Judgment of September 1, 2005 relating to the label of origin « Delimited wine of superior quality Saint-Sardos »

Considering the rural code;
Considering the code of consumption;
Considering Decree No. 2001-510 of 12 June 2001 implementing the code of consumption with regard to wines, sparkling wines, sparkling wines and liqueurs wines;
Considering the decree of 14 May 1991 amended concerning the issuance of the label of the wines of label of origin "Delimited wine of superior quality";
Considering the proposal of the national committee of wines and brandies of the National Institute of the labels of origin of 8 and 9 June 2005,
Stop:

Article 1


Only can benefit from the label of origin "Delimited wine of superior quality Saint-Sardos" the red and rosé wines responding to the conditions fixed by the present decree.

Article 2


The geographic area of wine production is constituted by the territory of the following municipalities:
In the department of Tarn-et-Garonne: Beaumont-de-Lomagne, Beaupuy, Belbèse, Bouillac, Bourret, Comberouger, Cordes-Tolosannes, Escazeaux, Faudoas, Gariès, Labourgade, Lafitte, Larrazet, Mas-Grenier, Montain, Saint-Sardos, Savenès, Vigueron, Verd.
In the department of Haute-Garonne : Belleserre, Lagraulet-Saint-Nicolas, Le Burgaud.
The wines are derived from grapes harvested in the geographic area of production, in an area delimited by parcel or part of parcel, as approved by the national committee of the wines and brandies of the National Institute of the labels of origin during its session of 8 and 9 June 2005, on the proposal of the commission of experts designated for this purpose.
The area thus delimited is deferred to the cadastral plans deposited at the town hall of the municipalities concerned.

Article 3


The wines come from the following grape varieties:
- main varieties: syrah N, whose proportion cannot be less than 40% of encépagement, and tannat N, whose proportion cannot be less than 20%;
- additional vines: cabernet franc N and merlot N, without the proportion of the latter being able to exceed 10%.
The wines are necessarily derived from the assembly of grapes or wines from at least three grape varieties.
The encépagement is understood as that of all the plots of exploitation producing the wine of the name for the color considered.
When they are vinified separately, the wines from the different grape varieties are assembled in the wineries before the sampling provided for in article 3 of the decree of May 14, 1991 referred to above.

Article 4


I. - The vines have a minimum planting density of 4,000 feet per hectare. They cannot present a gap between rows above 2.5 metres.
However, and up to the 2030 harvest included, the vines planted before the date of entry into force of this Order may have a minimum planting density of 3,500 feet per hectare. These vineyards cannot present a gap between rows above 2,80 meters.
II. - The following three size modes are allowed:
1° The size of a simple guyot, each foot bearing not more than 10 frank eyes, with a single long wood bearing not more than 8 frank eyes and a couron with no more than 2 frank eyes;
2° The bilateral cord, each arm bearing not more than 3 frank-eyed let us coursons at most;
3° The dual dual guyot size with two short baguettes, called locally "drive", with a maximum of 8 eyes per cep, only for the cabernet pass N.

Article 5


The wines come from grapes harvested at good maturity and have a minimum natural volumic alcoholometric title of 11%.
When an enrichment authorization is granted, the wines cannot present a total volumic alcoometric title greater than 13%.
Can not be considered to be at good maturity any unit batch of vintage with a sugar richness less than 180 grams per liter of must.

Article 6


The quantum to the hectare provided for in article R. 641-124 of the rural code is set at 60 hectolitres for red wines and rosé wines.
The maximum labelable volume provided for in the article R. 641-124 of the rural code will not exceed 72 hectolitres per hectare for red wines and rosé wines.
The benefit of the label of origin can only be granted to the wines from the young vines from the second year following that during which the plantation was made in place before the 31st of July.

Article 7


The wines are vinified according to local uses.
After fermentation, the fermentable sugar content of red wines cannot be greater than 3 grams per litre for red wines and 4 grams per litre for rosé wines.

Article 8


The wines cannot be put in circulation with the label of origin "Delimited wine of superior quality Saint-Sardos" without a label issued under the conditions provided for in articles R. 641-120 to R. 641-125 of the rural code.
Malo-lactic fermentation must be completed for the labelling of red wines.
Volatile acid content must be less than or equal to 10.2 milli equivalents per litre for roses and 13.3 milli equivalents for red wines for their label presentation.
Mention of this label with its number is included on accompanying documents.

Article 9


The wines for which, under the present decree, is claimed the label of origin "Delimited wine of superior quality Saint-Sardos" and which are presented under the said appellation can be offered to the public, shipped, put on sale or sold without that, in the declarations of harvest and stock, in the documents of accompaniment and commercial documents, on the labels, labels any labels and any advertising medium,
A thumbnail issued under the conditions specified in the rules of procedure provided for in article R. 641-122 of the rural code is affixed by the bottles on the sealed containers containing these wines.

Article 10


The use of any indication or sign likely to make believe to the buyer that a wine is entitled to the original name "Saint-Sardos" accompanied by the mention in question, while it does not meet all the conditions fixed by this decree, is continued in accordance with the general legislation on the suppression of frauds and on the protection of the labels of origin, without prejudice to the sanctions of a fiscal order, if applicable.

Article 11


The wines of the 2004 harvest held in stock by the producers on the date of publication of the present decree responding to the conditions of the present decree and having benefited from the name "Vine de pays de Saint-Sardos" can be shipped under the label of origin "Vine delimité de qualité supérieure Saint-Sardos", provided that they obtain, within three months after the publication of the present decree, the label of delimited wines of superior quality,

Article 12


The Director of Economic and International Policy, the Director General of Competition, Consumption and Suppression of Frauds and the Director General of Customs and Indirect Rights are responsible, each with respect to him, for the execution of this Order, to be published in the Official Journal of the French Republic.
