Decree of 16 July 2004 amending the amended order of 21 March 1995 regulating the transport of dangerous goods by the fixed transmanche link

Minister of State, Minister of Economy, Finance and Industry, Minister of Equipment, Transport, Land Management, Tourism and the Sea and Minister of Ecology and Sustainable Development,
Considering the European Agreement concerning the International Carriage of Dangerous Goods by Road (Agreement "ADR");
Having regard to the restructured annexes A and B of this agreement entered into force on 1 January 2003, including chapter 1.9 of its annex A;
Having regard to Appendix I of Appendix B to the Convention on International Carriage by Rail (the so-called "COTIF" agreement) on the Regulations concerning the International Carriage of Dangerous Goods by Rail (the so-called "RID"), in its version applicable as of 1 January 2003, and in particular Chapter 1.9 of this Regulation;
In view of the Council ' s amended directive 94/55/EC of 21 November 1994 on the approximation of the legislation of member States concerning the transport of dangerous goods by road, including its article 5, paragraph 2;
Having regard to amended Council Directive 96/49/EC of 23 July 1996 on the approximation of the legislation of member States concerning the transport of dangerous goods by rail, including article 5, paragraph 2 (a);
Having regard to Act No. 263 of 5 February 1942 on the carriage by rail, road or inland navigation of dangerous or infectious substances in the nomenclature established by the Secretary of State for Communications;
Having regard to the amended decision of 21 March 1995 regulating the transport of dangerous goods by the fixed transmanche link, including its article 14;
Having regard to the amended decision of 1 June 2001 on the carriage of dangerous goods by road (known as "ADR");
Having regard to the amended decision of 5 June 2001 on the transport of dangerous goods by rail (see "RID Order");
In view of the opinion of the Inter-Ministerial Commission for the Transport of Dangerous Goods, in its session of 11 June 2003;
Having regard to the formal submission made on 23 December 2003 by concessionaires on the revision of Annexes A and B of the "volume F of safety provisions" (document IGC 14/00/061M entitled "Transport of dangerous substances");
Having regard to the letter dated 3 March 2004 from the Chairman of the Intergovernmental Commission,
Stop:

Article 1


Section 6 of the amended dated 21 March 1995 is amended as follows:
"As soon as it enters the transmanche fixed link, any vehicle or road assembly carrying dangerous goods is required to declare itself as such and to proceed to the route provided for this purpose. All transport documents issued pursuant to Chapter 5.4 of the ADR must be submitted to dealer representatives. If the vehicle is admitted to transit, an identification badge must be displayed visibly on the vehicle. This badge can only be removed at the exit of the transmanche fixed link.
The provisions of this Order shall also apply when the transport is carried below the quantities per transport unit provided for in 1.1.3.6 of the ADR. However, they do not apply when the only dangerous goods transported are in accordance with 1.1.3.2, 1.1.3.3 or 1.1.3.4 of the ADR. »

Article 2


Appendix A, Volume F. - Transportation of Dangerous Goods. - Appendix A: HGV shuttles from the amended dated March 21, 1995 order is cancelled and replaced by Appendix A, Volume F. - Transportation of Dangerous Goods. - Appendix A: Hazardous substances accepted for transport on HGV shuttles" attached to this Order.

Article 3


Appendix B, Volume F. - Transportation of Dangerous Goods. - Appendix B: Rail freight" of the amended dated 21 March 1995 is cancelled and replaced by Appendix B, Volume F. - Transportation of Dangerous Goods. - Appendix B: Hazardous substances accepted for transport on rail trains" attached to this Order.

Article 4


The Director of Land Transport and the Director General of Nuclear Safety and Radiation Protection are responsible, each with regard to the execution of this Order, to be published in the Official Journal of the French Republic.
