseilles of 2 October 2000 approving the file of investigation relating to the realization of track U 222 and the expansion of the route of the Tuileries and calling for the opening of the public inquiry prior to the declaration of public utility and the modification of the land occupancy plan;
In view of the prefectural decree of 24 January 2001 prescribing the opening, on the territory and for the benefit of the commune of Marseille, for the realization of the U 222 route between Milly-Mathis Avenue and Barnier Boulevard and the connection of the Tuileries Road to the avenue of Saint-Antoine, of a public inquiry covering both the public utility of the aforementioned project and
Considering the pieces of the public inquiry on the one hand concerning the public utility of the realization of track U 222 between avenue Milly-Mathis and boulevard Barnier and the connection of the route des Tuileries to the avenue de Saint-Antoine, on the other hand on the compatibility of the plan of occupancy of the soils of the commune of Marseille with this project, to which it was unfavourable of 5 March 2001,
In view of the deliberation of the council of the urban community of Marseilles of 6 July 2001 decided to continue the project to carry out the U 222 route between Milly-Mathis Avenue and Barnier Boulevard and the connection of the Tuileries Road to Saint-Antoine Avenue as submitted to the public inquiry;
In view of the letter dated 21 June 2001 by which the departmental equipment director of Bouches-du-Rhône ensures that the characteristics of track U 222 in the file submitted to investigation are consistent with the land occupancy plan as revised on 22 December 2000;
The State Council (inland section) heard,
Decrete:

Article 1


The acquisitions and works necessary for the realization of U 222 between Milly-Mathis Avenue and Barnier Boulevard are declared public utility and the connection of the Tuileries Road to Saint-Antoine Avenue, in accordance with the plan of 1/1 000 annexed to this Order (1).

Article 2


The necessary expropriations shall be carried out within five years of the publication of this decree.

Article 3


The Minister of Interior, Homeland Security and Local Freedoms and the Minister Delegate for Local Freedoms are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
